Add a human approval gate before material AI-assisted marketing outputs reach customers or the public. Give a named business owner accountability, assign a knowledgeable reviewer with authority to edit or block content, and connect review to evidence checks, testing, monitoring, escalation, and correction. The right process depends on the content, audience, channel, market, and degree of automation; a grammar check alone is not meaningful review for higher-stakes claims.
Human review does not automatically remove disclosure duties. In the EU, Article 50 transparency rules have applied since 2 August 2026, and the European Commission’s guidance describes a specific human-review exception for certain AI-generated public-interest text—not a blanket exemption for marketing content. The UK Competition and Markets Authority (CMA) also makes clear that businesses remain responsible for consumer-facing activity carried out by AI agents.
What does human review mean in an AI-assisted marketing workflow?
Human review is a deliberate, accountable check of an AI-assisted output before it is released, with a reviewer able to assess its substance and change, reject, or escalate it. It is not simply proofreading, nor does it transfer the business’s responsibility to the reviewer or the AI provider.
Marketing teams use AI at different points: drafting copy, editing, choosing or adapting content for an audience, recommending products, generating images or audio, and answering customers directly. Review should match the role the system plays and the consequences of an error. A typo in an internal brainstorming draft is different from a false price, unsupported health-related claim, or misleading offer displayed to a customer.

The CMA’s 9 March 2026 guidance says consumer-law duties apply whether information or a service is delivered by a person or an AI agent, and that the business remains responsible for an agent’s conduct. Its practical implication is straightforward: assigning a third-party tool to produce or deliver marketing does not make the resulting customer experience someone else’s problem.
Who should own and perform the review?
Name one business owner for the workflow and assign review to a person with relevant subject knowledge, audience understanding, and the authority to approve, amend, reject, or escalate the output. The person performing the review may vary by content type, but accountability should not be left implicit or delegated to the AI vendor.
Business owner
The owner defines where AI is used, what outputs need approval, who is qualified to review them, and how the business responds when something goes wrong. They remain accountable for the customer-facing outcome even when an outside provider supplies the system. For a campaign with several channels or markets, make sure ownership covers the whole release path rather than only the person who entered the prompt.
Reviewer
Choose a reviewer who can judge whether the content is accurate and suitable for its intended audience, not merely whether it reads smoothly. Depending on the material, that may require knowledge of the product, offer terms, audience, or applicable market. The reviewer needs actual authority to change or stop publication; an approval step that cannot affect the outcome is not a meaningful control.
For the particular EU Article 50 public-interest-text guidance discussed below, the European Commission says human review involves deliberate examination of the content’s substance by a person with relevant knowledge and professional judgment. It also says editorial control involves genuine authority to approve, change, or reject content on substantive grounds, including fact-checking and assessing source trustworthiness.
How do you decide which AI-assisted outputs need approval?
Start by inventorying AI’s role in the workflow, then route outputs for review when an error could materially mislead, disadvantage, or otherwise affect a customer. The examples below are practical triggers synthesized from consumer-protection and transparency guidance; they are not an exhaustive list of official legal requirements.

Map where AI participates
For each use, record the audience, market, channel, content type, degree of automation, and likely consequences of an error. Include cases where AI drafts or edits text, selects or personalizes content, makes recommendations, generates synthetic media, or communicates directly with customers. Note whether a person approves every output, samples a set, or intervenes only when a problem is flagged.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsRoute higher-consequence content to review
Consider requiring approval before release when content includes:
- Product capabilities, performance, or other factual claims that customers may rely on.
- Prices, discounts, offer terms, eligibility, or availability.
- Comparisons with competing products or services.
- Personalized recommendations or messages that may affect an individual customer’s decision.
- Synthetic people, voices, or other content that may affect how an audience understands who is speaking or what is real.
- Customer-facing agent responses, especially where the response could misstate a product, offer, or service.
- Material in a regulated or otherwise high-impact context.
These triggers are a sensible starting point, not a substitute for checking the requirements that apply to a particular market and use. A low-risk draft for internal discussion may need less scrutiny than a public campaign, while a direct-to-customer agent may need controls across many individual interactions.
What should a human check before marketing content goes live?
Review the content’s meaning and likely consumer effect, not just its grammar. Check claims against reliable evidence, confirm offer details, look for misleading implications or omissions, consider audience suitability and necessary consent, and verify that any description of AI’s role is accurate.
- Verify factual claims. Match important statements to trustworthy evidence and check that the content does not overstate what the product or service can do. If a claim cannot be supported, edit it, remove it, or hold the output for escalation.
- Confirm commercial details. Check prices, discounts, terms, eligibility, and availability against the information approved for the campaign and market. Do not assume that plausible-looking details generated by a system are current or correct.
- Assess the whole impression. Ask whether a reasonable customer could be misled by the wording, visual presentation, or an important detail that is missing. A technically accurate sentence can still give a misleading impression in context.
- Check consent and audience fit. Consider whether the workflow has the necessary consent for the activity and whether the content is appropriate for its intended audience. The CMA’s guidance specifically highlights fair treatment, misleading information, necessary consents, and performance evaluation.
- Check representations about AI. Make sure any statement about whether AI was used, what it did, or what a customer is interacting with is accurate. Then assess whether a disclosure obligation applies to the specific market, system, and content type.
- Make a decision with authority. Approve, edit, reject, or escalate. Do not treat a reviewer’s pass as approval if the reviewer cannot prevent release or request a substantive change.
A useful reviewer’s question is: “What might a customer reasonably take away from this, and can we support that takeaway?” This directs attention beyond sentence-level accuracy to the overall consumer impact.

