Check every U.S. job posting for two separate issues: whether you must already be legally authorized to work when you start, and whether the employer will support an employment-visa process now or later. “Authorized to work in the U.S.” addresses your current ability to work; “will you now or in the future require sponsorship?” addresses the employer’s immigration support. You can satisfy the first and still need the second later.
Read the exact wording, save a copy of the posting, and ask the recruiter for a written answer tied to the role, worksite, employment type, and customer contract. Do not send Form I-9 documents with an application; that verification happens after you accept a job.
What should you check first in a job posting?
Search the posting for one statement about current work authorization and another about employer sponsorship. Treat them as different questions even when they appear in the same application form.

| Posting language or signal | What it asks | What it does not establish |
|---|---|---|
| “Must be authorized to work in the U.S.” | Whether you can work legally when employed, usually by the start date | Whether the company will sponsor you later |
| “No sponsorship available” or “We do not sponsor now or in the future” | Whether the company will support an employment-visa case | Whether every visa category, extension, role, or location is covered unless the employer confirms that scope |
| “Will you now or in the future require sponsorship?” | Whether you need employer support now or may need it when current authorization ends | That answering “yes” automatically disqualifies you; the employer’s policy controls |
| “E-Verify required” | Whether the employer uses E-Verify in addition to Form I-9 procedures | Whether the company sponsors visas |
| “U.S. citizens only” or “must be a U.S. person” | Whether a citizenship or export-control restriction is claimed | That the restriction is lawful without an identifiable legal, regulatory, contract, or export-control basis |
Federal law requires employers to verify the identity and employment authorization of new employees through Form I-9 after hire. The U.S. Department of Justice’s Immigrant and Employee Rights Section (DOJ IER) says employers may generally ask whether an applicant has the legal right to work in the United States and whether the applicant will need sponsorship for an employment visa.

How do you interpret “authorized to work in the U.S.”?
This phrase normally means you must have valid employment authorization by the job’s start date. It does not, by itself, promise sponsorship or prohibit it. A permanent resident, a U.S. citizen, or a person with a valid employment authorization document (EAD) may meet the current-authorization requirement, but the employer can still apply a separate sponsorship policy.
“Authorized to work” is a timing question
Check whether the posting says “at the time of application,” “at the start date,” or simply “in the U.S.” If it does not specify timing, ask the recruiter when authorization must be valid. An authorization that expires before the planned start date may not satisfy the employer’s requirement, while authorization valid at hire may still require a later immigration decision.
Do not infer sponsorship from silence
A posting that says only “must be authorized to work” is incomplete on the future-sponsorship question. It neither confirms nor denies that the employer files employment-visa petitions. Ask directly rather than treating the absence of a “no sponsorship” sentence as an invitation.

“No sponsorship available” generally signals that the employer does not intend to file or support an employment-visa case for that role. Wording such as “we do not sponsor now or in the future” is broader, but you should still confirm whether it applies to every visa category, future extension, worksite, and employment type.
Read the scope, not just the headline
Sponsorship policies can vary by role, seniority, funding source, worksite, customer, and visa category. A company may sponsor one position but not another, or may consider sponsorship only after a qualifying period. Ask which rule applies to the exact requisition rather than relying on a general careers-page statement.
“Sponsorship considered” is not a guarantee
That phrase means the employer may evaluate sponsorship; it does not guarantee that the company will file a petition, meet an eligibility requirement, or obtain approval. Ask what the employer actually files, at what stage, and under what written conditions.

How should you answer “Will you now or in the future require sponsorship?”
Answer accurately based on your expected need for employer support. “Yes” can mean you need sponsorship immediately, or that you can work under a current temporary authorization but will need the employer’s support when that authorization expires.
If you have OPT, STEM OPT, CPT, or an EAD
These labels describe different forms of current or time-limited authorization, but the posting’s sponsorship question remains separate. Tell the recruiter which authorization you have, when it expires, and whether you expect to need an employer-sponsored status afterward. Ask whether the employer’s policy accepts that authorization and whether it supports a later change or extension.
If you are transferring from another employer
Do not assume that a previous employer’s filing transfers automatically to a new job. Ask whether the company supports the relevant transfer process, whether the role and worksite qualify, and whether employment may begin only after a filing or approval milestone.
Is “U.S. citizens only” or “U.S. person” lawful?
Check whether the restriction is tied to a specific law, regulation, executive order, government contract, or export-control rule. DOJ best practices say job postings should match an actual legal requirement and should not incorrectly exclude people based on citizenship status.
Ask the recruiter to identify the rule or contract requirement and whether “U.S. person” is being used as a defined legal term. A vague preference for citizens is not the same as a documented requirement. Save the wording if the employer cannot explain the restriction.
Does E-Verify tell you whether a company sponsors visas?
No. E-Verify is an employer system that complements Form I-9 by checking employment-eligibility information. Its use does not answer whether the employer files H-1B petitions, permanent-residence cases, or any other employment-visa process.
If a posting mentions E-Verify, ask the separate sponsorship question anyway. Also ask whether the requirement applies to every employee, a particular federal contract, or a specific worksite.

What should you ask the recruiter?
Send separate, plain-language questions so the answers cannot be confused:
- “Does this role require me to have U.S. work authorization on the start date?”
- “Will the company sponsor an employment visa for this position now or in the future?”
- “If sponsorship is available, which categories do you support, such as H-1B or permanent residence, and under what conditions?”
- “Does this policy differ for OPT, STEM OPT, CPT, an EAD, or a transfer from another employer?”
- “Is the requirement tied to this job, worksite, contract, or customer?”
Ask for the answer in writing and keep it with a saved copy of the posting. Job-board text can change after you apply, and a recruiter’s clarification may be narrower than a company-wide policy.

