Police departments should buy an AI tool only after they can show that it solves a defined, lawful problem better than available alternatives, performs acceptably on representative local work, and can be governed throughout its life. A vendor demonstration or a high overall accuracy figure is not enough. The department needs an accountable owner, a cross-functional review team, an evidence-focused solicitation, an independent or otherwise credible field test, and a contract covering privacy, civil rights, security, updates, audits, human review, and exit. This process applies whether the system assists an analyst, recommends priorities, supports an investigation, or influences a decision affecting a person.

What should a police department define before issuing a solicitation?

Start with the operational problem and the decision the system could influence. The U.S. Department of Justice guidance says an agency should identify the problem, explain why AI is preferable, and establish oversight, workforce, monitoring, and evaluation structures before deployment.

Write the use case in plain language

Describe who will use the system, what information it will process, what output it will produce, and what action may follow. Identify the people who could be affected, the legal authority for the activity, and the consequences of an incorrect output. A federal definition reproduced in the U.S. Code compilation for Executive Order 14110 covers systems that make predictions, recommendations, or decisions influencing real or virtual environments; use that broad concept when deciding whether a proposed capability needs formal review.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Classify the decision impact

Label the proposed use as assistive, investigative, prioritizing, or rights-impacting. An assistive transcription tool and a system that ranks people or locations for enforcement should not pass through the same approval gate. The higher the potential effect on liberty, safety, access to services, or police attention, the stronger the evidence, human oversight, documentation, and public accountability should be.

Compare AI with realistic alternatives

Document the current process, a non-AI improvement, and the consequences of doing nothing. Include staff time, error patterns, accessibility, interoperability, and legal constraints in the alternatives analysis. The justification should explain what measurable benefit AI is expected to provide and why that benefit cannot be obtained more safely or cheaply by changing workflow, staffing, or existing software.

Set measurable outcomes and name one owner

Choose measures before seeing vendor results. They may include task accuracy, calibration, false-positive and false-negative rates, subgroup differences, operator workload, response time, safety incidents, complaints, cost, and downstream effects. Assign one accountable owner who can approve the use, monitor it, order a pause, and retire it; record separate responsibilities for procurement, technical security, legal review, frontline supervision, and records management.

Who should evaluate a police AI product?

A credible decision requires more than a technology buyer. Assemble a team with authority to challenge the business case and stop a deployment that creates unacceptable risk.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Command staff to connect the tool to policy, staffing, and operational accountability.
  • Procurement and finance staff to test pricing, competition, and total lifecycle cost.
  • IT, data, and security specialists to inspect architecture, access controls, logging, integrations, and resilience.
  • Privacy, records, civil-rights, and civil-liberties counsel to assess lawful purpose, data handling, retention, disclosure, and disparate effects.
  • Frontline users and supervisors who can describe actual workflows, exceptions, and workload.
  • Community, inspector-general, civilian-review, or other oversight representatives where the department’s law and governance structure allow.

Document who may approve acquisition, authorize each use, access outputs, investigate an incident, suspend the system, and authorize a restart. Require conflict disclosures and keep an auditable record of the evaluation, not just the final purchasing decision.

What should a police AI solicitation require vendors to disclose?

Make the request for proposals an evidence request, not a marketing exercise. Every material claim should be specific enough for the department to verify independently.

Demand information about purpose and limits

  • Intended uses, prohibited uses, assumptions, and environments in which the product was validated.
  • Known failure modes, edge cases, unacceptable uses, and examples of outputs that require human escalation.
  • Whether the system is assistive, investigative, prioritizing, or capable of influencing a rights-impacting decision.

Demand information about data and models

  • Training, validation, and test populations, including geography, time period, demographic coverage, labeling methods, and known gaps.
  • Data provenance, retention, deletion, secondary-use rights, subcontractor access, and whether customer data can be used to train a shared model.
  • Subgroup metrics, calibration information, error analysis, and independent test results, with the test protocol and sample description.
  • Model versioning, update schedules, change logs, release notes, and the events that would trigger a new validation.

Demand operational and security details

  • System architecture, hosting location, encryption, identity and access management, logging, vulnerability management, backup, and incident-response procedures.
  • Audit-log fields, export formats, retention periods, and the department’s ability to inspect records without vendor permission.
  • Accessibility, language support, application programming interfaces, data portability, interoperability, and offline or degraded-mode behavior.
  • References from comparable agencies and a list of claims the department may test during a pilot.
  • All pricing assumptions, implementation work, storage, support, training, upgrades, integration, and decommissioning costs.

