Yes. A UK company can usually contract with an EU cloud service and keep its data in the United Kingdom, or use an EU region without physically moving every record. The key legal question is not simply where a server sits. Under UK GDPR transfer rules, you must examine the cloud provider’s contracting entity, every processing and support location, subprocessors, remote access and onward disclosures. A provider established outside the UK will very likely create a restricted transfer even when its servers are in Britain; a UK-established provider is not automatically a restricted transfer merely because it stores data overseas. That distinction should drive procurement, contract terms and your transfer-risk assessment.
What is the short answer for a UK company?
You do not have to keep all personal data on physically UK-hosted servers. UK government cloud guidance published on 5 February 2025 says organisations may use overseas cloud and SaaS regions when legal, data-protection and security practices are satisfactory. It also says government data classified as OFFICIAL, including SENSITIVE, can be stored and processed overseas and that there is no universal requirement for physical UK location. Private companies must still apply their own UK GDPR, sectoral rules, customer contracts and security standards.
The decision turns on the legal relationships and data flows. The Information Commissioner’s Office (ICO) states that “the contractual location of where the service provider is established determines whether a transfer is a restricted transfer,” rather than the geographical location of the storage servers. That means an EU data centre is neither automatically prohibited nor automatically compliant.

No. Server geography by itself does not determine restricted-transfer status. First identify the organisation receiving or accessing the information and the country where that organisation is established.

UK-established provider, overseas servers
If your contract is with a provider established in the UK, using its cloud service is not itself a restricted transfer even when the provider stores data in an EU or other overseas region. You must still meet ordinary UK GDPR requirements for processor due diligence, security, transparency, retention and international access, but the server’s foreign location does not alone create a restricted transfer between you and that UK provider.
EU-established provider, UK servers
If the contracting provider is established outside the UK, using its service is very likely to be a restricted transfer. This remains true if the provider’s selected region or physical servers are in the UK, because the relevant recipient is the non-UK-established organisation.
Internal movements within one legal entity
When your own company owns and operates the infrastructure, moving information between locations operated by the same legal entity is not a restricted transfer in the ICO’s example. That does not remove security, governance or transparency duties, and a separate hosting or support company can change the analysis.
What data and access routes must be reviewed?
A cloud assessment must cover more than the files users upload. The ICO explains that cloud processing can include account and login information, content stored in the service, data generated by activity and information accessed by support engineers.

- Identity and account data: names, email addresses, user IDs, authentication records, administrator details and billing contacts.
- Stored content: documents, images, databases, backups, messages and metadata that can identify people.
- Operational data: logs, device identifiers, IP addresses, timestamps, diagnostics and usage records.
- Human access: support, security, maintenance and incident-response staff who can view live or copied information.
- Resilience copies: replicas, snapshots, disaster-recovery environments and test data in other regions.
- Onward processing: subprocessors used for hosting, monitoring, support, email, identity, analytics or abuse prevention.
Encryption does not make a transfer analysis unnecessary. If the provider can decrypt data, administer keys or obtain plaintext through support access, that access is part of the processing chain. Even strong encryption requires you to document who controls the keys, where key-management services operate and what happens during recovery.
How should we determine whether an EU cloud arrangement is lawful?
Use a data-flow decision process before signing, then repeat it when the provider changes architecture or subprocessors.
- Identify the exact contracting entity. Record the legal name, registered establishment country, role (processor, controller or subprocessor) and the entity named in the order form and data-processing agreement. Do not rely on a brand, sales office or website domain.
- Inventory every data category. List production content, account records, logs, support tickets, backups, test copies and administrator information. Classify special-category, criminal-offence, children’s, financial, health or other high-risk data separately.
- Draw the complete flow. Show collection, primary storage, replication, backup, disaster recovery, support access, monitoring and deletion. Include the locations of staff who can access systems remotely, not only the advertised region.
- Map subprocessors and onward transfers. Obtain the current subprocessor list, countries of establishment, service performed and notice period for changes. Check whether a subprocessor can appoint another provider or move processing within a global network.
- Classify each leg. Decide whether each disclosure is within the same legal entity, to a UK-established provider, or to an organisation outside the UK. Assess each flow separately; one compliant region does not cure a different support or backup flow.
- Check adequacy and safeguards. Determine whether a current UK adequacy regulation covers the destination. If it does not, document the applicable UK transfer instrument, such as the UK International Data Transfer Agreement (IDTA) or an EU Standard Contractual Clauses arrangement completed with the UK Addendum where appropriate. Confirm that the instrument matches the parties, modules, roles and data flows.
- Complete a transfer-risk assessment. Consider destination-country law, government-access powers, practical enforcement, provider technical controls, encryption, key custody, minimisation and whether supplementary measures are needed. Keep the reasoning and approval with your records of processing.
- Set review triggers. Require notice of subprocessor, region, ownership, support-model or legal-term changes. Recheck the map before renewal and after a significant incident.
Do UK companies need SCCs or an IDTA for an EU cloud service?
Not in every case. A safeguard is required only when the relevant data flow is a restricted transfer and no applicable adequacy regulation removes that requirement. A UK-established provider may not require an international-transfer instrument merely because it uses EU storage, while an EU-established provider may require one even when its selected servers are in the UK.
When an adequacy decision may help
A current UK adequacy regulation can allow a restricted transfer without adding contractual transfer clauses, but you must verify the destination, scope and expiry of the decision at the time of the transfer. Keep evidence of the check; adequacy status can be amended or revoked.

