Public agencies should treat cloud-vendor review as a documented, risk-based authorization decision—not a hunt for a logo or certificate. Start by classifying the information and identifying legal, privacy, records, mission, availability, and continuity obligations. Convert those obligations into security and privacy controls, map every control to the agency, provider, or subcontractor, and require current independent evidence that the controls are implemented and working. Then make data location, access, disclosure, incident cooperation, retention, return, deletion, audit rights, and remediation enforceable in the contract. FedRAMP or another authorization can simplify evidence review, but it never transfers the agency’s responsibility for deciding whether the service is acceptable.

What should a public agency decide before comparing cloud providers?

Define what information will enter the service, what could happen if it is disclosed or unavailable, and which laws and policies apply. The resulting impact level and mission requirements determine the controls, evidence, contract terms, and monitoring intensity that a provider must meet.

Classify the information and its consequences

Use the agency’s applicable federal or jurisdictional categorization method. NIST’s government cloud roadmap explains that categorization drives the security and privacy controls required for a system. Document confidentiality, integrity, availability, privacy, records, and mission effects for each information type, including data created by the provider on the agency’s behalf.

  • Incident response, forensic cooperation, and communications
  • Resource management, certification, independent assessment, and audit access

NIST SP 800-144, Guidelines on Security and Privacy in Public Cloud Computing, is a useful source for structuring these requirements, but the agency must add its own statutes, policies, and mission constraints.

How does shared responsibility change the assessment?

The provider does not secure the entire service. Responsibility shifts among the agency, cloud provider, and subcontractors depending on whether the service is infrastructure, platform, or software.

Service model Provider commonly operates Agency must still govern or configure
IaaS Facilities, hardware, virtualization, core network, and managed platform components stated in the service boundary Guest operating systems, applications, identities, data, configurations, logging choices, and often encryption keys
PaaS Infrastructure, runtime, operating system, and platform security controls within the documented boundary Application code, data, user access, configuration, API permissions, and integration security
SaaS Application, runtime, infrastructure, and most operational security controls Users, roles, data classification, tenant settings, integrations, retention choices, and agency-side monitoring

These are typical boundaries, not a substitute for the provider’s system description. Build a control-by-control matrix that names the implementer and the evidence source for every requirement. Include subcontractors, managed security services, identity providers, backup operators, and support personnel. Put the allocation in the contract and service-level agreement (SLA), including who configures logging, encryption, key management, identity, backup, deletion, and incident communications.

Request the authorization and planning package

  • Current system security plan and privacy plan, including architecture, data flows, boundaries, regions, and external connections
  • Control implementation statements that explain how each control works in the actual service
  • Applicable security and privacy policies, standards, and configuration baselines
  • Authorization decision, impact level, inherited controls, conditions, and expiration or review dates
  • Plans of action and milestones (POA&Ms), open findings, risk acceptances, and remediation status

Request independent assessment results

Obtain the assessor’s procedures, test results, evidence examined, findings, severity ratings, and conclusions. NIST SP 800-53A provides customizable assessment procedures. The Risk Management Framework Assess step asks whether controls are implemented correctly, operating as intended, and producing the desired outcome for the organization’s security and privacy requirements. A report that lists only pass/fail conclusions without scope, sampling, dates, or findings is not enough to evaluate residual risk.

Validate operational evidence

  • Recent vulnerability scans, penetration-test summaries, remediation records, and exception approvals where relevant
  • Incident-response exercises, recovery tests, backup-restore results, and continuity test dates
  • Configuration and patching metrics, privileged-access reviews, and security-training records
  • Logging, alerting, detection, and service-level reports that the agency can actually receive
  • Subprocessor list, locations, functions, and the provider’s change-notification process

Set an evidence age limit in the solicitation and contract. Require notice when an assessment is superseded, a material finding is discovered, or the service boundary changes.

Is FedRAMP enough for a federal cloud service?

No. FedRAMP provides a common assessment and authorization approach and can support joint authorizations, but the agency still owns its authorization decision.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check the exact offering, not the company name

Verify the specific cloud service offering, authorization status, impact level, authorization boundary, regions, inherited controls, and date of the latest package and continuous-monitoring reports. A provider may have several offerings with different boundaries, features, or regions; evidence for one does not automatically cover another.

