Usually, no automatic cancellation occurs. In a U.S. bankruptcy, the organization, its contract rights, and the game publisher’s independent authority are separate things. The debtor’s legal and equitable interests become bankruptcy-estate property under 11 U.S.C. § 541, while the publisher still controls rights the debtor never owned. A league participation agreement may be assumed, rejected, or sometimes assigned only after a contract-specific and court-supervised analysis; a community tournament license may be personal, revocable, and nontransferable from the outset.
The petition date, the exact agreement, any pre-filing termination, cure obligations, assignment rules, and court orders determine the result. The following framework explains U.S. federal principles, using Riot Games’ published League of Legends community policy only as an example—not as evidence of every professional team’s contract.

What exactly is being protected in an esports bankruptcy?
Start by separating three layers: the debtor organization, the rights it owned or held by contract, and the publisher’s underlying game and competition authority. Bankruptcy deals with the first two layers; it does not turn a contractual permission into ownership of the game, the league, or official marks.
The organization
The petitioning company is the debtor. Its cash, equipment, team marks, event brands, accounts receivable, and contract interests can become property of the estate under 11 U.S.C. § 541. The estate’s property is limited to what that entity actually owned or had enforceable rights to when the case began.

The contract right
A slot, participation right, sponsorship permission, broadcast authorization, or organizer license may be an executory contract rather than a freely saleable asset. The contract’s term, renewal language, performance duties, default provisions, consent requirements, and governing law matter as much as the bankruptcy chapter.
The publisher’s independent authority
A game publisher owns or controls the game copyright, official competition branding, and the power to authorize events. A debtor cannot transfer more than its own interest. A buyer of estate assets therefore does not automatically receive the publisher’s entire competitive ecosystem.
Does filing bankruptcy cancel a tournament license?
Filing alone does not answer that question. A live contractual interest may enter the estate and receive protection from the automatic stay, but a license can still end under its own nonbankruptcy terms, a valid pre-filing termination, or a later court-approved rejection.
The petition date is critical
Section 362 generally stays specified collection and estate-control actions after the petition. That can restrict a counterparty from taking unilateral steps against estate property, subject to statutory exceptions and court relief. It does not revive a right that validly ended before filing, and it does not prevent every action based on independent regulatory or contractual grounds.
Whether a termination was effective before the petition is fact-sensitive. Notice, cure periods, the contract’s effective-date language, and the parties’ conduct can change the analysis. The American Bar Association’s franchise-bankruptcy guide describes why courts can reach different outcomes on these timing questions: ABA franchise-law guidance.
Bankruptcy-triggered clauses versus ordinary compliance conditions
A clause that purports to terminate solely because a party filed bankruptcy is not the same as a permission conditioned on continuing compliance, payment, conduct, safety, branding, or event rules. Bankruptcy statutes constrain certain insolvency-triggered provisions, while a publisher may retain independent enforcement rights. The contract, timing, applicable law, and any bankruptcy-court order must be analyzed together.

What can the trustee or debtor do with the agreement?
Section 365 gives the debtor, with court approval, a choice among assumption, rejection, or—where permitted—assignment. Those choices are not interchangeable, and none automatically transfers a publisher’s rights that the debtor did not possess.

To assume an executory contract, the debtor generally must cure—or provide a prompt cure for—defaults and provide adequate assurance of future performance. Cure can include unpaid fees, nonmonetary defaults when legally compensable, and other obligations specified by the agreement or court. The debtor must also satisfy ongoing operational requirements, not merely pay a balance.
Rejection: a breach, not a cancellation
Rejection allows the estate to stop performing a burdensome executory contract. It creates a counterparty claim for damages, subject to bankruptcy limits; it does not rewrite the contract into a rescission. The Supreme Court stated the rule directly in Mission Product Holdings v. Tempnology: “A rejection breaches a contract but does not rescind it.” Read the opinion at supremecourt.gov.
Tempnology involved a debtor that was the licensor and a nondebtor trademark licensee. It does not mean that a debtor-licensee can automatically keep, assume, or assign another party’s game license. Whether a debtor can continue using a particular permission depends on the agreement, applicable law, the counterparty’s rights, and the court’s orders.
Assignment: transferring the debtor’s interest
Assumption and assignment are separate questions. Even after a contract is assumed, assignment may require compliance with section 365 and the contract’s conditions. Section 365’s general treatment of anti-assignment clauses has exceptions when applicable nonbankruptcy law excuses the counterparty from accepting a substitute party. Courts differ in how they apply section 365(c) in some settings, so the controlling authority in the bankruptcy venue is essential.
Do these 3 things before closing this tab:

A sale process can transfer the estate’s contract interest; it cannot force a publisher to grant a new franchise, organizer license, or participation right that the debtor never held.

