Sometimes—but not everywhere and not in the same way. Legal duties depend on the country where an organisation operates, whether it supplies or deploys an AI system, what the system does, and its risk category. The European Union has a binding, risk-based AI Act. The United Kingdom’s AI cyber-security code and the US NIST AI Risk Management Framework are voluntary, although contracts, procurement terms, sector regulators, or existing laws can make particular controls necessary. US businesses also remain subject to privacy, civil-rights, consumer-protection, employment, product-safety, and sector-specific rules. Treat “make our AI safe” as a jurisdiction-and-use assessment, not a yes-or-no global checkbox.

What determines whether AI safety compliance is mandatory?

Four questions establish the starting point: where the organisation and affected people are located, whether the organisation is a provider or a deployer, what risk category applies, and which date-specific rules are in force. The same model can face different obligations when used for a different purpose or in another market.

Where is the organisation, provider, or user?

EU rules can reach suppliers placing an AI system on the EU market and users (called deployers) located in the EU. A company headquartered elsewhere may therefore have duties when it offers a covered system in the EU or operates it for an EU-based organisation. The precise territorial test depends on the system and activity, so document the locations of the supplier, deployer, users, and affected individuals.

Are you a provider or a deployer?

A provider develops an AI system or has one developed and places it on the market or puts it into service. A deployer uses an AI system under its authority, such as an employer using a screening tool or a public body using an eligibility system. EU duties differ by role: providers carry most design, documentation, conformity, and market obligations; deployers must follow instructions, supervise operation, use appropriate data, and act on risks and incidents.

What is the system’s risk and purpose?

The EU AI Act distinguishes prohibited practices, high-risk systems, transparency-risk systems, and minimal-risk applications. A spam filter and an AI-enabled game generally fall into the minimal-risk group, while a system affecting employment, access to essential services, or other protected interests can trigger high-risk controls. Classification follows the use and legal definitions, not a marketing label such as “assistant” or “copilot.”

Does the EU AI Act apply to a company outside Europe?

It can. The Act is directly applicable to suppliers placing systems on the EU market and to deployers located in the EU. An overseas vendor should therefore assess whether it supplies an EU customer or makes a system available to people in the EU, while an EU company must assess systems it deploys even when the model is hosted abroad.

The European Commission describes the measure as “the world’s first comprehensive law for AI.” It is binding law, not a voluntary framework. Enforcement, duties, and transition periods depend on the system’s category and the organisation’s role.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What does each EU AI Act risk category require?

The category determines whether the Act prohibits the practice, requires controls and assessment, requires notices or labels, or imposes no specific AI-Act duty for ordinary use.

Category Typical treatment What an organisation should do
Prohibited practices Practices listed by the Act are banned. Stop the practice, check affected workflows, and train staff before the applicable prohibition date.
High-risk systems Formal controls apply before market placement or use. Implement risk management, data governance, documentation, human oversight, accuracy, cybersecurity, robustness, traceability, and the required conformity assessment.
Transparency-risk systems People must receive specified information; some generated or manipulated content must be identifiable or labelled. Design clear AI notices, content labels, and user communications into the product and its operating procedures.
Minimal-risk applications Generally no mandatory AI Act duties for ordinary examples such as spam filters and AI-enabled games. Keep ordinary security, privacy, and consumer-law controls in place; reassess if the purpose or impact changes.

When do the EU AI Act’s dates matter?

Application is phased rather than triggered on one global start date. The European Commission’s current overview gives these milestones; verify the exact category and any amendments before relying on a deadline.

Date Milestone Practical implication
2 February 2025 Prohibited-practice rules and AI-literacy duties begin. Remove prohibited uses and provide appropriate AI-literacy measures for relevant staff.
2 August 2025 Obligations for general-purpose AI (GPAI) models begin. Providers of covered GPAI models must check the obligations that apply to their model and role.
2 August 2026 Most remaining rules and transparency requirements generally apply. Complete classification, documentation, notices, controls, and assessments for systems entering scope.
2 December 2027 Some high-risk categories receive an extended transition deadline. Confirm whether the specific category qualifies for this extension; do not assume every high-risk system does.
2 August 2028 Some other high-risk transition arrangements extend to this date. Use the category-specific transition rule and keep evidence of the legal basis for the date used.

What must a high-risk EU provider do?

Before placing a covered high-risk system on the EU market or putting it into service, a provider needs a documented control system and the applicable conformity assessment. The requirements are operational, not just a policy statement.

