Before signing a cloud contract, get clear, written answers about who operates each security control, where your data and related records are handled, what independent evidence supports the provider’s claims, how incidents and service failures will be managed, and how you can leave. Turn those answers into specific, measurable contract terms for the exact services, regions, and support arrangements you will use. A provider’s certification or standard contract language is not, by itself, a guarantee that your workload is covered or that your obligations are met.
What security questions should I ask a cloud provider before signing?
Ask questions that identify the service boundary, allocate responsibilities, and establish evidence and remedies. Do not settle for broad assurances such as “we use industry-standard security.” The UK National Cyber Security Centre advises that security requirements should be “specific and measurable”; generic clauses can add cost while offering limited value and potentially being unenforceable.
Use this checklist in a written security schedule, contract, service-level agreement (SLA), or other binding document—not only in sales discussions. Adapt it to the service type, data classification, region, support tier, and applicable legal requirements.
Responsibility and scope
- Which security controls does the provider operate, and which must we configure, monitor, or maintain?
- What evidence maps each control to our workload, tenant configuration, and data classification?
- Which named services, regions, support tiers, APIs, and dependencies are included in the offer and its assurance materials?
- What assumptions about our configuration must remain true for the provider’s commitments to apply?
Ask for a control-by-control responsibility description, not a generic statement that security is “shared.” A control may be split: the provider may operate part of a service while your team configures how your tenant uses it. Record the division for each relevant control, identify the evidence available to verify it, and assign an internal owner for customer-side duties.

Data, privacy, and sovereignty
- Where are production data, backups, logs, metadata, and support artifacts stored and processed?
- Can data or support access cross borders? If so, what notice, approval, and contractual protections apply?
- What obligations govern confidentiality, lawful requests, retention, and deletion?
- Can the provider identify the regions and legal jurisdictions relevant to each data category and processing activity?
“Data location” should not mean only the primary production copy. Ask about backups, operational logs, metadata, and artifacts created when staff troubleshoot a service. Clarify whether the provider may process or access any of these outside the selected region, including through support arrangements, and what rights you have if the arrangement changes.
Identity, access, and encryption
- Can we require phishing-resistant multi-factor authentication (MFA), least privilege, segregation of duties, and customer-controlled identity federation?
- Who can access our tenant or data, under what approval process, and how are privileged sessions logged and reviewed?
- What encryption is used for data at rest and in transit? Who controls the keys, and how are keys rotated or revoked?
- What access information and encryption-related evidence can we obtain for our own records?
Make the contract clear about provider staff access as well as customer sign-in. Request the approval conditions for privileged access, how such activity is recorded and reviewed, and what records are made available to you. For encryption, distinguish the provider’s responsibilities from your ability to control keys; ask what happens to access when a key is revoked and how key-related obligations apply to backups and retained data.
How do I verify a cloud provider’s security claims?
Request current independent assurance evidence that covers the particular service and region you intend to buy, then check its scope, dates, exclusions, exceptions, and remediation status. A certification is evidence about a defined scope at a point in time—not a blanket guarantee for every product, location, tenant configuration, or future period.

Review the evidence, not just the badge
- Which current SOC 2, ISO 27001, or other independent reports cover this exact service and region?
- What services, locations, systems, and control periods are in scope—and what is expressly excluded?
- What findings or exceptions appear, what remediation is planned or completed, and when were tests performed?
- Will the provider supply refreshed evidence periodically and cooperate with your risk assessments?
Confirm that the evidence applies to the offering in your contract, rather than a different service or an umbrella program that excludes important components. Ask how exceptions relate to your use case and whether the provider will explain remediation and provide updated material. Agree on a recurring evidence process so the information is not limited to the procurement stage.

The UK NCSC says customers using a third party to handle or process data need confidence that it will take care of that data as expected. Independent reports can help build that confidence, but they do not answer every workload-specific question. Use them alongside the responsibility map, configuration evidence, and contractual commitments.
What should the cloud security contract say about incidents and monitoring?
The contract or SLA should define incident triggers, notification timing, cooperation, and the records you can access. It should also make monitoring, testing, availability, and recovery commitments concrete enough to assess against your operational needs.
Incidents and customer-visible records
- Which events trigger notice to us, and how soon after the trigger must notice be given?
- What investigation, evidence preservation, status updates, and cooperation will the provider supply?
- Which audit, activity, access, configuration, and deletion logs can we obtain?
- For each available log, what is its retention period and delivery format?
Define the trigger and timing in the agreement rather than relying on an undefined promise to notify “promptly.” Ask how the provider will cooperate with your investigation and what information can be shared as facts develop. Check whether the available logs cover the events your team needs to investigate activity in its tenant, and whether retention and format support your internal processes.
Testing, availability, and recovery
- How often are vulnerabilities assessed, penetration tests performed, recovery procedures tested, and incident exercises conducted?
- What availability commitment applies to the purchased service, and how is it measured?
- What recovery point and recovery time commitments apply, and what backup and maintenance practices support them?
- Which dependencies or concentration risks could affect service continuity, and what commitments address them?
Ask for the testing cadence and the scope relevant to the service, not just an assertion that testing occurs. Put availability and recovery commitments in the SLA or another binding schedule, with clear measurement terms. Confirm that recovery commitments cover the service components your workload depends on, and establish how planned maintenance and material dependencies are addressed.