The National Artificial Intelligence Advisory Committee (NAIAC) reported in April 2024 that producer testing is sometimes not independently verified and that operating conditions can change performance. Treat every vendor assertion as a hypothesis until the department confirms it under its own conditions.

How can a department score competing tools fairly?

Use a written matrix that scores mission performance and risk together. A product should not win because it has the best aggregate accuracy if its privacy, civil-rights, security, or reversibility risks are unacceptable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Mission performance: performance against a defined baseline and the actual task the department needs to improve.
  • Error behavior: accuracy, calibration, false-positive and false-negative rates, severity of each error, and how errors are detected.
  • Subgroup effects: differences in performance or burden across relevant populations and operating conditions.
  • Rights and safety: privacy, civil-rights, civil-liberties, safety, and the possibility of automation bias or misuse.
  • Explainability and traceability: whether users can understand the basis and limits of an output and reconstruct the inputs, version, and human action involved.
  • Security and resilience: protection against unauthorized access, manipulation, data leakage, outages, and compromised updates.
  • Human factors: training time, workload, interface clarity, override behavior, accessibility, and how supervisors review use.
  • Integration and reversibility: standards-based interfaces, exportable data, portability, and the ability to return to the prior process.
  • Lifecycle value: licensing, implementation, staffing, training, support, storage, audits, revalidation, incident response, and retirement.
  • Vendor accountability: transparency, independent evidence, update control, audit access, remedies, and willingness to support an exit.

Set minimum pass conditions for critical risks before calculating any weighted total. This prevents a strong score in one category from masking a disqualifying weakness in another.

How should a police department run a local AI field test?

Do not move directly from a paper evaluation to full deployment. Run a limited, representative test with pre-set measures, a baseline, safeguards, and a written stop rule.

  1. Write the protocol. Specify the use, users, time period, sample size, comparator or baseline, data sources, approved outputs, subgroup analyses, security checks, workload measures, cost measures, and who may see results.
  2. Use representative conditions. Test the workflows, data quality, languages, shift patterns, devices, and exception cases the department actually encounters. If local data are used, apply the jurisdiction’s privacy, records, and access rules.
  3. Define an error taxonomy. Record false positives, false negatives, abstentions, missing data, misleading confidence, unsafe recommendations, and operator overrides. Measure the consequence of each error, not merely its count.
  4. Measure subgroup performance. Compare relevant groups and contexts, document sample limitations, and investigate disparities rather than hiding them inside an overall average.
  5. Test human interaction. Observe whether users understand uncertainty, whether the interface encourages overreliance, how long review takes, and whether supervisors can detect and correct mistakes.
  6. Test security and change control. Check access permissions, logs, data flows, update handling, failure recovery, and behavior when an input or external service is unavailable.
  7. Use independent review when feasible. An evaluator who did not design the product or own the purchase can review the protocol, analysis, and conclusions. NAIAC’s checklist maps this work to the MAP and MEASURE stages of the NIST AI Risk Management Framework.
  8. Publish what can safely be published. Release the test plan and a plain-language results summary, including limitations, while protecting personal data, investigative information, and security-sensitive details.

Predefine the conditions for continuation, remediation, expansion, pause, or rejection. There is no universal accuracy threshold for every policing use; the acceptable level depends on the task, jurisdiction, affected people, alternatives, and consequence of error.

What should the AI contract require?

The contract must turn responsible-use promises into enforceable duties and practical exit rights.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Purpose and use limits: the approved use, prohibited inferences, prohibited autonomous enforcement decisions, authorized users, and required human review.
  • Data governance: ownership, permitted processing, confidentiality, retention, deletion, return, location, secondary use, subcontractors, and legally required records preservation.
  • Auditability: access to logs, relevant inputs and outputs, model and configuration versions, documentation, test evidence, and records needed to trace a decision.
  • Security: technical and organizational controls, vulnerability disclosure, access management, incident response, breach notification, recovery objectives, and cooperation with investigations.
  • Change control: advance notice of model, data, hosting, or material feature changes; release notes; risk assessment; and a department right to re-test before continued use.
  • Performance remedies: agreed measures, reporting, corrective-action timelines, service credits or other remedies where appropriate, and thresholds that require suspension or reapproval.
  • Liability and insurance: allocation for privacy, security, intellectual-property, and operational harms, including the effect of subcontractors.
  • Portability and exit: export in usable formats, deletion certification, transition assistance, continued access to records needed for legal obligations, and termination rights for unacceptable risk or repeated failure.

Require documentation sufficient to trace relevant inputs, outputs, user actions, overrides, and decisions. A contract that gives the department only a dashboard and a vendor assurance is not an auditable control.

How should a department pilot and operate the tool?