When contractual safeguards are needed
For a non-adequate destination, use the UK IDTA or an EU Standard Contractual Clauses package supplemented for UK transfers when that structure fits the parties and processing. Complete the schedules accurately, include all relevant subprocessors and attach the transfer-risk assessment. A generic data-processing agreement or a marketing statement such as “EU hosting” is not a substitute.
Do the EU’s UK adequacy decisions solve UK-to-EU transfers?
No. The European Commission’s adequacy framework concerns flows from the European Economic Area (the EU plus Norway, Liechtenstein and Iceland) to recognised third countries. The Commission lists the United Kingdom under EU GDPR and Law Enforcement Directive adequacy decisions. The ICO records that renewed decisions were adopted on 19 December 2025 and run until 27 December 2031. Those decisions make EEA-to-UK transfers easier; they do not remove the need to analyse a UK-to-EU transfer under UK law. Check the UK’s own adequacy regulations and any sector-specific rule for the destination.
Which deployment option is easiest to govern?
There is no universally best architecture. Compare the legal entity and every access route rather than choosing solely by a “UK” or “EU” region label.

What contract terms matter most?
Ask the provider to make operational facts enforceable rather than leaving them in an informal sales explanation.
- Processing schedule: list data types, purposes, subjects, retention and the provider’s role.
- Location commitments: identify primary, replica, backup and support locations, including remote administration.
- Subprocessor controls: provide a named list, advance-change notice, objection process and responsibility for onward providers.
- Access restrictions: require least privilege, strong authentication, logging, approval for production access and prompt revocation.
- Encryption and keys: state encryption in transit and at rest, key ownership, rotation, escrow and emergency-access procedures.
- Incidents: set notification deadlines, required facts, cooperation duties and evidence preservation.
- Government requests: require legally permitted notification, challenge of disproportionate requests and disclosure minimisation.
- Deletion and return: cover active systems, caches, replicas, backups and certificates after termination.
- Audit and assurance: define access to certifications, independent reports, questionnaires and targeted audits.
- Change and exit: provide migration assistance, usable export formats and a remedy if a material location or subprocessor change is unacceptable.
What are the common mistakes?
Most failures arise from treating a hosting-region selector as the complete compliance answer.
- Relying on the server postcode: the provider’s establishment and access paths can determine transfer status.
- Checking only production data: support tickets, logs, snapshots and disaster-recovery copies may contain personal data.
- Ignoring support staff: remote troubleshooting from another country can be an onward transfer even when storage remains in Europe.
- Using an incomplete template: a transfer instrument with missing parties, modules, locations or subprocessor details may not protect the actual flow.
- Assuming EU adequacy works both ways: EEA-to-UK decisions do not answer the UK-to-EU analysis.
- Failing to monitor change: cloud providers can add subprocessors, alter failover regions or reorganise contracting entities during a subscription.
- Overpromising UK residency: “UK region” may not cover identity, telemetry, support, billing or security services.
What does the government guidance mean for private companies?
The 5 February 2025 UK government guidance is useful policy context: it confirms that overseas cloud regions can be acceptable and that OFFICIAL data, including SENSITIVE, does not have a universal physical-UK requirement. It is not a blanket exemption for private companies. A business must still satisfy UK GDPR, confidentiality commitments, regulated-sector rules, customer requirements and its own risk appetite.

Regulated organisations should check whether a financial, health, telecommunications, defence, public-sector or contractual rule imposes stricter location or access conditions. Where a customer contract promises UK-only processing, that promise may be narrower than UK GDPR and can govern the procurement decision even when the law permits an EU region.

How should the decision be documented?
Keep a short evidence pack that another reviewer can reproduce.
- Signed contract and data-processing terms naming the legal entity.
- Current architecture diagram with primary, replica, backup and support routes.
- Data inventory and records of processing covering account, content, logs and support data.
- Subprocessor register, locations and change-notice history.
- Restricted-transfer decisions for each leg, including any adequacy check.
- Completed IDTA or Addendum schedules, where required, and the transfer-risk assessment.
- Security evidence: encryption, key management, access logs, testing and incident procedures.
- Deletion, exit and disaster-recovery test records.
- Review date tied to renewal, architecture changes and legal updates.
This documentation lets procurement, security, privacy and legal teams reach the same answer and shows why a particular EU service was accepted, restricted or rejected.
Frequently Asked Questions
Can a provider’s EU parent company access data held by its UK subsidiary?
Potentially. Ownership relationships do not decide the transfer by themselves; determine which entity receives the data, which staff can access it and from where. A parent-company access route should be recorded as an onward disclosure and assessed under the applicable UK transfer rules.
Free tools Windows power users keep installed
One-click scans. No signup required.
Does pseudonymising records remove the need for a transfer assessment?
Not automatically. Pseudonymised information remains personal data for the organisation holding the additional information or means of re-identification. Treat the cloud provider’s ability to combine identifiers, access keys or receive lookup data as part of the risk analysis.
What evidence should we request before approving an EU cloud service?
Request the signed processing terms, legal entity details, complete subprocessor list, region and support map, security and key-management description, incident process, deletion policy and proposed transfer instrument. Ask the provider to explain failover behaviour, because an emergency move can create a flow absent from the sales configuration.
How often should the transfer decision be revisited?
Review it at least before renewal and whenever the provider changes its contracting entity, subprocessors, support model, regions, encryption design or disaster-recovery plan. Reassess sooner after a serious incident, regulatory change or customer requirement change.
