Not as an unchecked decision-maker. Police forces may use generative AI for bounded support work such as drafting, transcription, summarising case material, disclosure assistance and some digital-evidence analysis, but an AI tool does not itself authorise an officer to decide risk, create policy, justify an intervention or determine a criminal-case outcome. In England and Wales, responsibility remains with the force and an authorised human decision-maker, under documented legal, ethical, security and data-protection controls.
A live Independent Office for Police Conduct (IOPC) investigation illustrates the boundary. Derbyshire Constabulary had authorised Microsoft Copilot for productivity tasks, while an officer is being investigated over allegations that AI was used for policy decisions, risk assessment, decision justification and the input of sensitive data. Those are allegations, not findings.
What is the short answer to whether police can use Copilot for criminal-case decisions?
Police can use Copilot or a similar system only for purposes their force has approved and governed. Using it to organise information is materially different from allowing it to determine whether someone poses a risk, whether an action has sufficient grounds, what policy should be applied or what outcome a case should receive.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesThe UK Home Office’s England-and-Wales factsheet, updated 22 October 2026, says police AI should be lawful, ethical, transparent and robustly assessed before deployment. It places decisions about when and how a force uses AI with chief officers, who remain accountable for the system and for police use of its output. A force’s local policy can therefore be narrower than the capabilities advertised for a commercial AI product.

There is no evidence in the available official material that Copilot has been shown to improve criminal-case outcomes or that it is generally approved to make operational decisions. The answer depends on the task, the data, the human role, the approval route and the jurisdiction.
What counts as “using AI” in a police investigation?
“AI use” covers activities with very different risks. A transcript or first draft can be checked against the original material; a generated risk assessment can influence liberty, safety or the direction of an investigation. Treating both as the same category hides the control that is needed.
| Area | Lower-stakes or bounded example | Higher-stakes concern |
|---|---|---|
| Function | Drafting, transcription, summarisation or administrative support | Assessing risk, creating policy, justifying action or shaping a case outcome |
| Human role | An officer checks sources and keeps authority to change the result | An output is adopted without meaningful review or effectively determines the result |
| Data | Information permitted by force rules in an approved environment | Personal, sensitive, operational or case material entered contrary to policy |
| Evidence | Internal productivity material outside the evidential process | Creating, editing, reviewing or generating evidential material without specific approval |
| Governance | Approved use case, training, procedure, monitoring, audit and named accountability | Unclear authorisation, inadequate assessment or no way to explain and challenge a decision |
This framework combines the Home Office, College of Policing, Information Commissioner’s Office (ICO) and force-level guidance. It is a practical way to distinguish assistance from delegation, not a statutory classification.
What does the Home Office require before a force uses AI?
The Home Office says a force should establish that an AI use is lawful and ethical, assess it robustly, be transparent about it and define accountability. Operating procedures should state what the system may do, what it must not do, who may use it, what information may be entered and how results are checked.
Chief-officer responsibility
Chief officers decide when and how their force uses AI. That responsibility cannot be transferred to a vendor, an algorithm or an individual officer who happens to have access to the tool. A permission to use Copilot for office productivity is not, by itself, permission to use it for an operational decision or an evidential task.
Funding is not proof of effectiveness
The Home Office factsheet says more than £50 million in direct grants has supported specific police AI projects since the 2024 election, and that a further £115 million was announced for police adoption of AI and automation. Those figures describe public funding, not accuracy, legality or improved case outcomes.

What happened in the Derbyshire Copilot investigation?
On 22 October 2026, the IOPC announced an investigation after Derbyshire Constabulary made a voluntary conduct referral on 23 June. An internal review had raised concerns that an officer’s use of AI might not have followed force guidance and conditions.

