Short answer: AI training is not automatically legal or illegal. In the United States, whether copying works to train a model is fair use depends on four case-specific factors, and courts have not set a safe number of words, notes, or percentage. In the European Union, commercial text-and-data mining can be blocked by an appropriately expressed rights reservation, while providers of general-purpose AI models have copyright-policy and training-content transparency duties from August 2, 2025. AI-assisted songs, images, writing, and code can receive copyright protection when a human contributes perceptible expression or creative arrangement; a prompt alone is not enough.
What does copyright law currently say about AI training?
There is no single worldwide rule for using copyrighted music, writing, images, or code in model training. The answer depends on the country, the role of the person using the material, the source and license of the material, and what the trained system does with it.
In the United States, the Copyright Act’s fair-use doctrine is the central framework, but it is a fact-specific defense rather than a blanket permission for machine learning. The U.S. Copyright Office’s AI study describes training as an active policy issue, and litigation is continuing. A 2025 UK government report said more than 70 U.S. AI copyright cases had reportedly been commenced; that is a reported figure, not an independently verified court count.
The European Union takes a more explicit text-and-data-mining approach. Rightsholders can reserve their rights for commercial mining in an appropriate form, including machine-readable methods. If a reservation is validly expressed, a developer generally needs authorization such as a license to use the reserved material.

Is copying works to train an AI model automatically fair use in the United States?
No. Section 107 requires a court to weigh all four fair-use factors together. Commercial purpose, technical transformation, the type of source work, the amount copied, and effects on existing or potential markets all matter; none decides the case alone.
Purpose and character of the use
A court may examine whether training serves a commercial purpose and whether the use is transformative. A developer should be able to explain what the copying accomplishes, how the model is offered, and whether the system competes with the market for the source works. Calling a process “transformative” does not end the analysis, particularly when the model can reproduce protected expression or substitute for licensed products.
Nature of the copyrighted work
Highly creative works receive stronger protection under this factor than factual material. Songs, lyrics, novels, illustrations, and original software can therefore present a more difficult nature-of-work question than a database of purely factual information. This does not make training on creative works automatically infringing; it changes the balance a court may consider.

Courts look at both the quantity copied and the qualitative importance of what was taken. A small excerpt can still be substantial if it captures the heart of a work, while a large technical copy may be judged in light of what was necessary for the claimed purpose.
Effect on markets
The analysis includes harm to the market for the original and to plausible licensing markets. Evidence that a model’s outputs replace songs, stock images, books, or code that users otherwise would license can be important. Developers should analyze memorization, output similarity, and whether rightsholders could realistically license training access.

Is there a safe number of words, musical notes, or percentage to copy?
No. The U.S. Copyright Office’s Fair Use FAQ states: “There are no legal rules permitting the use of a specific number of words, a certain number of musical notes, or percentage of a work.” A fixed threshold cannot turn a disputed training use into a guaranteed lawful one.
For a musician, that means a short melody or lyric can still be significant. For a developer, it means token counts, file counts, or a claim that only a small slice of each work was retained are not substitutes for a four-factor analysis. Keep the reasoning tied to the particular dataset, model, purpose, and output behavior.

The practical route differs by jurisdiction and by whether material has already been ingested. A reservation can control future access where the applicable law recognizes it, but it does not promise that a previously trained model will forget material or that every intermediary will remove it.
EU commercial text-and-data mining
EUIPO explains that rightsholders may block commercial text-and-data mining through an express reservation implemented in an appropriate way, including machine-readable methods. A developer encountering that signal generally needs permission, such as a license, before using the reserved work for the covered mining activity. The reservation should be clear, consistently applied, and connected to the material or service where the work is made available.
What an opt-out cannot promise
An opt-out is not a guaranteed deletion mechanism for a model that was trained earlier. Creators should preserve dated copies of their reservation, the relevant work, and evidence of where it was published. If a provider claims to honor a reservation, ask what dataset removal, retraining, or filtering process it actually uses and whether that process covers the model version in question.

Can music, writing, images, or code made with AI be copyrighted?
Human creative contribution is the dividing line. The U.S. Copyright Office’s January 29, 2025 report says AI-assisted output can be protected when human expressive elements are perceptible or when a person makes creative arrangements or modifications. A prompt by itself does not establish copyright authorship.

