DeepSeek and ChatGPT should not be compared as if each had one universal privacy setting. The relevant choice is between a specific consumer app, API, managed workspace, or a third-party product built on a model. DeepSeek’s English consumer policy says it collects prompts, uploaded files, account details, usage logs and approximate IP-derived location, and that it processes and stores personal data in China. OpenAI says content from individual ChatGPT services may be used to improve models depending on your settings, while API and managed-workspace content is not used for training by default. ChatGPT also documents controls for model improvement, memory, export, deletion and Temporary Chat. The evidence supplied here does not establish a complete feature list or regional-availability ranking, so those questions require current product-specific documentation.
What is the practical difference between DeepSeek and ChatGPT?
The biggest documented difference is how the providers describe consumer data handling. DeepSeek’s policy states that it directly collects, processes and stores personal data in the People’s Republic of China and may use it to improve and develop its services, including training and improving its technology. OpenAI describes consumer-data use as setting-dependent and publishes controls that let users manage model improvement, memory, chat deletion, data export and Temporary Chat.
That does not prove that one service is universally safer, more secure or more capable. Storage location alone is not a legal or security verdict, and the policies apply to different product categories and can change. Decide only after identifying the account type you will use and the data you are allowed to submit.

DeepSeek’s English consumer privacy policy, last updated February 10, 2026, lists several categories of information:

The policy says DeepSeek directly collects, processes and stores personal data in China. It also says personal data may be used to provide, maintain, improve and develop services, including training and improving the company’s technology. The policy does not turn that statement into a promise that every data type is used in exactly the same way; purpose and data characteristics affect handling.
Retention is likewise purpose-dependent. DeepSeek says information can be kept for different periods according to why it was collected and what kind of data it is. Data needed to provide the service may be retained while you maintain an account. Do not interpret that language as a fixed deletion deadline.

OpenAI’s consumer-services FAQ says content submitted to individual services may be used to improve model performance depending on the settings associated with the service. OpenAI also says a limited number of authorized personnel and trusted service providers may access content for defined purposes, such as investigating abuse or incidents, providing support, handling legal matters, or improving performance where permitted.
OpenAI describes storage on its systems and those of trusted service providers in the United States and around the world. That geographic description is materially different from DeepSeek’s statement that it stores personal data in China, but geography by itself does not establish which service meets your legal, contractual or threat-model requirements.

OpenAI’s US Privacy Policy and Data Usage for Consumer Services FAQ are the relevant references for consumer accounts. Settings, product versions and regional terms can affect the result, so check the policy that applies to your account rather than relying on a generic comparison.
Which privacy controls are documented for ChatGPT?
OpenAI documents several controls in ChatGPT. The exact menu wording can change, but the controls described in its help documentation include:
- Model-improvement setting: manage whether eligible consumer content is used to improve models.
- Memory controls: review or manage information that ChatGPT can retain as memory.
- Data export: request a copy of account data.
- Chat deletion: delete individual conversations rather than leaving them in the account.
- Account deletion: remove the account through the documented deletion process.
- Temporary Chat: start a conversation that does not appear in chat history and, according to OpenAI’s help page, is not used to improve models.
These controls are not interchangeable. Turning off model improvement does not itself delete old conversations; deleting a chat does not necessarily change every other account setting; and Temporary Chat is a mode for a new conversation, not a retroactive cleanup tool. Use the control that matches the action you need.

Do not convert this table into a numerical privacy score. The providers use different policy language, and the evidence does not measure breach rates, employee access frequency, government requests, model quality or security performance.

Does using an API or business workspace change the answer?
Yes. A developer API, managed workspace and consumer chat account can have different data-use defaults, retention rules and administrators. Comparing a consumer DeepSeek account with an OpenAI business or API deployment as if they were equivalent can produce the wrong compliance decision.
OpenAI API and managed workspaces
OpenAI says content from its API and managed workspace products is not used to train models by default. Organizations can also apply workspace rules for retention, memory, compliance and member access. The organization’s contract, configuration and administrator policies determine how those controls operate in practice.
Third-party products using a model

Check the provider’s current sign-up flow, service terms and regional documentation for the specific product you intend to use. Do not infer availability from a friend’s account, a model name shown in a screenshot or access to a third-party application.