Who else can access or affect the cloud service?
Require visibility into subprocessors and underlying infrastructure providers, together with notice and contractual flow-down obligations. The provider’s own controls are only part of the picture if another organization can process your data, provide critical infrastructure, or perform support.
Subprocessors and supply-chain obligations
- Who are all subprocessors and underlying infrastructure providers involved in the service?
- What notice or consent rights apply when the provider adds or changes a subprocessor?
- What security, confidentiality, audit, personnel, and SLA obligations must those parties follow?
- Can the provider explain how these obligations are passed through and monitored?
Ask for a way to identify the parties that handle data or support the service, and for notice before relevant changes take effect. Establish what happens if a proposed change creates an unacceptable risk: can you object, terminate, or migrate? The Australian Government Architecture’s cloud procurement guidance explicitly includes supply-chain risk and foreign ownership, control, or influence risks among the security obligations to address before finalizing a contract.
Ownership, control, and jurisdiction changes
Ask what notice you receive if the provider’s ownership, control, or relevant operating arrangements change. Clarify whether a change can affect data access, processing jurisdictions, subprocessors, or the safeguards you relied on when signing. The contract should explain your options if a material security or jurisdictional change makes the arrangement unsuitable.

How do I compare two cloud providers’ security terms?
Compare providers against the same workload and contract requirements, not against marketing summaries. A useful comparison tests whether each provider can show who owns each control, provide evidence for the exact service, and accept measurable terms for risks your organization cannot absorb.

| Comparison area | What to examine |
|---|---|
| Control ownership | Provider and customer responsibilities, plus evidence tied to your workload and tenant configuration |
| Data and legal exposure | Storage and processing locations, cross-border access, and relevant jurisdictions |
| Identity and encryption | Identity federation, privileged access, logging, encryption, and key control |
| Independent assurance | Report scope, service and region coverage, dates, exceptions, and remediation |
| Incident and monitoring terms | Notification triggers and timing, cooperation, available logs, retention, and format |
| Resilience | Availability, recovery point and time commitments, backups, maintenance, and dependencies |
| Supply chain | Subprocessor visibility, change notice, and flow-down obligations |
| Exit | Portability, assistance, cost, timing, and proof of return and deletion |
Record gaps as contract exceptions or risk decisions rather than treating them as equivalent to commitments. If a provider cannot negotiate a particular term, identify the specific risk, the alternative evidence or safeguard offered, and who in your organization is authorized to accept it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should the contract say about changes and leaving?
Before signing, agree on notice and options for material changes, as well as a practical exit process. The contract should explain how you can retrieve data and related assets, what assistance costs, and how return and deletion will be verified.
Changes during the contract
- How much notice applies to changes in contract terms, features, controls, regions, subprocessors, or ownership?
- Can we object, terminate, or migrate if a change materially affects security or jurisdictional exposure?
- What happens to existing data and access during the notice, objection, and migration periods?
Specify which changes are material and which rights follow from them. A notice provision is less useful if it gives you no time or contractual option to respond. Align the notice period and migration rights with the time your organization would need to assess the change and move the affected workload.

Return, portability, and deletion
- What formats, APIs, and tools are available to export data, configurations, keys, and logs?
- What migration assistance is included, how long is it available, and what does it cost?
- What timelines govern retrieval and deletion, including retained copies and backups?
- What documentation or other verification will demonstrate that data and keys were returned or deleted?
Test whether the proposed export covers more than the data records themselves: configurations and logs may also matter to a transition or audit. Put the permitted formats, assistance, timing, and charges in writing. Define what proof of deletion the provider will supply and how the terms treat copies retained for operational or other stated purposes.

How should I turn the checklist into a contract review?
Use the answers to produce a scope-specific security schedule and resolve gaps before signature. The UK NCSC’s advice to make requirements specific and measurable is especially useful here: each important promise should identify what is covered, who performs it, what evidence is available, and what happens if the commitment is not met.
- Define the offer. Record the services, regions, support tier, APIs, dependencies, and data categories in scope.
- Map responsibility. Assign each relevant control to the provider, your organization, or both, and identify evidence for the assignment.
- Convert risk into terms. Write measurable requirements for access, encryption, location, incidents, logs, testing, availability, recovery, and change notice.
- Review assurance and supply chain. Match independent evidence to the service and region; document exclusions, findings, subprocessors, and flow-down expectations.
- Agree on remedies and exit. Set out the consequences of material changes or unmet commitments, plus export, assistance, cost, timing, and deletion verification.
- Recheck before signing. Confirm that provider terms, subprocessors, assurance evidence, and breach-notification commitments still match the final offer.
Responsibilities vary between infrastructure, platform, software, and managed services, and also depend on region, data classification, configuration, and applicable law. Treat the signed allocation—not a generic description of cloud security—as the working reference for your specific purchase.
Frequently Asked Questions
Can a cloud provider’s security certification replace our own risk assessment?
No. A certification or independent report can support an assessment, but its scope may not include the exact service, region, configuration, or data use you are considering. Your organization still needs to decide whether the documented controls and contract terms fit its own workload and obligations.
What if a provider will not share its full security report?
Ask what assurance material it can provide, including a scoped attestation, relevant report sections, exceptions, and remediation information. Decide whether that evidence is sufficient for the risk at issue; if not, record the unresolved gap and escalate it to the person authorized to accept or reject the risk.
Should we revisit cloud security terms after the contract is signed?
Yes. Recheck the provider’s terms, subprocessors, assurance evidence, and incident-notification commitments immediately before signing and when contract or service changes are proposed. A scheduled evidence refresh also helps ensure the documents used for oversight remain current.