How should you set up the approval gate?
Place the gate at the last practical point before customer-facing release, while preserving enough time for a substantive check and correction. Route the right version to the right reviewer, prevent unapproved material from being published, and retain a record of what was reviewed and decided.

- Define the release point. Identify where content moves from draft or testing into a live campaign, public post, personalized placement, or customer conversation. Specify which outputs must wait for approval.
- Route by subject and risk. Send claims, terms, recommendations, synthetic media, and agent responses to a reviewer who can evaluate the relevant content. If an output spans multiple areas, establish who resolves questions that cross those areas.
- Provide review context. Give the reviewer the intended audience, market, channel, relevant product or offer facts, and the evidence needed to check claims. Without context, an apparently polished output may be difficult to assess reliably.
- Require an explicit decision. Record whether the reviewer approved, edited, rejected, or escalated the item. Keep the approved version identifiable so that edits made after review do not silently bypass the gate.
- Keep the decision trail. Record the version reviewed, reviewer, decision, edits, supporting evidence, and any escalation. These details make it possible to understand what happened if a campaign needs correction.
- Connect approval to publishing. Ensure the release process does not treat submission, automated checks, or a completed grammar pass as approval. The gate must be able to hold material until the authorized decision is made.
There is no single review matrix, reviewer count, or approval time limit established by the cited guidance. Treat these workflow choices as operational design decisions: make them proportionate to the likely consequences, and ensure the reviewer has enough information and time to do the job meaningfully.
How do you test and monitor the workflow?
Test the system and its review process before deployment, then monitor whether outputs are correct, behave as intended, and comply with consumer-law requirements. Human review is one control in a continuing feedback loop—not a reason to assume the system will remain reliable after launch.
Before launch
Evaluate the system in the kinds of situations it will encounter, including the content types, audiences, and channels in scope. Use suitable testing to identify errors and improve the system or process before release. Assess whether reviewers receive the evidence and context they need and whether the approval gate can actually stop an unsuitable output.
After launch
Monitor performance against the intended use. Look for incorrect results, behavior that differs from what the business intended, and outcomes that may breach consumer-law requirements. Review should cover the system’s operation as well as individual campaign assets when AI is selecting, personalizing, recommending, or directly communicating at scale.
Give staff a clear escalation route when an output appears inaccurate, misleading, or otherwise non-compliant. The process should let an authorized person pause or stop a campaign or agent, investigate the cause, refine prompts or other process controls, and correct affected material quickly. The CMA particularly emphasizes prompt action when an agent may create non-compliant outcomes affecting many people or vulnerable customers.
Does human review remove AI disclosure requirements?
No. Whether disclosure is required depends on the jurisdiction, the system’s role, and the content or interaction involved. Do not treat a reviewer’s approval as a universal exemption from labeling or transparency obligations.

