There is no single number of days for an NLRB union-recognition case. In a typical representation case, the process runs from an RC petition and showing of interest through unit review, an election, counting and resolving challenged ballots or objections, and certification. Current NLRB procedures generally open a pre-election hearing about 8 calendar days after the hearing notice, require the employer to post the Notice of Petition for Election within 2 business days, and schedule the election for the earliest practicable date. The NLRB’s customer-service standard says an election normally occurs within 25–30 days after a regional decision following hearing issues. A clean case can therefore move in weeks, while disputes, post-election hearings, Board review or litigation can extend certification for months.

This guide explains each stage, the timing anchors that actually apply, and how voluntary recognition differs from an NLRB election. It is written for the RC process used when a union seeks initial certification; RD and RM petitions follow related but different procedural postures.

What “union recognition” means in an NLRB case

Recognition is the legal point at which an employer accepts a union as the employees’ bargaining representative. That can happen voluntarily, outside an NLRB election, or through Board certification after a secret-ballot election. Those routes should not be treated as interchangeable: they use different evidence, deadlines, safeguards and opportunities for review.

RC, RD and RM petitions

An RC petition is generally filed by a union seeking initial certification as the representative of an unrepresented unit. An RD petition is typically used to seek decertification of an existing representative, while an RM petition is filed by an employer seeking an election when competing representation claims or uncertainty exist. The timeline in this article focuses on an RC petition, because that is the usual question behind “How long does it take to get union recognition?”

What certification establishes

After a valid election, the NLRB certifies the union if it receives a majority of the votes cast, not a majority of every employee in the proposed unit. Certification establishes the union as the employees’ exclusive bargaining representative. It does not itself produce a collective-bargaining agreement; bargaining is a later stage.

The NLRB recognition timeline at a glance

Stage What happens Timing anchor or outcome
Petition and showing of interest The union files an RC petition and submits evidence that enough employees support an election. The Regional Office investigates jurisdiction, unit questions and whether a genuine representation question exists. No universal deadline for the entire case.
Agreement or pre-election hearing Parties may agree on the unit, voter eligibility and election details. If they do not, the Regional Office conducts a pre-election hearing. Under the current rule, a typical hearing generally opens about 8 calendar days after the Notice of Hearing is served.
Employer notice The employer posts and distributes the Notice of Petition for Election as directed by the Regional Office. Generally within 2 business days of service of the notice.
Regional decision and election notice The Regional Director decides whether a question of representation exists and ordinarily specifies the election type, date, time, location and eligibility period. Election is set for the earliest practicable date; there is no mandatory 20-business-day waiting period.
Campaign and secret-ballot voting Union and employer communicate with employees under applicable labor-law limits. Eligible employees vote by secret ballot. The NLRB says an election normally occurs within 25–30 days after a regional decision following hearing issues.
Tally and post-election disputes Ballots are counted. Parties may challenge a voter’s eligibility or file objections alleging conduct that affected the election. Determinative challenges or substantial objections can require investigation or a post-election hearing.
Certification or dismissal The Regional Office resolves outstanding issues and certifies the union or dismisses the petition, depending on the result and Board procedures. After certification, election results or petition dismissal, a party generally has 14 days to request Board review.

Step 1: Filing the petition and showing of interest

The process starts when the union files an RC petition with the appropriate NLRB Regional Office. The petition identifies the employer, the proposed bargaining unit and the union’s claim that employees should be represented. It must be supported by a showing of interest—usually authorization cards or another accepted form of employee support. The showing is used to establish that an election is warranted; it is not itself the final vote.

The Regional Office investigates threshold matters such as the employer’s coverage under the National Labor Relations Act, the proposed unit, whether another petition or certification blocks the case, and whether the filing presents a question of representation. The evidence and legal issues at this stage influence how quickly the case moves. A complete petition with no jurisdiction or unit dispute can proceed faster than one requiring extensive fact gathering.