Use inherited controls carefully

Identify which controls are inherited from the underlying provider and which remain the agency’s responsibility. Confirm that the inherited service, region, identity path, logging tier, and encryption options match the configuration the agency will buy. Require the provider to identify controls that are shared, customer-configured, or excluded.

Apply the rule outside federal government

State and local agencies can use FedRAMP materials as useful evidence, but they must separately apply their own privacy, public-records, residency, procurement, breach-notification, and retention requirements. A federal authorization does not waive a state statute or local policy.

What should the cloud contract say about agency data?

Make every critical data-handling promise measurable, auditable, and enforceable. NIST SP 800-144 identifies contract subjects that should be explicit rather than left to a provider’s online terms.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ownership, location, and sovereignty

  • State that the agency retains ownership and control rights over its data, metadata, logs, and derived records as applicable.
  • List permitted storage, processing, support, and backup locations, including regions used for disaster recovery.
  • Require advance notice and agency approval, or a defined objection and exit right, for material location or subprocessor changes.
  • Disclose all subprocessors and their functions; flow down equivalent security, privacy, records, and deletion duties.

Access, disclosure, and visibility

  • Limit provider and subcontractor access to documented purposes, least privilege, screened personnel, and monitored sessions.
  • Require prompt notice of subpoenas, warrants, public-records requests, or other disclosures when legally permitted, plus assistance in asserting exemptions.
  • Give the agency access to relevant logs, audit reports, configuration data, and evidence needed for oversight and investigations.
  • Specify encryption in transit and at rest, key ownership or control, rotation, revocation, and emergency access procedures.

Incidents, availability, and recovery

  • Define incident categories, notification deadlines, update frequency, points of contact, and the information each notice must contain.
  • Require cooperation with containment, evidence preservation, forensic analysis, regulator notification, and public communications.
  • Set service levels, maintenance notice, backup frequency, recovery objectives, geographic redundancy, and tested restoration requirements.
  • State remedies for missed obligations, including corrective action, service credits where appropriate, indemnity or cost allocation, and termination rights.

Retention, return, and deletion

  • Map retention periods to the agency’s records schedule and legal holds; prohibit provider deletion while a hold or investigation applies.
  • Define export format, timing, cost, and assistance so the agency can retrieve usable data and audit history.
  • Require secure deletion or expunging from primary systems, replicas, caches, and backup media when authorized.
  • Require a signed deletion attestation identifying scope, method, date, exceptions, and any remaining copies with their scheduled destruction date.

Address restrictions on commingling where separation is legally or operationally necessary, and reserve audit and testing rights that are practical for a multi-tenant service.

How should an agency evaluate identity tokens, federation, and APIs?

Review these controls as part of the data-protection assessment because a stolen or misused identity assertion can bypass otherwise strong storage controls. NIST IR 8587, published in September 2026, highlights protections against forgery, theft, and misuse of identity tokens and assertions.

Test token issuance and validation

  • Identify who issues tokens, which signing algorithms and keys are used, and how keys are protected, rotated, revoked, and recovered.
  • Require strict issuer, audience, expiration, time-skew, and signature validation; reject tokens with unexpected claims or algorithms.
  • Use replay resistance, nonce or state protections where applicable, short lifetimes, and documented refresh-token handling.
  • Define revocation and lifecycle behavior for terminated users, changed roles, compromised credentials, and disabled applications.

Review federation and API authorization

Confirm interoperability with the agency’s identity provider, administrative separation, privileged-access controls, and logging of authentication and authorization decisions. For APIs, inspect scopes, object-level authorization, rate limits, secret storage, version changes, and machine-to-machine credentials. Require the provider to explain how token, federation, and API evidence is generated and shared with the agency, and how anomalies are monitored continuously.

How can agencies compare two or more providers fairly?

Use the same evidence request, control matrix, contract schedule, and scoring method for every bidder. Compare risk and operating burden, not just the presence of a certification.

Comparison axis Questions to answer
Control coverage and impact fit Does the exact service meet the agency’s information impact level and required controls?
Independent assessment Who assessed it, when, against which scope, with what findings and remediation evidence?
Authorization scope Do the authorization boundary, inherited controls, regions, and features match the proposed deployment?
Residency and subprocessors Where is data processed and supported, and can the provider change that without approval?
Encryption and keys Can the agency control keys, rotation, revocation, separation, and emergency access?
Identity, logging, and monitoring Can the agency configure controls and obtain timely logs, alerts, and assessment reports?
Incident and forensic access Are notification, cooperation, evidence preservation, and investigation rights specific and time-bound?
Backup, recovery, portability, and exit Are recovery tests, export formats, deletion proof, and termination assistance demonstrated?
Remedies and service levels Do the SLA, audit rights, corrective actions, and termination provisions create enforceable consequences?
Agency operating burden How much configuration, monitoring, staffing, and evidence collection must the agency perform itself?