In the EU, the AI Act’s Article 50 transparency obligations have applied since 2 August 2026. The European Commission describes a deployer disclosure obligation for deepfakes and AI-generated or manipulated text on matters of public interest when published without human review or editorial control. For that specific text provision, the Commission says the relevant review must be substantive: “Superficial, solely formal, or procedural checks (e.g. spell-checking or grammatical correction) are not considered to be human review or editorial control.” That exception concerns the specified public-interest text context; it is not a blanket rule that human review removes disclosure duties for marketing material.
Recommended Free Tools
Article 50 also contains obligations that apply separately to providers of AI systems, including requirements concerning certain direct interactions with AI systems and marking generated outputs. Those provider duties should not be collapsed into a universal label rule for every marketing asset, nor confused with a deployer’s obligations. Check which role, system, output, and market apply to the activity at hand.
The IAB’s August 2026 Framework V2 offers an industry approach to marketing disclosure based on risk and materiality. Its scope includes AI-generated and AI-assisted text, imagery, video, audio, synthetic voices, digital twins, and AI-powered consumer interactions. It is an industry framework, not binding law; use it as a way to consider disclosure choices, not as a replacement for jurisdiction-specific legal analysis.
How should you choose between review workflow designs?
Compare possible designs by whether they cover the risks in your use case and give reviewers meaningful authority, traceability, and a way to stop or correct problematic outputs. The criteria below are a practical synthesis of the cited guidance, not a prescribed standard.
| Criterion | What to ask |
|---|---|
| Risk coverage | Does the process route consequential claims, offers, recommendations, synthetic media, and customer-facing interactions to an appropriate check? |
| Reviewer expertise | Can the reviewer assess the subject matter, evidence, audience, and market for this output? |
| Authority | Can the reviewer approve, edit, reject, or escalate before release? |
| Evidence traceability | Can you identify the reviewed version, decision, edits, and supporting evidence? |
| Review latency | Can the process support review before the planned release without encouraging teams to bypass it? |
| Escalation and pause | Can staff route difficult cases to a responsible decision-maker and pause a campaign or agent when needed? |
| Monitoring and correction | Can the business detect problems after launch and investigate and correct affected material quickly? |
| Disclosure fit | Does the workflow account for the applicable market, system role, content type, and transparency rules? |
A design that is fast but cannot prevent release is weak at the approval point. A design that captures every review but does not monitor live behavior is incomplete for systems that continue to generate or select customer-facing content.

- Proofreading instead of checking substance: polished grammar does not establish that claims, prices, or terms are correct.
- Approval without authority: a reviewer who cannot edit, reject, or stop publication cannot provide effective editorial control.
- Reviewing the wrong version: substantive changes after approval can invalidate the decision; keep the reviewed version identifiable.
- Assuming vendor responsibility: using an outside system does not remove the business’s responsibility for its customer-facing activity.
- Confusing a single legal exception with a general rule: EU guidance on human review of certain public-interest text does not make all reviewed marketing content exempt from disclosure.
- Stopping at launch: a pre-release check does not replace monitoring, escalation, or correction when a system continues to operate.
The CMA’s central warning is direct: “Ultimately, you will be responsible if an AI agent does something illegal, so it is important to make sure you think about compliance with consumer law from the start.”
What is a practical starting checklist?
Use this checklist to turn the principles into an operating process, adapting it to the channel, market, and consequences of each use.
- Identify each marketing task where AI drafts, edits, selects, personalizes, recommends, generates media, or communicates.
- Name the business owner and define the customer-facing outcomes they are accountable for.
- Set review triggers for claims, offers, recommendations, synthetic content, direct customer interaction, and higher-impact contexts.
- Assign reviewers with relevant expertise and authority to approve, amend, reject, or escalate.
- Give reviewers the context and evidence needed to assess facts, terms, omissions, consent, audience suitability, and AI representations.
- Hold release until there is a recorded decision on the version intended to go live.
- Test the system and review gate before deployment, then monitor performance and consumer-law compliance.
- Establish a way to pause or stop the activity, investigate errors, improve controls, and correct affected content.
- Check transparency obligations for each relevant jurisdiction, system role, interaction, and output type.
Frequently Asked Questions
Can the same person create and approve AI-generated marketing copy?
The cited guidance does not prescribe a minimum number of reviewers or require different people for every task. The essential control is that review is substantive and the reviewer has relevant knowledge and real authority to change or block the output; whether one person can meet that standard depends on the use and the applicable rules.
Does every AI-written social media post need a separate human sign-off?
The cited sources do not establish a universal per-post approval rule. Decide based on the output’s likely consequences, the degree of automation, and the relevant market and content rules; higher-consequence claims and customer interactions are sensible candidates for explicit review.
Is the IAB AI disclosure framework a legal requirement?
No. The IAB’s August 2026 Framework V2 is described as an industry approach based on risk and materiality, rather than binding law. A business still needs to determine which legal obligations apply in each market.
What should we do if an AI marketing agent has already sent incorrect information?
Escalate promptly, pause or stop the campaign or agent if needed, investigate the cause, and correct affected material. The CMA particularly emphasizes quick action where potentially non-compliant outcomes may affect many people or vulnerable customers.