What authorization cards do—and do not—do

Signing an authorization card can help the union satisfy the showing-of-interest requirement and may support a request for voluntary recognition. It does not automatically make the union the certified representative. Certification normally follows the secret-ballot process unless the employer chooses voluntary recognition under the separate rules described below.

Step 2: Defining the bargaining unit and preparing for a hearing

The proposed bargaining unit determines which employees may vote and which employees the union would represent. Typical disputes concern job classifications, supervisors, managers, temporary workers, remote employees, locations and whether separate groups share a community of interest. Parties can agree on the unit and election details, avoiding a contested hearing. If they cannot, the Regional Office issues a Notice of Hearing.

The eight-day pre-election hearing anchor

Under the NLRB’s current representation-case rule, a pre-election hearing generally opens about 8 calendar days after the Notice of Hearing is served. “About” matters: the rule supplies a general scheduling anchor, not a promise that every hearing will begin or finish on the eighth day. Motions, service problems, unusual factual issues and regional scheduling can affect the actual date.

The employer’s notice obligation

The employer generally must post and distribute the Notice of Petition for Election within 2 business days after service. The notice tells employees that a petition has been filed and explains where and when they can review the information. Failure to post or distribute it as required can create additional compliance issues and may affect scheduling.

Agreed election versus contested hearing

Feature Agreed election Contested pre-election hearing
Unit and eligibility Parties stipulate to the unit and key voter-eligibility terms, subject to Regional Office approval. Parties present evidence and legal arguments about disputed classifications, locations or other unit questions.
Scheduling Can move directly toward an election date once the Regional Office accepts the agreement. Hearing must be noticed and conducted before the Regional Director decides disputed issues.
Delay risk Lower if the agreement is complete and no later dispute arises. Higher because hearing preparation, a written decision, requests for review or litigation may intervene.
Trade-off Faster certainty, but each side gives up the chance to litigate every disputed unit issue before voting. More opportunity to develop a record and preserve legal arguments, at the cost of time and expense.

Step 3: Regional decision and election notice

After an agreement or hearing, the Regional Director determines whether a question concerning representation exists. The decision ordinarily identifies the election type, the date, time and location, and the eligibility period used to determine who may vote. The Regional Office sets the election for the earliest practicable date under the governing procedures.

Older summaries sometimes describe a mandatory 20-business-day waiting period. That is not the current general rule. The NLRB’s present framework does not require that fixed wait; the practical date depends on the Regional Office’s schedule, the parties’ submissions, voting logistics and any unresolved procedural matter.

How the 25–30-day standard fits

The NLRB’s customer-service standards state that an election normally occurs within 25–30 days after a regional decision following hearing issues. This is a service expectation, not a guaranteed statutory deadline and not an average for every case. It is most useful as a planning estimate after a Regional Director has issued the decision that resolves hearing issues. An agreed election may follow a different schedule, and an appeal, unusual logistics or a later order can change the date.

Step 4: Campaign period and secret-ballot voting

Once the election is scheduled, the union and employer communicate with employees about representation. Employees receive the Regional Office’s instructions on eligibility, polling arrangements and voting procedures. The ballot is secret, so the employer and union do not learn how an individual employee voted.

Who can vote

Eligibility is controlled by the unit description and the eligibility period in the election notice. Employees whose status is disputed may be allowed to vote subject to challenge. A challenged ballot is placed aside rather than immediately counted as part of the uncontested tally.

What happens on election day

  1. The Regional Office or its designated agent opens the polling process at the stated time and location, or administers an approved mail or other authorized procedure.
  2. Employees check in against the eligibility list and receive a secret ballot if they are eligible under the election notice.
  3. Employees mark the ballot privately and place it in the ballot box or return it under the stated instructions.
  4. At the close of voting, the ballots are secured and counted under NLRB procedures.

Campaign disputes can become post-election objections if a party alleges conduct that materially affected the result. Employees and parties should preserve relevant notices, communications and witness information while events are fresh.

