Under the EU AI Act, providers and deployers of covered high-risk AI systems must keep logs under their control for a purpose-appropriate period of at least six months, subject to applicable Union or national law. Outside that scoped rule, set and document a period for each log category based on its purpose, applicable privacy and other legal duties, and the system’s deployment context.
What retention period does the EU AI Act require?
For covered high-risk AI systems, the EU AI Act sets a minimum for automatically generated logs under the relevant operator’s control: at least six months, for a period appropriate to the system’s intended purpose, unless applicable Union or national law provides otherwise. Article 19(1) applies to providers; Article 26(6) sets a corresponding requirement for deployers. The rule is not a general six-month mandate for every AI system, every log, or every country. See Regulation (EU) 2024/1689, Articles 19 and 26.
The Act also distinguishes the ability to record events from how long logs must be kept. Article 12 requires covered high-risk systems to technically allow automatic event recording over the system’s lifetime. The retention provisions address covered logs under provider or deployer control; logging capability does not itself mean every record must be stored indefinitely.
Why six months is not a universal answer
System scope and who controls the logs matter
First establish whether the system is classified as high-risk under the EU AI Act, which operator’s role is relevant, and which logs are actually under that operator’s control. Other systems and jurisdictions may have different requirements. The AI Act’s six-month minimum should not be applied automatically to ordinary operational telemetry or systems outside its scope.

Personal data can limit retention
When logs contain personal data, the GDPR’s storage-limitation principle generally requires keeping identifiable data “for no longer than is necessary” for the processing purpose, subject to the regulation’s exceptions and safeguards. The AI Act’s retention language also recognizes that applicable data-protection law can affect the period. A policy therefore needs to reconcile applicable duties for the actual data and purpose rather than treating six months as permission to retain every identifiable field for that long. Other records have different clocks
The AI Act’s ten-year period in Article 18 applies to specified provider technical and quality-system documentation after the system is placed on the market or put into service. It is not a general ten-year retention period for automatically generated operational logs. Keep documentation and event logs in separate retention categories.

How to set a defensible retention schedule
- Inventory log categories. List safety events, system or model version and configuration records, input/output traces, human interventions, incident records, security or access events, and operational telemetry. Record each category’s owner, system, storage location, and whether it contains personal or sensitive data.
- Give each category a specific purpose. Examples include safety-risk detection, incident investigation, post-market monitoring, security response, audit, or a defined legal or contractual obligation. Avoid keeping identifiable content simply because it might be useful someday.
- Map applicable requirements and control. Check system classification, provider or deployer role, who controls each record, applicable data-protection and sector rules, contracts, litigation holds, and national requirements. Build any applicable minimum into the schedule, while obtaining qualified legal review where requirements may conflict or have exceptions.
- Choose and document a period for each category. The period should cover the legitimate monitoring, investigation, or accountability need and account for applicable legal or contractual requirements. Record the reasoning; there is no established default duration for non-high-risk systems, ordinary telemetry, or every jurisdiction.
- Set review, deletion, and exception procedures. At expiry, erase or anonymise data where appropriate. If a legal hold or other basis requires longer retention, document its basis, scope, owner, and review date. UK Information Commissioner’s Office guidance recommends documented retention periods where possible, regular review, and deletion or anonymisation when data is no longer needed. Its storage-limitation guidance says it is under review following UK Data (Use and Access) Act changes, so consult current applicable guidance. - Keep retention separate from access controls. Restrict access and protect retained logs, but do not treat security controls as a reason to keep data beyond its purpose. GDPR principles address both storage limitation and integrity and confidentiality.
Compare log categories before choosing periods
Use the same decision factors for each category, but do not assume that different logs need identical schedules.
- Purpose and detection window: How long could a relevant safety issue take to surface, and how long is evidence needed for a legitimate investigation or monitoring task?
- Legal or contractual floor: Does an applicable law, contract, or hold require a minimum or an exception?
- Identifiability and sensitivity: Does the log expose personal or sensitive information, and can those fields be removed or reduced?
- Control and role: Is the provider, deployer, or another party responsible for the record, and who actually controls it?
- Evidence value versus exposure: Would aggregation, redaction, or anonymisation preserve useful safety evidence while reducing the risk of retaining identifiable content?
- Operational feasibility: Can the organization retrieve relevant records when justified and securely delete them when the schedule expires?
Longer retention can preserve evidence for later review, but extends the period during which personal or sensitive data must be protected. Shorter retention reduces that exposure but can remove evidence needed for a justified monitoring or investigation purpose. Treat this as a policy trade-off, not a quantified universal formula.

What standards and guidance do—and do not—settle
The UK ICO offers practical guidance on purpose-based retention and AI data minimisation, but its storage-limitation page notes that it is under review. NIST’s AI Risk Management Framework page reports that version 1.0 is being revised; the page does not establish a specific AI log-retention period. Neither source supplies a universal duration that replaces the system- and jurisdiction-specific analysis above. See the NIST AI Risk Management Framework page.
The right schedule for a particular organization depends on system classification, deployment context, log fields and purposes, role allocation, countries, sector rules, and contracts. Have qualified counsel review the policy where those obligations or the interaction between the AI Act and data-protection duties is uncertain.
