Yes. Employers can use artificial intelligence to parse, rank, or filter resumes, but the technology does not exempt them from employment-discrimination or reasonable-accommodation duties. In the United States, federal law applies to AI-assisted hiring just as it applies to other selection practices. A resume screener can create legal risk through intentional discrimination or through an unjustifiable disparate impact, even when its code does not use a protected characteristic directly.

Your rights depend on the job’s location, the tool’s role in the decision, and the facts of your application. This guide explains the federal baseline, New York City’s specific automated-employment-decision-tool rules, the European Union framework, how background-report rules differ, and what to document or do if an automated screen may have harmed your candidacy.

What does AI resume screening actually do?

“AI resume screening” covers several different systems. A parser can extract education, skills, job titles, dates, or keywords from a document. A matching model can compare those attributes with a job description and produce a score or shortlist. A ranking system can then determine which applications receive human review, an interview invitation, or no further consideration.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Those functions are not interchangeable. A simple keyword filter, a machine-learning ranking model, a video-analysis system, and a report supplied by a background-information company raise different factual and legal questions. Knowing which type was used is therefore important before you decide what rights or remedies may apply.

Can a U.S. employer legally use AI to screen resumes?

There is no blanket federal ban on automated resume screening. The Equal Employment Opportunity Commission (EEOC) states that federal employment laws apply to artificial intelligence and other new technologies “just as they apply to other employment practices.” The same rules can cover screening resumes for keywords or experience, ranking applicants, and other AI-enabled steps.

An employer may violate federal law if a system intentionally excludes applicants because of a protected trait. A practice can also be unlawful when it appears neutral but produces an unjustifiable disparate impact on a protected group. The question is not whether software made the decision; it is whether the employer’s selection practice, including the way the tool is designed or used, complies with applicable law.

The EEOC’s AI materials identify these federal protected bases: race, color, religion, sex (including gender, sexual orientation, and pregnancy-related conditions), national origin, age 40 or older, disability, and genetic information. Individual statutes have different coverage, elements, and defenses, and state or local law may protect additional categories.

How can an AI screener discriminate without being told to discriminate?

A model can learn patterns from historical hiring data or from proxies that correlate with protected traits. For example, a requirement that looks job-related on paper may disproportionately remove applicants in a protected group. You do not necessarily need proof that a developer wrote a discriminatory rule: disparate-impact analysis can examine the outcome and whether the employer can justify the practice.

Intentional discrimination

This theory concerns a deliberate use of a protected characteristic, or deliberate treatment of applicants because of it. Evidence might include instructions, model settings, communications, or a pattern showing that the tool was used to exclude a protected group.

Disparate impact

Here, the screening rule is framed in neutral terms, but its operation disproportionately rejects a protected group. A single rejection does not establish disparate impact; evidence generally concerns the practice’s effect on a group and the employer’s justification. The legal test and proof required depend on the statute and jurisdiction.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Proxy and data-quality problems

Using a school, employer, location, career gap, writing style, or other variable can unintentionally act as a proxy for a protected trait. Inaccurate parsing can also omit a credential, misread a date, or penalize a nonstandard format. These are reasons to preserve your original resume and any automated-screening notice, but they are not by themselves proof of unlawful discrimination.

What accommodations can applicants request during AI hiring?

Existing reasonable-accommodation duties can apply when a disability, religion, pregnancy-related condition, or related limitation affects participation in an AI-mediated hiring step. The EEOC says an applicant can ask the employer about its accommodation process even when software is used.

Make the request as early as practical and describe the hiring step that creates the barrier and the assistance you need. Depending on the situation, an accommodation could involve an alternate way to provide information, additional time, or a different assessment method. Employers may ask for information allowed by applicable law, and the exact process varies by employer and jurisdiction.

Keep a copy of your request and the response. If the employer refuses to discuss an accommodation, or the automated step screens you out because of a limitation, that record may be important when you seek advice or contact an enforcement agency.

Do applicants have a federal right to an explanation of an AI score?

The federal baseline described by the EEOC protects against discrimination and supports accommodation rights; it does not create a universal entitlement to the model, a numerical score, or a detailed explanation of every rejection. You may ask the employer whether an automated tool was used and whether a human can review your application, but the employer is not automatically required to disclose a particular score under federal law.

Other laws or local rules can require notices about automated tools. Those requirements are narrower than a general right to inspect an algorithm and may apply only to specified employers, tools, or locations.

What does New York City require for automated employment decision tools?

New York City’s Local Law 144 is a concrete example of a local rule. It covers a defined automated employment decision tool (AEDT) used to substantially assist or replace discretionary employment decisions. A covered employer or employment agency must satisfy all of the following before using the tool:

Requirement What the rule requires
Bias audit The AEDT must have undergone a bias audit within one year before the tool is used.
Public information Information about the bias audit must be publicly available.
Notices Specified notices must be provided to employees or job candidates.

The New York City Department of Consumer and Worker Protection (DCWP) began enforcement on July 5, 2023. The city’s official explanation is available on the DCWP AEDT page, and its applicant-facing information and complaint instructions are on NYC311’s Automated Employment Decision Tools page.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

These rules do not apply to every algorithm or every employer in the United States. Whether a system is an AEDT depends on the local definition and how the employer uses it. If you suspect a covered New York City employer lacked a required audit, public summary, or notice, DCWP asks for the suspected violation date, an explanation, job details, and the AEDT’s name or type if known.

How does the EU AI Act treat recruitment and selection systems?