What the IOPC says was authorised
According to the IOPC, Derbyshire authorised Copilot in May 2025 to support productivity, including drafting reports and summarising information. The conditions reported by the IOPC said users must not put operational, sensitive or personal data into the system.
What is alleged
The allegations concern use between May 2025 and June 2026 to create policy decisions, assess and manage risk, justify decisions and enter sensitive operational and personal case data. The officer was notified of an investigation for alleged gross misconduct. The IOPC has not reported an outcome, so the allegations must not be described as established misconduct or as a court finding.
IOPC Director of Engagement Emily Barry said: “These are serious allegations and it’s right they are investigated thoroughly and independently.” The case demonstrates why an approved productivity tool still requires a precise list of permitted tasks and data boundaries.
Can a human officer simply approve an AI-generated decision?
No. A name or click on an approval box is not enough if the officer merely rubber-stamps the output. The ICO’s law-enforcement guidance says meaningful intervention requires a competent, authorised person to examine the relevant input and output, consider the consequences and have power to change the decision.
Safeguards for significant decisions
For decisions made solely by automated means that could have a significant adverse effect, the ICO describes safeguards that allow a person to obtain human intervention, express their point of view, receive an explanation and challenge the decision. The guidance page says it is under review following the Data (Use and Access) Act 2025, which became law on 19 June 2025. It should therefore be treated as current regulator guidance, and the statutory wording should be checked before making a definitive legal claim about a particular case.

What meaningful review looks like
- Check the original records rather than relying on an AI quotation or summary.
- Test whether the output makes sense in the factual and legal context.
- Look for omissions, invented details, outdated material, bias or an unsupported inference.
- Record the reasoning for accepting, correcting or rejecting the output.
- Ensure the reviewer is authorised to alter or stop the proposed action.
Can Copilot create or edit evidence in a criminal case?
The College of Policing’s national Copilot training, announced on 25 August 2026 for officers and staff in England and Wales, says Copilot must not be used to create, review, edit or generate material forming part of the evidential process unless that use has specific approval under relevant governance arrangements.
The training principle is “Use. Check. Own.” Users are told to check an output’s source, sense and impact because generated content may be inaccurate, incomplete, outdated or biased. The user remains accountable for content produced with AI, even when the system supplied the wording.
This restriction matters beyond obvious fabrications. Editing a statement, disclosure schedule or evidential explanation can alter meaning, provenance or what another party is entitled to inspect. A force that wants an AI-assisted evidential workflow needs a documented approval route, controls over the original material and a way to show what the system did and what a human changed.
What information may police enter into Copilot?
Only information allowed by the force’s policy and the approved technical environment should be entered. Derbyshire’s reported conditions prohibited operational, sensitive and personal data, despite the force authorising Copilot for drafting and summaries.
Avon and Somerset Police’s published approach illustrates a more developed local framework. It describes data-protection impact assessments where required, ethical and legal review, technical and security assessment, continuing monitoring and audit. Its internal generative-AI rules, including for Microsoft Copilot, prohibit processing sensitive or restricted information, require output verification and position the tools for productivity and internal processes rather than autonomous operational decisions or evidential material.
That is the published approach of one force, not proof that every police organisation has identical rules. Officers must follow their own force’s current policy, approved account and information-classification requirements.

Consumer and organisational accounts are not interchangeable
Microsoft’s consumer Copilot terms effective 18 August 2026 warn that answers may be wrong, incomplete or inappropriate and tell users to check outputs before making decisions or taking action. Those terms expressly do not apply to people signed in with a work, school or organisational account. Consumer wording therefore cannot be treated as the policy or data-protection contract governing an enterprise police deployment.

