These are risk arguments about potential access and control—not proof that the Chinese government has used TikTok to spy on Americans or manipulate their feeds. The legal and ownership picture changed in 2025 and 2026, but the public materials described here do not independently establish how well the new safeguards work in practice.
1. Could TikTok user data be accessible to China?
The concern starts with the amount and variety of information a large social platform can handle. U.S. officials have argued that access to sensitive data about millions of Americans could create national-security risks. In its account of congressional testimony, the Congressional Research Service (CRS) reported that TikTok’s CEO testified in March 2023 that ByteDance retained in China at least seven years of U.S. TikTok users’ data.
That testimony establishes a claim about data retention, not proof that the Chinese government accessed the data or used it for intelligence purposes. In January 2025, Deputy Attorney General Lisa Monaco described the government’s concern as the ability to gather sensitive information about tens of millions of Americans. That, too, was an explanation of a potential capability, not a finding that the capability had been used.
TikTok’s court filings, as reported by CRS, cited 170 million U.S. users in December 2024. That is a dated figure from the company’s filings, not a current user count.

2. Could recommendations be used to influence what Americans see?
Recommendation systems determine which videos are surfaced and how widely they may be distributed. The U.S. government’s concern, described by the Department of Justice (DOJ), is that a party with influence over the platform could covertly manipulate the content delivered to users—for example, by amplifying some material or reducing the visibility of other material.
This is a potential influence pathway. The official materials cited here do not establish that the Chinese government carried out a covert campaign to manipulate U.S. TikTok recommendations.

3. Could control over moderation enable censorship?
Moderation is a separate form of editorial control from recommendation. Moderation rules decide what content is permitted, restricted, or removed; recommendations affect the distribution of content that remains available. If an outside authority could influence moderation policy or its enforcement, it could potentially shape which political or other material users are allowed to post or encounter.
The official sources reviewed frame this as a risk associated with foreign control. They do not establish a comprehensive finding that the Chinese government directed censorship of U.S. TikTok content.

4. Could software control expose devices or information?
National-security concerns also involve the software itself: how the app handles data, how updates are controlled, and whether software functions or ongoing transmissions could create exposure. CRS reported that some experts argued that storing U.S. data domestically would not, by itself, resolve risk if technology functions, updates, or continuous transmissions remained connected to China.
This is an argument about architecture and control of the software pipeline. The sources cited here do not establish that TikTok has been used to compromise U.S. devices.

5. Why do ownership and jurisdiction matter?
ByteDance’s ties to China raise questions about who ultimately controls TikTok’s data, software, and content systems, and whether legal or other forms of leverage could affect those systems. CRS describes U.S. concerns about platforms linked to China in terms that include potential data access and influence over company data or content policies.
Those concerns do not mean that Chinese law, by itself, proves the government has obtained TikTok data. They are about possible exposure arising from ownership, jurisdiction, and control—and about whether safeguards can reliably separate those interests.

What changed in TikTok’s U.S. ownership and legal status?
The law and subsequent restructuring are established events. Their existence does not prove that the feared conduct occurred. The following chronology separates the legal steps from what officials or the company said those steps meant.

What safeguards does the U.S. joint venture say it operates?
TikTok USDS Joint Venture LLC describes its controls as designed to put U.S. user data, software security, recommendation governance, and trust-and-safety decisions under U.S. oversight. These are the venture’s statements about its own operations, not independent outcome data confirming that each safeguard eliminates the risks above.

The OLC opinion concerns the government-device statute and the joint venture’s version of TikTok. It should not be read as an assessment that independently verifies every company-described control or settles how the arrangement will be evaluated over time.
What is established—and what remains unproven?
The cited official materials document the U.S. government’s concerns, the 2024 law, the Supreme Court’s 2025 decision, the White House’s 2025 determination and enforcement pause, and the 2026 ownership and legal developments. They do not establish that the Chinese government has used TikTok to collect U.S. user data for intelligence purposes, manipulate U.S. recommendations, censor U.S. content, or compromise U.S. devices. Nor do they provide independent outcome data showing that the joint venture’s controls eliminate the risks. The distinction is central: a government risk assessment and a precautionary legal response are not, by themselves, proof of an incident.
