Open-source status does not remove a general-purpose AI (GPAI) model from the EU AI Act. Under the European Commission’s published interpretation, a qualifying open-source release can be exempt from two documentation duties: preparing technical documentation for authorities and providing documentation to downstream AI-system providers. The exemption is conditional on a free and open-source license and public access to the model’s parameters, including weights, plus architecture and usage information. Every open-source GPAI provider must still maintain a copyright-compliance policy and publish a sufficiently detailed summary of training content. Models presenting systemic risk receive no documentation exemption and face additional evaluation, risk-management, incident-reporting and cybersecurity duties.
What does the EU AI Act require from open-source GPAI providers?
The Act regulates the provider of a general-purpose AI model, not just the company that later embeds it in an application. The Commission’s guidance says an open-source provider may use a narrow documentation exemption when the release meets specific openness conditions. That exemption does not create a general “open-source exception” from the Act.
In practical terms, an eligible provider may avoid two tasks that otherwise apply to GPAI providers:

The provider remains responsible for the duties that the Commission says apply to all GPAI providers, including open-source providers. The most important are a policy for complying with EU copyright and related-rights law and a public, sufficiently detailed summary of the content used to train the model.

The Commission’s materials are implementation guidance rather than a binding, case-specific legal ruling. The Regulation is the source of the obligation, and the Court of Justice of the European Union has the authoritative role in interpreting EU law.
What conditions must an open-source release meet?
The exemption depends on both the legal terms of the release and the information made publicly available. Calling a model “open source” in a README, model card or marketing page is not enough by itself.
Use a free and open-source license
The license must allow the relevant public access, use, modification and distribution on open terms. A provider should examine the actual license text, including restrictions, field-of-use limits and conditions imposed on derivatives. If the license does not provide the kind of freedoms contemplated by the Commission, the label “open source” will not establish eligibility.
Publish the model materials the Commission identifies
The public release must include the model parameters, including its weights, together with architecture information and usage information. These elements allow others to inspect, run, adapt or integrate the model rather than merely send requests to a closed service. A release that exposes only an API, documentation or source code but withholds the parameters does not satisfy the stated public-availability condition.
Check each version and distribution channel
Openness is assessed for the released model and its license, not for a general corporate policy. Record which weights, architecture description, usage documentation and license were public for each version. If a later distribution removes weights, narrows the license or changes the model materially, reassess whether the exemption still applies to that release.
Which duties remain even when the exemption applies?
Two obligations remain central for every GPAI provider, including one that publishes weights under an open license.

Maintain a copyright and related-rights policy
The provider must have a policy for complying with EU copyright and related-rights law. The Commission describes this as a continuing provider duty, not an optional best practice that disappears because users can download or modify the model. A policy should be operational: identify who owns decisions, how rights-related requests are handled and how training practices are reviewed.

The provider must publish a summary of the content used to train the model. The requirement is a public summary, not publication of every training item or a complete copy of the dataset. The summary should be detailed enough to communicate what kinds of material were used and how the training corpus was assembled, while addressing applicable copyright and privacy constraints.
The Commission provides a template that providers can use as a practical aid for this public summary. Using a template does not replace the legal duty; it helps organize the information that must be made available.
Does the open-source exemption cover models with systemic risk?
No. The Commission states that the open-source documentation exemption does not apply to a GPAI model with systemic risk. The provider must meet the additional systemic-risk requirements even when the model is freely licensed and its weights are public.
Additional systemic-risk duties
- Assess and mitigate systemic risks associated with the model.
- Carry out model evaluations.
- Keep records of relevant evaluations and risk-management work.
- Report serious incidents.
- Provide adequate cybersecurity for the model and the physical infrastructure on which it runs.
Open release can make later mitigation harder because copies can spread beyond the provider’s control. The Commission therefore notes that a provider may need to assess and mitigate risks before releasing a systemic-risk model, rather than waiting for problems to appear after publication.
Do not treat a compute threshold as a safe harbor
The Commission’s 2025 guidance describes a presumption of systemic risk for models trained with more than 1025 floating-point operations (FLOP). It also allows the Commission to designate a model based on equivalent capabilities or impact. A model below the compute figure is not automatically outside the systemic-risk regime, and a model above it is not assessed by arithmetic alone.

When did the GPAI rules start, and what is the transition period?
The dates differ depending on when the model was placed on the market.