Document scoring assumptions and unresolved risks. A provider with broader certifications may still impose more agency-side configuration or weaker residency and exit terms than a less heavily marketed alternative.

How does continuous monitoring keep the decision valid after award?

Authorization is a living decision. Define monitoring before award and connect the results to remediation, reauthorization, and contract remedies.

  1. Set the cadence and scope. Specify monthly, quarterly, annual, and event-driven reviews; identify controls, services, regions, subprocessors, and evidence included.
  2. Define evidence delivery. Require machine-readable or otherwise usable reports, control status, vulnerability and incident summaries, assessment updates, and access to relevant logs.
  3. Set notification thresholds. Establish deadlines for notifying the agency of incidents, critical vulnerabilities, material architecture changes, new subprocessors, region changes, and control failures.
  4. Track remediation. Record finding owner, severity, compensating controls, due date, risk acceptance authority, and closure evidence in the agency’s POA&M or equivalent register.
  5. Trigger reassessment. Reevaluate the service after material changes to architecture, identity flows, encryption, data types, regions, subcontractors, or legal obligations.
  6. Use results in authorization decisions. Continue, condition, suspend, or terminate authorization when evidence no longer supports the approved risk posture.

Require the provider to preserve evidence for the period needed by records, audit, litigation, and oversight rules. Monitoring that cannot reveal control drift or verify remediation is reporting, not effective oversight.

What are the most common assessment mistakes?

  • Accepting a certificate as the decision. A certificate has a scope, date, boundary, and assumptions; it does not evaluate the agency’s configuration or legal obligations.
  • Skipping the responsibility matrix. Unassigned controls such as logging, key management, backup, or deletion become silent gaps.
  • Ignoring subcontractors and support paths. Data may be accessed or replicated outside the named provider unless locations and functions are disclosed.
  • Writing vague incident language. “Prompt notice” is hard to enforce; specify clocks, content, contacts, evidence, and updates.
  • Leaving exit until termination. Without tested export and deletion procedures, the agency may be unable to meet records or continuity duties.
  • Failing to reassess identity integrations. Token, federation, and API changes can alter access without moving the storage boundary.
  • Closing findings without proof. Require retest results, updated plans, and evidence that the corrective control operates in production.

What is the defensible approval path?

Approve the service only when the agency can show a traceable chain from information categorization to controls, evidence, contract obligations, and ongoing monitoring. The authorizing official should document residual risk, conditions, accepted findings, and who is accountable for each shared control. NIST’s roadmap states that moving a system or service to the cloud does not change the authorizing official’s responsibility or authority; the agency remains answerable for the decision even when a provider supplies much of the infrastructure and evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Frequently Asked Questions

How often should a public agency refresh a cloud provider’s evidence?

Set a baseline cadence in the contract, then require event-driven updates after incidents, critical vulnerabilities, material architecture or subprocessor changes, and authorization-scope changes. The right interval depends on impact level and control volatility; high-risk services generally need more frequent evidence than stable, low-impact workloads.

Can an agency require data to stay inside one jurisdiction?

Yes, if the requirement is tied to law, policy, records, sovereignty, or mission risk and is written into the service boundary and contract. Include backup, support access, telemetry, disaster-recovery, and subprocessor locations so a residency promise does not cover only the primary database.

What should a provider do when it cannot share a penetration-test report?

The agency can accept a controlled alternative only if it still establishes scope, test dates, methods, material findings, remediation, and independent review. Options include an assessor briefing, secure-room review, executive summary plus findings register, or evidence under confidentiality terms; a marketing letter alone is not equivalent.

How can a small local agency handle continuous monitoring with limited staff?

Prioritize high-impact controls, identity integrations, incident evidence, location and subprocessor changes, and open critical findings. Use standardized evidence formats, shared services, and contractual report feeds, but retain an agency official who reviews exceptions and accepts residual risk.