The European Union’s Regulation (EU) 2024/1689 classifies certain AI used for recruitment and selection as high-risk. High-risk classification means additional regulatory obligations apply; it is not an automatic ban on using the system.

The precise obligations and dates depend on whether the system falls within the Act’s scope and on the role of the provider, deployer, or other organization. An applicant in the EU should therefore identify the employer, the country involved, and the system’s function before assuming that a particular transparency or challenge right applies. Read the regulation’s text at Regulation (EU) 2024/1689.

Is an AI resume score the same as a background-check report?

No. A resume parser or ranking model is not automatically a consumer report covered by the Fair Credit Reporting Act (FCRA). Separate rules can apply when an employer obtains a report from a company that compiles background information about an applicant.

Free tools Windows power users keep installed

Process Typical issue What not to assume
Resume parsing or ranking Whether the selection practice discriminates or fails to accommodate a protected limitation. Do not assume every score triggers FCRA procedures.
Third-party background report Permission, accuracy, and pre-adverse-action steps may be required. Do not treat a resume-screening notice as proof that a background report was used.

The EEOC’s Background Checks: What Job Applicants and Employees Should Know explains that employers generally need written permission before obtaining a covered report and must follow specified pre-adverse-action notice and report procedures. Those steps concern the report process, not every automated resume decision.

What should you do if you think AI screening affected your application?

Take practical steps while dates, documents, and communications are still available.

  1. Preserve the record. Save the job posting, your submitted resume and application confirmation, screening questionnaires, automated notices, rejection messages, and relevant dates. Record the employer, role, location, and the tool’s name if it was disclosed.
  2. Ask a focused question. You can ask whether an automated tool was used, what stage it controlled, and whether a human review or correction process is available. Keep the request factual and retain the response.
  3. Request an accommodation when needed. If disability, religion, pregnancy, or a related limitation affects a screening step, contact the employer promptly and ask how to request an accommodation. Explain the barrier and the adjustment you need rather than disclosing more medical information than necessary.
  4. Separate an error from a discrimination claim. A missing keyword, parsing mistake, or formatting problem may be correctable, while a pattern tied to a protected group may raise a discrimination issue. Document both the technical problem and any facts suggesting protected-group impact.
  5. Use the appropriate channel. The EEOC worker resource directs applicants who believe AI or another automated tool discriminated against them to the agency’s Public Portal or telephone services. In New York City, DCWP accepts complaints about Local Law 144 audit, public-information, and notice violations.
  6. Check local rules and get advice. Federal law is a baseline, not a complete state-by-state survey. A qualified employment lawyer, legal-aid organization, or relevant agency can assess deadlines, coverage, evidence, and the employer’s location-specific obligations.

What evidence is most useful in an AI-screening complaint?

Start with contemporaneous documents rather than assumptions about the software. Useful material can include the exact resume version, job description, application timestamp, accommodation request, notice language, rejection timing, and any statement identifying the tool or its vendor.

Information about other applicants can matter, but do not obtain or share confidential personal data improperly. A pattern of similarly qualified applicants from a protected group being rejected, a requirement unrelated to the job, or a refusal to provide an available accommodation may be more informative than a single unexplained score.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What are the most common mistakes applicants make?

  • Assuming every automated decision is illegal. AI use itself is not the violation; the legality turns on the practice, its effects, intent, and applicable jurisdiction.
  • Assuming every tool is covered by the same rule. Keyword filters, ranking models, video analysis, and background reports are different technologies and may trigger different obligations.
  • Treating New York City’s rule as nationwide. Local Law 144 applies within its defined scope and does not create a universal U.S. notice requirement.
  • Expecting an automatic explanation right. Federal EEOC materials support discrimination and accommodation protections, not a universal right to a model’s source code or score.
  • Ignoring accommodation timing. Waiting until after a rejection can make it harder to show what barrier the screening step created and when you asked for help.
  • Confusing a resume score with a background report. FCRA procedures are tied to covered third-party reports, not automatically to applicant-tracking or resume-ranking software.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

What is the practical bottom line for applicants?

Employers may use AI to screen resumes, but they remain responsible for complying with employment-discrimination law and, where applicable, accommodation duties and local automated-tool rules. Preserve your application record, ask about the process when useful, request an accommodation promptly, and match any complaint to the correct jurisdiction and type of technology. For a specific adverse decision, obtain qualified legal advice based on the facts rather than assuming that an automated score alone proves a violation.

Frequently asked questions

Can I ask an employer to remove my resume from an AI system?

You can ask, but the federal materials do not establish a general right to deletion or to opt out of automated screening. An employer may have retention duties or a separate process under local privacy or employment rules, so ask what policy applies and keep the response.

What if the AI rejected me because my resume had a career gap?

A career gap can be a data point in a model, but its use is not automatically unlawful. Explain any context that is relevant to the job, request correction or human review, and document whether the gap reflects a disability, pregnancy-related condition, religious practice, or another protected circumstance.

Can an employer use AI to evaluate a disability-related accommodation request?

Using software does not eliminate the employer’s duty to handle an accommodation request appropriately. The employer should consider the request through its accommodation process; if the tool itself creates the barrier, ask for an alternative way to complete that step and preserve the exchange.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a New York City bias-audit notice prove that the tool is fair?

No. A notice or publicly posted audit is evidence that a required process may have occurred, not a guarantee that every applicant was treated lawfully. You can still raise a concern about a specific decision, an accommodation failure, or information that appears inaccurate.