Can a bankruptcy sale transfer a league slot?
Only the debtor’s actual interest can be sold, and the slot may not be assignable. Section 363 can authorize sales of estate assets, but a sale order is not a universal assignment of publisher permissions.
Questions a buyer must answer
- Which legal entity was the contracting team or organizer?
- Was the right owned property, or only a personal contractual permission?
- Was the agreement live on the petition date?
- What are the remaining term, renewal, performance, and payment obligations?
- Does the contract restrict assignment, change of control, or dealings with a competitor?
- Does applicable nonbankruptcy law permit the counterparty to refuse an assignee?
- Are there independent termination grounds unrelated to insolvency?
- What cure amount and adequate assurance would be required?
- Who owns team marks, event branding, broadcast footage, sponsor rights, equipment, and other associated assets?
- What do the bankruptcy court’s sale, assumption, or rejection orders actually authorize?
Why a “slot” may be several rights
What fans call a slot may combine a participation agreement, a team identity, player-registration obligations, broadcast permissions, sponsor restrictions, and use of league marks. Each component can have a different owner and transfer rule. A purchaser may acquire equipment and a brand while still needing a new or separately approved participation agreement.
How does a professional league agreement differ from a community tournament license?
A professional participation agreement and a community-event license are not interchangeable. The first usually governs a named team entity’s access to a league; the second is a limited permission to organize particular events under publisher rules.
| Question | Organization and estate | Team or league participation agreement | Community tournament license |
|---|---|---|---|
| Grantor and holder | Identify the debtor and its interests at filing under § 541 | Identify the league or publisher counterparty and the precise team entity | Riot’s policy grants qualifying independent organizers a defined permission; professional teams are addressed by separate agreements |
| Possible bankruptcy treatment | Estate property may be sold under § 363 and other applicable requirements | Executory status, assumption, assignment, cure, and consent require contract-specific analysis | Published terms are personal, nontransferable, and revocable, so the text and conditions control |
| What filing does not do | It does not enlarge the debtor’s rights | It does not create an automatic right for a buyer to compete | It does not convert community-event permission into a professional league slot |
What Riot’s August 2026 community policy actually says
Riot’s League of Legends community-competition guidelines describe a conditional, personal, nonexclusive, nonsublicensable, nontransferable, revocable, limited event-organizing license. Riot writes: “In most cases, organizers will no longer need to wait for Riot approval to run an event.” That statement operates within the policy’s conditions; it is not an irrevocable grant and does not convey ownership of the game or official esports brands.
The policy allows qualifying organizers to charge certain fees and stream on an online platform of their choice, while restricting sponsor categories, official esports branding, and certain broadcasts. Riot also reserves intervention rights. Those conditions illustrate how an organizer can have permission without owning the underlying intellectual property.
What does “rejection” mean for continued use of a license?
Rejection changes the debtor’s performance obligations and gives the counterparty a breach claim; it does not provide a simple yes-or-no answer about every post-rejection use. The answer turns on what rights were conveyed, whether they survived ordinary breach, and whether another contract or rule permits termination.

The Tempnology limit
Tempnology protected rights already conveyed to a nondebtor trademark licensee when the licensor rejected the agreement. Its reasoning prevents rejection from functioning as rescission. It did not decide that every debtor organizer may retain a publisher license after rejection, and section 365(n)’s specified intellectual-property framework does not itself cover trademarks.
Why the counterparty’s remedies still matter
A counterparty may hold a damages claim, seek relief from the stay where permitted, object to assumption or assignment, or enforce nonbankruptcy rights subject to the court’s jurisdiction. A debtor’s continued use can also remain conditioned on brand, safety, reporting, payment, or event requirements. Only the actual agreement and orders show which obligations survive.
What do the 100 Thieves and FTX examples prove?
They illustrate different transactions and should not be treated as precedents for an unnamed team’s contract.
100 Thieves: a structural, nonbankruptcy example
In a July 18, 2025 account, Riot said 100 Thieves made a business decision in late 2024 to sell its franchise slot back to Riot. Riot then offered a one-year provisional guest arrangement for the 2025 LTA season, with access to compete but no long-term guarantee, while seeking a long-term North American partner for the 2026 slot. The announcement is available at LoL Esports.
The one-year provisional guest agreement is a specific 2025 arrangement, not an industry-wide rule. Riot’s announcement does not describe a 100 Thieves bankruptcy, a court cancellation, or a transferable asset that every bankrupt team would receive.