How should a police force govern an AI use case?
A practical approval process should make the task, data and accountability explicit before anyone starts using the tool.
- Define the task. Write down whether the system is drafting, transcribing, summarising, searching, analysing digital evidence or influencing an operational decision. Do not describe a high-impact decision as “administration” to fit an easier approval category.
- Classify the information. Identify personal, sensitive, operational, confidential and evidential material. Confirm what the approved environment can process and what must never be entered.
- Assess legality and ethics. Complete a data-protection impact assessment where required and obtain the force’s legal, ethical, security and technical reviews.
- Set a human decision point. Name the competent person who must examine inputs and outputs, can change the result and remains responsible for the decision.
- Protect provenance. Keep original records separate from generated drafts, preserve source references and document material changes.
- Test before deployment. Check for inaccurate, incomplete, outdated or biased outputs using representative scenarios, including cases where an error could cause harm.
- Train and restrict access. Give users task-specific instruction, limit permissions to approved accounts and explain the difference between productivity use and evidential or operational use.
- Monitor and audit. Review logs, errors, complaints and near misses; suspend the use case if controls fail or the system changes materially.
- Explain and challenge. Provide a route for affected people to obtain human intervention, state their view, receive an explanation and challenge a consequential decision where the applicable rules require it.
Does a national AI study show that Copilot is reliable for police decisions?
No. The Office of Justice Programs lists a 28-page, NIJ-sponsored Landscape Study of Generative Artificial Intelligence in the Criminal Justice System, published 1 June 2025. It surveys possible uses ranging from transcription and translation to investigation and decision support; it does not establish that Copilot performs reliably or is approved for a particular police decision.
No published, quotable statistic in the cited official material measures Copilot’s accuracy or its effect on criminal-case outcomes. Funding announcements and a landscape review cannot substitute for validation of a specific model, workflow, jurisdiction and risk.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should an officer do when an AI answer looks useful but may be wrong?
Stop treating the output as an answer and treat it as an unverified lead or draft. Check the underlying source, compare the wording with the original record, test dates and names, and look for missing context or a conclusion that the material does not support.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Do not paste restricted information into a tool merely to obtain a more detailed response.
- Do not cite generated text as evidence without following the force’s approved evidential process.
- Escalate a proposed risk, policy or operational decision to the authorised human decision-maker.
- Record significant corrections and report a suspected data or policy breach through the force’s incident route.
- If the tool produced a consequential error, preserve the relevant records so the decision can be reviewed.
Does the answer change outside England and Wales?
Yes. The principal guidance described here is for England and Wales, and the sources do not establish one global rule. Other jurisdictions may apply different privacy statutes, evidence rules, public-sector procurement requirements and restrictions on automated decisions.
Even within England and Wales, the materials do not settle every decision type, including arrest, charging, bail, risk assessment or prosecution. The force’s policy and the law applicable to the particular decision must be checked rather than inferred from a general Copilot approval.

What is the defensible conclusion?
Police may use AI such as Copilot as a governed assistant, not as an unaccountable substitute for professional judgment. Summaries and drafts can be permissible when the force approves them, the data is allowed, the output is checked and the human retains real authority. Risk assessments, policy creation, decision justification and evidential work demand stronger controls and, in some settings, specific approval or prohibition.
The Derbyshire investigation shows why the distinction matters: an authorised productivity deployment and alleged use for consequential decisions are separate questions. Until an approved process answers who decided, what data was used, what was checked and how the result can be challenged, an AI-generated recommendation should not become the criminal-case decision.
Frequently Asked Questions
Can an officer use a personal AI account for police work?
A personal or consumer account should not be assumed to have the security, retention or contractual controls of an approved organisational environment. The officer must follow the force’s account, information-classification and approved-tool rules; a consumer product’s terms do not establish permission to process police material.
What records should a force keep when AI assists a decision?
A defensible record should identify the approved use case, the data category, the responsible decision-maker, the checks performed and any material correction to the output. Keeping the original source material separate from generated text helps preserve provenance if the decision is later reviewed.
Can AI-generated text be disclosed to a defendant?
That depends on the applicable disclosure rules and the force’s approved evidential process. Because national training warns against creating, reviewing or editing evidential material without specific governance approval, officers should obtain the required authorisation and preserve relevant source and audit records before relying on generated text.
Who can challenge a police decision influenced by AI?
For significant adverse automated decisions, the ICO describes safeguards including human intervention, an opportunity to give a view, an explanation and a challenge route. The precise right and procedure depend on the decision, the governing law and the current guidance in force.
