Yes, an employer can introduce AI and remove work, but AI is not a legal shortcut to dismiss you. In Great Britain, the employer normally must show a genuine business reason, choose a lawful process, consult before deciding, avoid discrimination, consider alternatives and pay the notice and redundancy entitlements that apply to your status and service. A system’s recommendation does not transfer responsibility away from the employer. This explanation reflects the law and guidance available on 30 October 2026 and is mainly for England, Scotland and Wales; Northern Ireland has separate employment legislation and some statutory rates differ.

What does “AI replaces my job” mean legally?

There is no single UK statute that gives an employer permission to replace people with artificial intelligence. The House of Commons Library describes the position as a combination of ordinary employment law, equality law, privacy rules and data-protection law. The legal label depends on what is actually happening.

If the organisation genuinely needs fewer employees because technology has changed or reduced the work, the situation may be redundancy. GOV.UK defines redundancy as a form of dismissal that occurs when an employer needs to reduce its workforce. If the work still exists but the employer says your performance, conduct or willingness to accept new terms is the problem, a capability, conduct, contractual-change or dismissal-and-re-engagement process may be more accurate. Calling a decision “AI-led” does not make an unfair or discriminatory dismissal lawful.

When is it likely to be redundancy?

Redundancy is more plausible where the employer is closing a business or workplace, reducing headcount, or requiring fewer people to perform the same work. If an entire operation closes, or you are the only employee in the relevant part of the organisation, a conventional selection pool may not be necessary. In other cases, the employer should normally define a pool and apply fair, objective criteria.

When might the label be misleading?

A role can be described as “replaced by AI” even though the employer is really challenging capability, changing contractual duties or selecting particular people for another reason. Ask the employer to state the proposed legal and business reason in writing. The underlying facts, evidence and process matter more than the technology’s label.

What must my employer do before making an AI-related redundancy decision?

Consultation should occur before the decision is fixed. Acas says, “You should consult with your employees before making a decision about any redundancies.” A meeting held after the employer has already decided who will leave is unlikely to be meaningful consultation.

Acas says consultation should address why the change is proposed, ways to avoid or reduce redundancies, the skills and experience needed in the future, the proposed selection criteria, employees’ concerns and support such as time to update a CV or arrange training.

Questions to put to the employer

  • What work is changing, and what evidence shows that AI or automation causes the change?
  • Is the proposal redundancy, capability dismissal, dismissal and re-engagement, or another procedure?
  • What is the selection pool, and why was it chosen?
  • What criteria, scores and documents will be used?
  • Has the employer checked for disability-related barriers, proxy bias and other discriminatory effects?
  • Are there suitable alternative vacancies, retraining or redeployment options?
  • What are the proposed termination date, notice arrangements and payments?
  • What appeal or grievance route is available?

If an employer makes a redundancy decision without genuine and meaningful consultation, Acas says an employee could have an unfair-dismissal claim, subject to the normal qualifying rules and any automatically protected reason.

Can an employer use AI to select who is made redundant?

AI may assist with workforce planning or scoring, but it cannot override the Equality Act 2010. Employers must not select someone for redundancy because of a protected characteristic or fail to make reasonable adjustments for a disabled worker.

Discrimination risks in automated scoring

  • Direct discrimination: treating a person less favourably because of race, sex, disability, age, religion or belief, or another protected characteristic.
  • Indirect discrimination: applying a neutral-looking criterion that disadvantages a protected group and cannot be objectively justified.
  • Disability discrimination: using an inaccessible assessment or refusing a reasonable adjustment.
  • Proxy bias: using data such as attendance patterns, work history or location that indirectly stands in for a protected characteristic.
  • Automation bias: accepting a model’s ranking without checking whether the output is accurate, relevant or fair.

The Government’s Responsible AI in Recruitment guidance says it is essential that systems comply with the Equality Act and asks whether technology creates new barriers, amplifies existing bias or creates novel risks at scale. Although written for recruitment, those equality-risk questions are also relevant when algorithmic performance data, monitoring or ranking influences redundancy.

AI use is not automatically discriminatory. The issue is whether the criterion, data, adjustment process or outcome disadvantages people unlawfully and whether the employer investigated and mitigated the risk.

Does a human have to review an AI redundancy decision?

Potentially. The ICO says UK GDPR has specific safeguards where solely automated individual decision-making, including profiling, produces legal or similarly significant effects. A dismissal or materially adverse employment decision can fall within that concern.

The distinction is between decision-support and a decision made solely by automated processing. A human review must be meaningful: the reviewer should be competent, actively assess the information, be able to challenge the output and have authority to depart from it. The ICO warns that “a decision does not fall outside the scope of Article 22 just because a human has ‘rubber-stamped’ it.”

Information worth requesting

  • Whether AI identified your role, ranked employees, assessed performance or helped define the selection pool.
  • What personal data and data sources were processed.
  • Whether the outcome was solely automated or genuinely reviewed by a person.
  • What notice or privacy information explained the processing.
  • How you can challenge the output or request meaningful human intervention.
  • Whether a data-protection impact assessment was required and completed.

An employer does not necessarily have to disclose source code or every trade secret. You can still ask for an understandable explanation of the factors used, the human decision-maker’s role and the route for correcting inaccurate data.

What happens in a collective AI redundancy?