That was a sponsorship and marks dispute, not a team slot or tournament-organizer license. It shows why “rejection equals all rights disappear” is too broad: the parties’ stipulated treatment controlled the specified marks and existing materials.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How should you analyze a specific bankrupt esports organization?
Use a document-by-document process rather than starting with the team’s public identity.
- Identify the debtor. Confirm the exact corporate entity, affiliates, guarantors, and the chapter and venue of the bankruptcy case.
- Freeze the timeline. Record the petition date, every termination notice, cure notice, default, renewal, and event date. Determine what was live when the case began.
- Classify each right. Label every item as owned property, an executory contract, a personal license, a franchise or participation agreement, or a permission governed by published policy.
- Map the grantor and owner. Identify who owns the game, league marks, team marks, event brand, broadcast rights, sponsor inventory, footage, and equipment.
- Read transfer language. Check anti-assignment, change-of-control, consent, sublicensing, exclusivity, territory, term, renewal, and termination clauses.
- Separate insolvency grounds from ordinary grounds. Ask whether the counterparty relies on the filing itself or on missed payments, conduct, branding, competitive integrity, safety, or another independent condition.
- Calculate cure and future assurance. A buyer or debtor seeking assumption must address monetary defaults and show it can perform future obligations.
- Check court authority. Review stay-relief orders, assumption or rejection orders, sale procedures, bidding protections, and the final sale order.
- Describe the outcome narrowly. Say exactly what was sold, assumed, rejected, or approved; do not call a purchase of equipment or marks a purchase of a league slot without separate evidence.
What common explanations get wrong?
- “Bankruptcy cancels every license.” Filing does not automatically rescind contracts, and rejection is a breach under Tempnology.
- “The estate owns the slot because the team used it.” Use does not establish ownership; the agreement may grant only a personal, conditional permission.
- “A sale order forces the publisher to accept the buyer.” Section 363 transfers estate interests, not rights the publisher never granted or that applicable law makes nonassignable.
- “A community license is a franchise.” Riot’s published community policy expressly describes a limited organizer permission, not a professional league place.
- “The FTX order proves tournament licenses vanish.” That order addressed a rejected sponsorship agreement and specified marks treatment.
- “100 Thieves proves a bankrupt team can keep competing.” The 100 Thieves announcement describes a business-driven slot return and a one-year provisional guest arrangement, not a bankruptcy ruling.
- “A bankruptcy clause and a compliance clause are identical.” Insolvency-triggered restrictions and independent performance conditions can receive different treatment.
What evidence is needed before making a public claim?
A reliable statement should identify the agreement, the parties, the relevant date, and the court action supporting it. Public league announcements can describe a particular arrangement, but they do not substitute for the team’s contract or the bankruptcy docket.

What is the practical answer for teams, organizers, and buyers?
A team should treat its league access as a contract whose survival and transferability must be proven, not presumed. An independent organizer should read the publisher’s current policy as a conditional license and maintain compliance records. A buyer should value a slot only after confirming that the contracting entity held a live, assumable or assignable right and that the publisher or league has approved the required transaction.
For any real case, obtain the actual agreement and docket before announcing that a slot was canceled, preserved, or sold. The general rule is stable—bankruptcy does not enlarge the debtor’s rights—but the outcome is contract-, timing-, and venue-specific.
Frequently Asked Questions
Can a publisher terminate a tournament permission for reasons other than bankruptcy?
Yes. A published policy or contract may reserve termination or intervention for noncompliance, branding, sponsor, broadcast, safety, or other independent grounds. Whether a particular exercise is effective against an estate still depends on the agreement, timing, the automatic stay, and any court order.
Does buying an esports organization include its team name and footage?
Only if those assets belonged to the debtor and are included in the approved transaction. Team marks, event brands, sponsor permissions, and footage can have different owners, licenses, or usage restrictions, so each must be traced separately.
Can a bankrupt organizer keep running events while a case is pending?
Possibly, if the organizer has a live permission and can satisfy its continuing conditions, but filing does not create new authorization. The automatic stay and any publisher intervention rights must be considered with the particular policy, contract, and court orders.
Why does the governing bankruptcy venue matter for assignment?
Courts have taken differing approaches to section 365(c), especially when applicable nonbankruptcy law limits assignment. The same contract can therefore require a different analysis depending on the venue’s controlling authority and the law designated in the agreement.