What can support a claim of authorship?
- Human-written lyrics, melodies, code, text, or visual elements incorporated into the final work.
- Creative selection and arrangement of generated material in a larger composition.
- Substantial human editing, rewriting, instrumentation, orchestration, or code modification that changes the expressive result.
- A documented sequence showing which parts came from a person and which came from a system.
Keep drafts, stems, source files, source code, prompts, generated alternatives, edit history, and contribution records. Those materials can help identify the human-authored portions if registration, licensing, or an ownership dispute later arises. They do not convert every generated element into protected expression; protection extends only to the human-authored contribution recognized under the applicable law.
What should I do if an AI output resembles a song, lyric, or code passage?
Pause distribution and investigate before releasing or licensing the output. The U.S. Copyright Office’s FAQ notes that unauthorized use may support an infringement action and recommends consulting an attorney when in doubt.
- Preserve evidence. Save the exact output, prompt, model name and version, generation date, account records, and any settings or reference files.
- Identify the overlap. Compare melody, lyrics, arrangement, images, text passages, or code structure with the suspected source. Record both literal matches and distinctive nonliteral similarities.
- Check authorization. Review the model provider’s terms, the dataset or asset license, your own input rights, and any rights reservation that applied when the source was accessed.
- Assess distribution risk. Consider whether the output could substitute for the original or expose confidential, proprietary, or third-party material.
- Get qualified advice. A lawyer can assess infringement, fair use, contract obligations, and the appropriate notice or licensing path for the relevant jurisdiction.
What must AI developers disclose under EU rules?
From August 2, 2025, providers of general-purpose AI models (GPAI) in the EU must maintain a copyright-compliance policy and publish a sufficiently detailed summary of the content used to train the model. The European Commission also lists technical-documentation and downstream-information duties.

These duties apply to GPAI providers, not every person who runs a small model or uses an AI tool. Developers should determine whether their system falls within the GPAI category and obtain local advice for edge cases, exemptions, and enforcement questions.

What should developers record before training a model?
Documentation is both a compliance tool and a way to investigate complaints. For every dataset or major data source, record:
- Provenance and chain of title: where the material came from and who supplied it.
- License scope and territory: permitted purposes, geographic limits, duration, attribution terms, and restrictions on model training or redistribution.
- Reservation signals: any express opt-out or machine-readable reservation encountered during collection.
- Model linkage: the model and version trained on each source, with ingestion and removal dates.
- Output controls: memorization testing, similarity review, filtering, and escalation procedures.
- Audit and deletion capability: whether a source can be isolated, removed, or addressed through retraining or another documented mitigation.
A licensed dataset is easier to explain when its chain of title and permissions are preserved. An open dataset still requires a license and provenance review. Scraped web material requires source-by-source checks, because public availability does not itself establish permission for commercial training.

A company operating across both regions should not assume that a U.S. fair-use theory satisfies an EU reservation or transparency duty. Map collection, training, deployment, and complaint handling to the locations where each activity occurs.

The figure illustrates why musicians focus on substitution, catalog dilution, voice and style imitation, and the ability to license training access. It does not by itself prove that any particular model infringes or that every generated track is unlawful. Those conclusions still require analysis of the source works, authorization, model behavior, and applicable law.

What is still unsettled for creators and model builders?
The U.S. Copyright Office received more than 10,000 comments during its 2023 AI study, reflecting the breadth of disagreement over training, licensing, attribution, and enforcement. Courts continue to develop the law through individual disputes, so a provider’s business model or a creator’s opt-out cannot be treated as a universal answer.
For a disputed use, separate three questions: whether the source was copied lawfully, whether the training use is defensible under the governing jurisdiction, and whether a particular output infringes or violates a contract. Each can have a different answer. Qualified legal advice is appropriate before a high-value catalog, commercial model, or contested output is released.
What is a practical compliance plan for each side?
For musicians, songwriters, and developers who own creative works
- Inventory songs, lyrics, recordings, images, writing, and code, noting ownership and co-creator agreements.
- Keep dated project files, stems, drafts, source code, and edit histories that show human contribution.
- For EU commercial mining concerns, publish and preserve an appropriately implemented rights reservation, including a machine-readable form where suitable.
- Monitor for suspicious outputs and save the output, model details, and comparison evidence before contacting a provider.
- Use a lawyer for licensing, takedown, infringement, or registration decisions involving material value.
For model developers and deployers
- Classify the role and jurisdiction of each activity: collection, training, fine-tuning, hosting, and distribution.
- Build a dataset register with provenance, license terms, reservations, model versions, and retention dates.
- Evaluate the four U.S. fair-use factors where relevant instead of relying on a percentage copied.
- Implement controls for memorization and substantial similarity, with a documented escalation path.
- If the system is an EU GPAI model, prepare the copyright policy, technical documentation, downstream information, and public training-content summary required from August 2, 2025.
Frequently Asked Questions
Does an opt-out remove my songs from a model that was already trained?
Not necessarily. A reservation can govern covered future mining, but it does not guarantee that an existing model has deleted or forgotten the work. Ask the provider what removal, retraining, or filtering process applies to the specific model version and keep evidence of your reservation and dates.

What does a machine-readable rights reservation mean?
It is a reservation expressed in a form software can detect and process, rather than only in prose intended for human readers. EUIPO recognizes such methods as one way to express a commercial text-and-data-mining reservation when implemented appropriately.
Do prompts give me copyright in everything an AI system generates?
No. The U.S. Copyright Office says a prompt alone does not establish copyright authorship. Protection may cover perceptible human expression and creative arrangement or modification, so preserve records showing exactly what you contributed.