Under the current framework, collective consultation is required when an employer proposes 20 or more redundancies at one establishment within a 90-day period. The Employment Rights Act 2025 factsheet describes an additional organisation-wide threshold to be set in secondary legislation and an increase in the maximum protective award for failing to consult from 90 to 180 days’ pay. The commencement dates and practical application of those changes must be checked when a proposal is made.

Collective consultation normally involves elected employee representatives or a recognised trade union, as well as information about the proposal and meaningful discussion. A collective process does not remove the need for fair individual consultation and lawful selection.

Will I receive statutory redundancy pay if AI removes my role?

Usually only if you are an employee with at least two years’ continuous service and the other conditions are met. Statutory redundancy pay is calculated from age, completed years of service and a capped week’s pay; no more than 20 years of service is counted. A contract or redundancy policy may provide an enhanced payment.

Redundancy date Statutory weekly-pay cap Maximum statutory payment
On or after 6 April 2026 £751 £22,530

These figures are from current GOV.UK guidance and apply to the statutory calculation for the stated date. Check your employment status, continuous-service record, termination date, contract and jurisdiction before relying on an amount. A person who refuses suitable alternative work without good reason can lose statutory redundancy entitlement in specified circumstances. Northern Ireland’s statutory rates and rules can differ.

How much notice should I get?

Your contract may give more notice, but it cannot give less than the statutory minimum. The employer may make a payment in lieu of notice where the contract or circumstances allow it.

Can I claim unfair dismissal if AI is involved?

As at 30 October 2026, Acas says ordinary unfair-dismissal claims generally require two years’ service. The planned reduction of the qualifying period to six months is due in January 2027 but is not yet law; check the position if your dismissal falls near that proposed commencement date. Automatically unfair reasons can be actionable without two years in relevant circumstances.

A redundancy dismissal may be challenged where there was no genuine redundancy, no fair reason, an unreasonable selection method, inadequate consultation or a disguised unlawful reason. Protected grounds and activities include race, sex, disability, age, religion or belief, pregnancy and family leave, trade-union membership, whistleblowing and exercising statutory rights. A tribunal will examine the employer’s real reason and process, not simply accept an algorithm’s recommendation.

Can my employer make me reapply for my own job?

An employer can propose a competitive process for redesigned roles, but requiring existing staff to reapply does not remove consultation, equality or contractual duties. Ask whether the old role is genuinely disappearing, what new roles exist, how criteria were set and whether suitable alternative employment is being offered. If the exercise is used to force people onto worse terms or select particular individuals without a fair rationale, obtain advice promptly.

  10. Contact Acas or a qualified employment adviser quickly if a tribunal claim may be needed.

How long do I have to bring a tribunal claim?

Acas describes employment-tribunal time limits as strict. For problems occurring on or after 1 October 2026, most claims have a six-month-minus-one-day limit. Acas’s example treats a problem on 1 October 2026 as ordinarily subject to a 31 March 2027 deadline.

For unfair dismissal, time usually runs from the final day of the notice period, or from the dismissal date if no notice was given. Notify Acas for early conciliation within the relevant limit; that notification can pause the clock. An internal appeal, grievance or disciplinary process does not itself extend the tribunal deadline.

What evidence should I keep?

Keep the original redundancy or dismissal letter, consultation invitations and notes, your contract and policies, payslips, performance records, selection scores, vacancy information, messages about AI use and any request for reasonable adjustments. Write a dated account of meetings while events are fresh. Do not alter files or access confidential data you are not entitled to use.

How do redundancy and other employer actions differ?

Issue Genuine redundancy Other possible process
Reason Fewer employees or less work is genuinely required. Capability, conduct, contractual change or another stated reason.
Consultation Should occur before the redundancy decision and cover alternatives and selection. Must follow the procedure appropriate to the stated reason.
Selection Usually a defined pool and objective criteria, unless a pool is unnecessary. Evidence relevant to capability, conduct or the proposed contractual change.
AI role May assist planning or scoring but does not decide legal responsibility. Still subject to equality, data-protection and fairness duties.
Payments Potential redundancy pay, notice and alternative-work rights, subject to eligibility. Notice and contractual payments still require checking; statutory redundancy pay may not apply.
Challenge Appeal, grievance, Acas early conciliation and tribunal routes may be available. Routes depend on the reason, protected status and applicable time limit.

Frequently Asked Questions

Can I refuse to use a new AI system at work?

That depends on your contract, policies, training, health-and-safety position and the reason for refusing. A refusal can become a conduct or capability issue if the instruction is lawful and reasonable, but a disability-related limitation or unsafe system may require adjustments and investigation before disciplinary action.

Can I ask for my personal data used by the redundancy algorithm?

You can make a data-protection access request for personal data held about you, although exemptions and third-party confidentiality can limit disclosure. Ask specifically for the categories and sources of data, retention information and an explanation of how the data affected the decision; specialist advice may be needed if the response is incomplete.

What if the employer offers me a lower-paid AI-related role?

Treat it as a proposed alternative role and examine duties, pay, location, hours, status and security. A role may be unsuitable in the circumstances, while an unreasonable refusal of suitable alternative work can affect redundancy pay; obtain advice before rejecting or accepting it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a tribunal order my employer to stop using AI?

An employment tribunal usually focuses on remedies for the employment claim, such as compensation, a basic award or a protective award. Data-protection complaints may involve the Information Commissioner’s Office, and the appropriate route depends on the particular processing and harm.