Form I-9 is an after-hire verification process, not an application requirement. USCIS employer guidance says you should not complete Form I-9 until after accepting the position. You complete Section 1 on or before your date of hire, and the employer completes Section 2 within three business days of your first day of work.
You choose which acceptable documents to present from the Form I-9 lists. USCIS instructions state that employees do not need to prove citizenship, immigration status, or national origin when establishing employment authorization for Form I-9 or E-Verify. An employer generally may not demand a particular document, such as a passport or green card, when an acceptable alternative is available.
What can an employer ask for before making an offer?
A recruiter may ask whether you have the legal right to work and whether you will need sponsorship for an employment visa. The employer should not turn that question into an early demand for a specific immigration document.
- Do not send a passport, green card, or EAD merely because an application portal requests proof before an offer unless a lawful process specifically requires it.
- Do not let a recruiter replace the Form I-9 document-choice rules with a demand for one preferred document.
- Watch for different verification requirements applied only to applicants perceived as foreign or to non-U.S. citizens.
DOJ IER says employers may not request more or different Form I-9 documents, demand a specific document because of citizenship or national origin, or apply verification rules inconsistently.

How does employment-visa sponsorship work after an employer says yes?
Sponsorship is a process with employer filings and eligibility conditions, not a single benefit added to an offer letter. The exact steps depend on the visa category and the position.
H-1B sponsorship
For an H-1B case, the employer generally files a certified Labor Condition Application (LCA) with the U.S. Department of Labor before submitting the petition to USCIS. The LCA includes attestations about wages, working conditions, notice, and other statutory requirements. Ask whether the company files for the role, when it starts the process, and which costs it covers.
Permanent employment sponsorship
For permanent employment in most cases, the employer obtains DOL labor certification before filing the immigrant petition. DOL must certify that there are not sufficient U.S. workers able, willing, qualified, and available for the job and that employing the foreign worker will not adversely affect similarly employed U.S. workers. The employer’s willingness to consider a case does not guarantee certification or approval.
Who pays which costs?
DOL says an H-1B employer may not require the worker to pay petition filing fees or certain employer business expenses. If a recruiter asks you to pay costs that belong to the employer, request an itemized explanation and obtain qualified immigration advice before sending money.
How should you compare two jobs that appear to sponsor?
Compare the written policy details rather than the word “sponsorship” alone:
| Comparison point | Question to ask |
|---|---|
| Visa category | Which categories does the employer actually support? |
| Timing | Is sponsorship available at hire, after a waiting period, or only when current authorization is nearing expiration? |
| Current authorization | Does the policy accept OPT, STEM OPT, CPT, an EAD, or a transfer from another employer? |
| Role and worksite | Does the policy apply to this level, location, funding source, and customer assignment? |
| Eligibility conditions | What education, job duties, salary, tenure, or internal approvals must be met? |
| Written confirmation | Will recruiting or human resources confirm the policy for this requisition in writing? |

- The employer demands a passport, green card, or another specific document before making an offer.
- A recruiter rejects an apparently valid Form I-9 document because it is foreign.
- Only applicants who appear to be non-U.S. citizens are asked for extra proof.
- A “U.S. citizens only” restriction has no identifiable legal or contract basis.
- The employer says you must pay the employer’s H-1B petition filing fees or certain business expenses.
- The posting says “sponsorship considered,” but the recruiter will not identify the supported category or timing.
A single unclear sentence may be a drafting problem; a refusal to clarify, inconsistent document treatment, or a demand for prohibited payment deserves more caution.
What should you do if the posting and recruiter disagree?
- Save screenshots or a PDF of the posting, application questions, emails, and messages showing the date.
- Ask the recruiter to state the exact current-authorization and sponsorship rule for the specific job, worksite, and employment type.
- Request clarification in writing if the posting says “no sponsorship” but the recruiter says sponsorship is possible, or the reverse.
- Do not submit identity or immigration documents through an informal channel before an offer and the normal Form I-9 process.
- If the issue involves citizenship-status discrimination, national-origin discrimination, or unfair document requests, contact DOJ IER’s worker hotline at 1-800-255-7688. The employer hotline is 1-800-255-8155.
Keep your records even if you withdraw. They show which wording you relied on and whether the employer applied a rule consistently.

- Save the posting and the written response.
- Wait until after accepting an offer to complete Form I-9, and choose your acceptable documents yourself.
Frequently Asked Questions
Can I apply when a posting requires work authorization but says nothing about sponsorship?
Yes, if you can meet the stated authorization requirement by the relevant date. Treat the missing sponsorship language as an unanswered question and obtain the employer’s policy for the role before relying on the opportunity.
What should I select on an application that asks for a yes-or-no sponsorship answer?
Answer according to whether you need employer support now or expect to need it later, not merely whether you currently hold an EAD or another temporary authorization. If a text box is available, state the authorization you hold and its expiration date, then ask recruiting to confirm the policy.
Can a customer contract or worksite change the sponsorship answer?
Yes. A restriction may come from the assignment, funding source, customer, or worksite rather than the employer’s general policy. Ask whether the answer applies to the exact location and customer named for the job.
What should I do if a recruiter asks for my passport before an offer?
Ask why the document is needed and whether the request is part of a lawful, uniformly applied process. Form I-9 document verification occurs after you accept the job, and you generally choose from the acceptable document lists instead of supplying a particular document on demand.