The transition is tied to the model’s status before 2 August 2025, not simply to when a company was founded or when a new version is planned. Keep evidence showing when each model or version was placed on the market and what was released at that time.
How are GPAI and systemic-risk models identified?
The Commission’s 2025 guidance uses training compute exceeding 1023 FLOP together with specified generative capabilities as a criterion for identifying GPAI models. This is guidance for applying the Act, not an independent scientific definition that settles every borderline case.
GPAI identification criterion
A model trained above 1023 FLOP and possessing the generative capabilities described in the guidance is within the Commission’s GPAI identification framework. Providers should examine the model’s actual capabilities and training history rather than rely only on a product name or a parameter count.
Systemic-risk assessment
More than 1025 FLOP creates the Commission’s stated presumption of systemic risk. The Commission may also designate a model because its capabilities or impact are equivalent to the models covered by that presumption. Because the guidance and implementation practice can evolve, a provider should document its assessment and monitor later Commission materials.
Who is considered the provider after a model is released?
The original developer is not automatically the only provider throughout the model’s life. An entity that significantly modifies or fine-tunes an existing GPAI model may become the provider of a new model. Minor changes do not automatically create provider status.

Significant modification
The Commission’s guidance includes an indicative training-compute criterion for significant modification, but the result depends on the facts and on the applicable guideline text. Assess the scale and purpose of the additional training, the resulting capabilities and whether the modified model is effectively a new model. Do not treat a single numerical test as a universal answer.

A company that integrates an unchanged model into an AI system can have obligations attached to that system even if it is not the provider of the underlying GPAI model. Model-provider compliance and downstream-system compliance are separate questions. Contracts and technical documentation should identify which party is responsible for each role instead of assuming that the open-source provider covers every later use.
What should an open-source provider do before release?
Use the following sequence to decide whether the limited exemption is available and to prepare for the duties that remain.
- Classify the model. Determine whether it meets the Commission’s GPAI criteria, including the 1023-FLOP guidance criterion and the model’s generative capabilities.
- Screen for systemic risk. Review the 1025-FLOP presumption, equivalent capabilities and potential impact. If systemic risk may apply, plan for the full additional regime before publication.
- Audit the license. Confirm that the actual license grants the relevant freedoms to access, use, modify and distribute the model. Record the license version and any conditions on derivatives.
- Verify public materials. Check that the released package makes the parameters, including weights, architecture information and usage information publicly available.
- Prepare the continuing documents. Adopt a copyright and related-rights compliance policy and publish the sufficiently detailed training-content summary. The Commission’s summary template can help structure the disclosure.
- Document provider boundaries. Identify the original provider, any organization performing significant modification or fine-tuning, and the parties responsible for downstream AI systems.
- Preserve dated evidence. Keep the release package, license, public pages, training summary, risk assessment and market-placement date for each model version.
- Reassess on material change. Repeat the analysis after a major fine-tune, new weights, changed license, new capability or Commission designation.
How do closed and open release approaches compare?
The relevant comparison is not “open source versus no regulation.” It is whether a particular release satisfies the conditions for the narrow documentation exemption while still meeting the universal and systemic-risk duties.

What is the General-Purpose AI Code of Practice, and is it mandatory?
The General-Purpose AI Code of Practice is a voluntary compliance tool. The Commission and the AI Board assessed it as adequate for providers that follow its commitments to demonstrate compliance with duties under Articles 53 and 55. It explains practical ways to organize compliance, but it is not the legal source of the obligation and does not replace the AI Act.

A provider can therefore use the Code, the Commission’s training-summary template and internal controls together, while still checking the Regulation and current guidance. Choosing not to follow the Code does not by itself eliminate the statutory duties; choosing to follow it does not create an exemption for a systemic-risk model.

What common mistakes cause open-source providers to lose the exemption?
- Relying on the label. “Open source” in a repository title is not proof that the license and public materials meet the Commission’s conditions.
- Publishing code but not weights. Source code or architecture diagrams alone do not provide the public parameters identified in the guidance.
- Skipping the training summary. The documentation exemption does not remove the public summary requirement.
- Ignoring systemic risk. An open license cannot be used to claim the documentation exemption for a systemic-risk model.
- Treating fine-tuning as automatically minor. Significant modification can create a new provider, while the answer depends on the facts and applicable guidance.
- Confusing model and system obligations. A downstream integrator may have duties for its AI system even when the underlying model provider has complied with its own obligations.
- Using old guidance without checking dates. Application dates, templates and implementation guidance can change; verify the current Commission materials and the Regulation before a release.
Frequently Asked Questions
Does an open-source GPAI provider have to publish its entire training dataset?
No. The Commission describes a requirement to publish a sufficiently detailed summary of training content, not to disclose every training record or reproduce the full dataset. The summary must be public and should be prepared alongside the provider’s copyright-compliance policy.
Does publishing only an API qualify for the open-source documentation exemption?
Not on the conditions described by the Commission. The exemption requires public availability of model parameters, including weights, as well as architecture and usage information; an API-only service does not provide those materials.
Can a company that fine-tunes an open model become a new GPAI provider?

What should a provider retain to prove that a release met the exemption conditions?
Keep dated copies of the license, public weights and architecture and usage materials, the training-content summary, the copyright policy and the systemic-risk assessment. Preserve the market-placement date and records for any later fine-tuning or license change so each version can be assessed separately.
