The Federal Trade Commission and attorneys general from 20 states sued Dollar General Corporation on October 26, 2026, alleging that the retailer repeatedly charged shoppers more at the register than prices shown on shelves, tags or advertisements. The civil complaint, filed in the U.S. District Court for the Middle District of Tennessee, says the practice continued for years despite customer complaints and internal knowledge. Dollar General has not been found liable: the case is pending, and the court will decide whether the allegations are proven.
Why is Dollar General being sued?
The FTC and the states allege that Dollar General’s checkout prices often exceeded the lower prices displayed in stores or advertising. Their complaint says the alleged mismatch was not an isolated mistake but a recurring practice that persisted after the company received complaints and faced earlier state enforcement.
The filing identifies at least 29,265 Dollar General complaints categorized as “Did Not Honor Marked Price” from January 1, 2023, through March 31, 2026. Those complaints came from all 48 states where the company operated during the period, according to the complaint.
The FTC says filing a complaint means it had reason to believe the defendants were violating, or were about to violate, the law. It is not a final finding by a judge.

What price differences does the complaint describe?
The central issue is the difference between an advertised or shelf price and the amount charged by the register. The complaint cites examples from shoppers in three states:
- A Massachusetts customer saw trail mix advertised at $2.75 and was charged $5.
- An Ohio customer saw milk marked at $3.95 and was charged $4.25.
- An Alabama customer saw Twinkies marked at $2.50 and was charged $3.50.
State inspectors also reported discrepancies during store checks. The figures below are allegations summarized in the 2026 federal complaint.
| State | Inspection period | Result described in complaint |
|---|---|---|
| Iowa | January 23, 2023–June 27, 2024 | All eight inspections of seven stores found failures; 18% of items tested were overcharged |
| Wisconsin | 2023 | 662 overcharged products out of 7,344 scanned (9%); average overcharge was 17% above the stated price |
| Arkansas | January 4, 2023–April 15, 2026 | At least 20.1% of 392 inspections failed |
These inspection results do not establish that every store or transaction was inaccurate. They are evidence the plaintiffs say supports their broader allegations.

The federal venue is the Middle District of Tennessee. The defendant is Dollar General Corporation, also doing business as Dollar General.
Why could the alleged overcharging affect low-income and rural shoppers?
The complaint describes a large store footprint and a customer base for whom small price differences can matter. Its company overview lists 20,893 stores in 48 states and Mexico; a separate FTC description says the company operates more than 21,000 stores nationwide, a difference that reflects the sources’ different counting and rounding.
- About 80% of the stores are in towns with 20,000 or fewer residents.
- About 75% of the U.S. population lives within five miles of a store.
- Households earning $35,000 or less account for 60% of company revenue, according to the complaint.
- The company sells about 2,000 items priced at $1 or less.
The plaintiffs argue that inaccurate shelf-to-register pricing can therefore impose particular harm on rural shoppers and households managing tight budgets. FTC Bureau of Consumer Protection Director Christopher Mufarrige said the alleged conduct “betrayed the trust” of consumers and caused financial harm; Michigan Attorney General Dana Nessel said shoppers deserve respectful treatment in any store.

What laws does the complaint invoke?
The FTC alleges violations of Section 5(a) of the Federal Trade Commission Act and the Gramm-Leach-Bliley Act. The states also plead violations of their own consumer-protection and weights-and-measures laws. Michigan invokes its Shopping Reform and Modernization Act, commonly called the state’s “Scanner Law.”
The complaint asks the court for a permanent injunction, monetary relief, civil penalties and other remedies. Those requests are proposals by the plaintiffs, not orders that Dollar General must pay now.
What prior pricing settlements does Dollar General have?
The complaint lists seven pricing settlements with six state attorneys general or consumer-protection agencies between 2019 and 2026. It says the settlements totaled more than $6 million.

If a register price exceeds a posted price, keep the receipt and record the store location, date and time, product, shelf or advertisement price, and checkout price. A clear photo of the price display alongside the product can help preserve the difference. You can ask the store to correct the transaction and can report suspected violations to your state attorney general or consumer-protection and weights-and-measures office; any remedy depends on the applicable state law and the facts.

What happens next in the federal case?
Dollar General will have an opportunity to respond to the complaint. The case can proceed through motions and evidence gathering, and it could end in a negotiated settlement or a court decision after litigation. Until that process is complete, the allegations, inspection figures and requested penalties remain disputed matters for the court to evaluate.
The Associated Press reported that Dollar General had not immediately returned a request for comment at publication time. A response from the company, later filings and any court orders could change what relief, if any, becomes available.
Frequently Asked Questions
Does the complaint mean every Dollar General receipt contains an overcharge?
No. The filing alleges a recurring pattern and cites complaints and inspections, but it does not establish that every store or transaction was wrong. The court must assess the evidence and the company’s defenses.
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Will earlier state settlements automatically increase payments in this case?
No. The listed state settlements were separate enforcement matters. They may be cited as background, but they do not create an automatic refund or determine the remedy in the federal lawsuit.
What proof is most useful if my shelf and register prices differ?
Keep the itemized receipt and capture a dated photo showing the product and posted price before it changes. Note the store, product identifier, transaction time and both prices so an investigator can match the report to a specific sale.
Could the case create a consumer claims program later?
It could, if a later court order or settlement provides for redress, but no such program has been announced. Any legitimate process would specify eligibility, deadlines and an official administrator.