Adopt written operating procedures before the first live use. Limit the pilot to approved users, approved purposes, approved data, and a defined period.

  • Require a human to review and, where appropriate, override every consequential output.
  • Prohibit unapproved inferences, repurposing, sharing, or autonomous enforcement actions.
  • Define escalation for uncertain, harmful, discriminatory, or technically anomalous results.
  • Train everyone involved in acquisition, configuration, use, supervision, records, and incident response; training should cover limitations and automation bias, not just button clicks.
  • Record each use, material output, human decision, override, complaint, incident, and corrective action according to applicable records rules.

The UK Home Office’s police artificial-intelligence factsheet, updated October 22, 2026, states that responsible deployment must be lawful, ethical, transparent, based on robust assessment before use, and supported by clear accountability and operating procedures. Those principles are useful even when a department operates outside the United Kingdom, but local law controls.

What should be monitored after deployment?

Approval is the beginning of governance, not the end. Review performance on a schedule and whenever the model, data, workflow, population, or legal context changes.

Which public frameworks and evidence should guide procurement?

Use the framework that applies to the department’s jurisdiction, then add local law, policy, collective-bargaining obligations, records rules, and public-disclosure requirements.

  • U.S. Department of Justice guidance: emphasizes defining the problem and lawful purpose, explaining why AI is preferable, and establishing oversight, workforce, monitoring, and evaluation structures.
  • NAIAC Law Enforcement Subcommittee, April 2024: says, “The responsible use of AI in law enforcement requires AI developers to train, test, and audit their AI tools to ensure that the results of a predictive tool are sufficiently accurate, non-discriminatory, rights-respecting, and cost-effective.” Its checklist addresses the MAP and MEASURE stages of the NIST AI Risk Management Framework.
  • Executive Order 14110 principles: the U.S. Code compilation reproduces the direction that “Agencies shall ensure that their AI applications are regularly tested against these Principles.” Departments should translate that requirement into their own testing, documentation, and review rules where applicable.
  • UK Home Office policy: its October 22, 2026 factsheet records more than £50 million in direct grants for police AI projects since the 2024 election and £115 million announced for police adoption of AI and automation. Those funding figures describe the United Kingdom and are not a procurement budget for other jurisdictions.

The scale of the sector makes disciplined procurement important: the Federation of American Scientists reported in 2026 that the United States has more than 18,000 law-enforcement agencies, each with different missions, laws, data, and oversight arrangements. No single template can set the right threshold for all of them.

What are the most common procurement failures?

Most failures come from treating AI as ordinary software or accepting a vendor’s preferred evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Buying the demo: fix it by requiring a local field test against a baseline before expansion.
  • Using one accuracy number: add calibration, error costs, subgroup analysis, workload, safety, privacy, and security measures.
  • Skipping alternatives analysis: document non-AI options and the reason AI is proportionate to the problem.
  • Leaving ownership vague: name one accountable owner and publish approval, monitoring, suspension, and retirement responsibilities.
  • Allowing silent updates: require version notice, release notes, re-test triggers, and a right to pause.
  • Ignoring exit: require portable data, deletion certification, transition assistance, and access to records needed for legal duties.
  • Training only operators: train procurement, supervisors, records staff, security teams, and investigators who may rely on or challenge outputs.
  • Publishing nothing: release a clear use description and test summary whenever law and security permit so oversight is possible.

A responsible purchase is therefore a lifecycle decision: define, compare, test, contract, pilot, monitor, disclose, and retire when the evidence no longer supports continued use.

Frequently Asked Questions

Can a department skip a full pilot for a low-risk administrative AI tool?

A lower-impact use may justify a lighter review, but it still needs a defined purpose, data assessment, security review, accountable owner, and documented acceptance criteria. If the tool later influences investigations, prioritization, or a person’s treatment, the department should reclassify it and apply the stronger field-testing and oversight requirements.

How should a department pay for an independent evaluator without creating a conflict?

Put evaluation costs in the procurement plan and require the evaluator to disclose financial or personal ties to the department and bidders. If a vendor funds the work, the contract should preserve the evaluator’s control over methods, access to evidence, and publication of findings.

What should be disclosed to the public about a police AI system?

At minimum, publish the system’s purpose, approved and prohibited uses, accountable office, broad data categories, human-review rules, and a plain-language summary of field-test and monitoring results. Withhold personal, investigative, or security-sensitive details only under a documented legal basis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What happens when a vendor releases a major model update during a contract?

Treat it as a change-control event, not routine maintenance. Require notice and documentation, run the agreed re-test or risk review, keep the prior version available when feasible, and suspend use if the new version misses a safety, fairness, security, or performance condition.