Step 5: Tally, challenged ballots and objections

The Regional Office prepares a tally showing the votes for and against representation, the number of valid ballots, and any challenged or otherwise unresolved ballots. The tally may immediately show a majority, but certification can still wait when unresolved issues could change the outcome.

When a challenged ballot is determinative

A challenge is determinative when the number of challenged ballots could affect which side has a majority of valid votes. For example, if the union leads by one vote and two eligibility challenges could be counted for either side, the Regional Office must resolve those challenges before declaring the result. If challenged ballots cannot affect the outcome, they may not require a full investigation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Objections to election conduct

A party may file objections alleging conduct that affected the fairness or reliability of the election. The Regional Office may investigate, recommend a remedy, or schedule a post-election hearing. Remedies can range from overruling the objection to ordering corrective action or a rerun election when the circumstances warrant it.

Post-election timing anchors

The NLRB’s customer-service standards state that a regional report or supplemental decision after challenges or objections is expected in 35 days without a post-election hearing or 85 days with a post-election hearing. These figures are service standards, not guaranteed completion dates. They begin to matter after the post-election issues are presented and do not include every possible appeal or court proceeding.

Step 6: Certification, dismissal and review

When all outcome-changing challenges and objections are resolved, the Regional Office applies the Board’s rules to the tally. If the union has a majority of votes cast, the Board certifies it. If it does not, the petition is dismissed or the result is otherwise handled under Board procedures.

Parties generally may request Board review within 14 days of certification, the election results or dismissal of the petition. A request for review can extend the time before the result becomes final. Further litigation is possible in some circumstances, particularly when a party contests the Board’s order or an employer’s legal obligations.

Certification is not the first contract

Certification gives the union the right and responsibility to bargain for the unit. The parties then have to negotiate wages, benefits, scheduling, discipline, grievance procedures and other terms. The time needed to reach a first agreement is separate from the recognition timeline and is not included in the NLRB election estimates.

Why some cases finish in weeks and others take months

  • Unit disagreement: Disputes over classifications, locations or supervisory status can require a hearing and a detailed record.
  • Incomplete or contested filings: Questions about jurisdiction, the showing of interest or the petition’s description can require additional investigation.
  • Regional scheduling: Hearing and polling availability varies by office and by the practical requirements of the proposed election.
  • Board review: A party may ask the Board to review a Regional Director’s decision or the election result within the applicable period.
  • Challenged ballots: Eligibility disputes delay the tally when the challenged votes could change the outcome.
  • Objections: Allegations of coercion, improper conduct or other election interference can trigger investigation or a post-election hearing.
  • Rerun elections: If the Board finds that conduct prevented a fair election, another vote may be ordered.
  • Court proceedings: Litigation or enforcement actions can extend the schedule beyond the Regional Office’s service standards.

These contingencies explain why a responsible estimate uses ranges and milestones rather than promising that every petition will be certified on a particular day.

Voluntary recognition: a different route

An employer may voluntarily recognize a union after the union demonstrates majority support through signed authorization cards or another accepted method. Because the employer agrees to recognize the union, there is no NLRB secret-ballot election, election tally or ordinary election-objection process. The parties can therefore control the recognition date more directly than they can in a contested Board case, although the agreement must comply with labor law.

The 45-day notice period

When voluntary recognition is reported to the NLRB, a 45-day notice period can apply during which a properly supported petition may be filed. This gives employees or another party an opportunity to seek an election under the Board’s procedures.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The bargaining period after voluntary recognition

Under NLRB guidance, voluntary recognition can be followed by a reasonable bargaining period of at least six months and no more than one year. The period is intended to provide a meaningful opportunity for the newly recognized representative and employer to bargain before a decertification petition may be entertained under the applicable rules. It is not a promise that a first contract will be reached within that time.

Question Voluntary recognition NLRB election and certification
Evidence of majority support Employer accepts authorization cards or another showing as sufficient for recognition. Union first uses a showing of interest to obtain an election; the secret-ballot vote determines certification.
Procedural safeguards No Board-run vote is required at the recognition moment, although a 45-day notice period can allow a petition. Regional Office procedures govern notice, eligibility, polling, counting and objections.
Timing control Employer and union can set recognition once an agreement is reached, subject to legal requirements and notice rules. Timing follows petition investigation, unit decisions, election scheduling and any post-election process.
Review rights Challenges focus on the validity and legal effect of the recognition agreement and subsequent filings. Parties can request Board review within 14 days of certification, election results or petition dismissal.
Exposure to objections or litigation No election objections to a vote, but the recognition can still be contested through a supported petition or other legal challenge. Challenges, objections, post-election hearings, review and litigation can delay certification.

How to estimate a case realistically

To estimate a date, identify the case’s current procedural event rather than counting from the first organizing activity. Authorization cards, internal union elections and employer meetings may occur before any NLRB petition and do not start an NLRB deadline.

  1. Confirm the route: Determine whether the parties are pursuing voluntary recognition, an RC petition, an RD petition or an RM petition.
  2. Locate the last formal NLRB event: Use the petition filing, Notice of Hearing, Regional Director decision, election date, tally or post-election report—not an informal campaign milestone.
  3. Check for a unit dispute: An agreed unit generally removes the need for a contested pre-election hearing; a dispute can invoke the approximately 8-calendar-day hearing schedule and subsequent decision time.
  4. Apply the relevant anchor: Use 2 business days for the employer’s general notice-posting obligation, 25–30 days from a regional decision following hearing issues to the expected election, or 35/85 days for a post-election report depending on whether a hearing is required.
  5. Add unresolved contingencies: Account for determinative challenges, objections, a request for review within 14 days, rerun-election orders and any court proceeding.
  6. Separate recognition from bargaining: Certification or voluntary recognition is not the same as reaching a first collective-bargaining agreement.

Common questions about the NLRB timeline

How long after filing an NLRB petition is the election?

There is no universal filing-to-election deadline. If hearing issues are contested, the current framework generally points to a pre-election hearing opening about 8 calendar days after notice, followed by a Regional Director’s decision. The NLRB’s customer-service standard says the election normally occurs within 25–30 days after that regional decision. The actual filing-to-election period depends on investigation, agreement, hearing issues and review requests.

Do authorization cards guarantee recognition?

No. Cards can satisfy the showing-of-interest requirement for an election and may support voluntary recognition, but they do not by themselves produce NLRB certification. In an election case, employees must vote and the union must obtain a majority of votes cast.

Can challenged ballots delay certification?

Yes. If challenged ballots are determinative, the Regional Office must investigate and resolve them before the result can be certified. If they cannot change the outcome, the case may proceed without a full hearing on those challenges.

Is an NLRB election always required?

No. An employer can voluntarily recognize a union after majority support is shown. A 45-day notice period can apply after the recognition is reported, and NLRB guidance describes a reasonable bargaining period of at least six months and no more than one year. If the parties do not use voluntary recognition, an RC petition normally proceeds through the Board’s election process.

What does the 35-day or 85-day figure mean?

Those are NLRB customer-service standards for a regional report or supplemental decision after challenges or objections: 35 days when no post-election hearing is needed and 85 days when one is held. They are not guaranteed deadlines and do not include every possible request for review or litigation.

Practical takeaway

Plan an NLRB recognition case as a sequence of decisions, not a fixed countdown. The cleanest path can reach a secret-ballot election in roughly the weeks covered by the Regional Office’s 25–30-day standard after a hearing-related decision. Certification follows only after the tally and any outcome-changing challenges or objections are resolved. A contested unit, determinative challenged ballots, a post-election hearing, Board review or litigation can move the finish well beyond that window. Voluntary recognition can be faster at the recognition stage, but it has its own 45-day notice and six-month-to-one-year bargaining-period rules.