  • Risk management: identify foreseeable risks, evaluate them, apply mitigations, and keep the process current throughout the system’s lifecycle.
  • Data governance and quality: use appropriate, relevant, and sufficiently representative data practices, with controls for errors and bias risks that matter to the intended use.
  • Technical documentation: describe the system, purpose, design choices, capabilities, limitations, evaluation methods, and changes so authorities and customers can understand it.
  • Traceability and logging: generate and retain logs needed to monitor operation, investigate failures, and establish what happened.
  • Transparency: provide instructions and information that let deployers and affected people understand the system’s role and limits.
  • Human oversight: design meaningful intervention and override capability rather than treating a human as a nominal sign-off.
  • Accuracy, robustness, and cybersecurity: test performance for the intended conditions, resist foreseeable errors and attacks, and maintain the required level of resilience.
  • Conformity assessment: complete the applicable assessment and registration or post-market steps before the system is supplied where the Act requires them.

What must an EU deployer do?

Deployers are not passive purchasers. They must operate the system according to the provider’s instructions and the Act’s safeguards, and they remain responsible for decisions made in their organisation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Assign enabled, competent human oversight and make sure staff can interpret outputs, challenge them, and stop or override operation.
  2. Use relevant and sufficiently representative input data when the deployer controls the data, and document the data sources and preparation.
  3. Monitor operation, record significant events, and investigate errors, unexpected behaviour, or indications of serious risk.
  4. Respond to identified risks or serious incidents through the provider and the organisation’s incident process.
  5. Give required information to affected people and follow restrictions on use, retention, and access that apply to the system and context.
  6. Keep the operating instructions, training records, logs, and decisions needed to demonstrate compliant use.

Are chatbot disclosure rules legally required?

For transparency-risk systems, yes. A chatbot must inform people that they are interacting with AI, unless the context makes that obvious under the applicable rule. Certain generated or manipulated images, audio, video, or text must also be identifiable or labelled.

Build the notice into the interaction rather than hiding it in a general terms page. Test the label in the channels where people encounter the output, including copied content and automated messages. A minimal-risk tool may have no mandatory AI Act notice, but privacy, consumer-protection, accessibility, or contract duties can still require clear communication.

Is the UK cyber-security code legally binding?

The UK Code of Practice for the Cyber Security of AI is voluntary. Its 13 principles are still useful for setting a defensible baseline and for meeting customer, procurement, or regulator expectations, but the code itself does not create a general statutory duty.

A voluntary code can become practically important when it is incorporated into a contract, tender specification, internal control policy, or regulator’s expectation. Check those instruments separately from the code’s legal status.

Is NIST AI RMF mandatory?

No. The National Institute of Standards and Technology says the AI Risk Management Framework (AI RMF) “is intended for voluntary use.” It supplies a common vocabulary and a structured way to govern, map, measure, and manage AI risk; it is not a federal law that automatically applies to every company.

Its practices can nevertheless become effectively required for a particular organisation when a customer contract, government procurement rule, sector regulator, insurer, or internal policy calls for them. Map each requested control to the document that makes it binding, rather than describing the framework itself as law.

What does the US position mean for a business?

The US approach is fragmented. There is no single comprehensive private-sector AI safety mandate identified here. A business must map each use to existing privacy, civil-rights, consumer-protection, employment, product-safety, and sector rules, while monitoring federal and state developments.

The Government Accountability Office counted 94 AI-related requirements for federal agencies—government-wide or government-significant—as of July 2025. That figure describes federal-agency requirements, not a universal obligation on private companies. A vendor serving government customers may still inherit controls through procurement terms, and a regulated business may face duties under laws that never use the words “AI safety.”

What should a business do now?

Use a repeatable inventory and review process. The following sequence works whether the immediate trigger is a new model, a new vendor, a new country, or a changed business purpose.

  1. Inventory systems and vendors. Record the model, version, provider, hosting location, data flows, users, affected people, and business purpose.
  2. Assign the role. Decide whether your organisation is providing, deploying, modifying, or merely purchasing the system; one project can involve more than one role.
  3. Classify risk and jurisdiction. Check for prohibited, high-risk, transparency-risk, or minimal-risk treatment; list the countries and sectors involved and the date rule you used.
  4. Document the use case. State intended outputs, foreseeable misuse, limitations, performance measures, and who can approve changes.
  5. Test before launch. Evaluate accuracy, robustness, security, data quality, harmful failure modes, and the ability of a human to intervene.
  6. Set human accountability. Name an owner, define escalation and override powers, train operators, and prevent automation from silently making consequential decisions.
  7. Implement notices and labels. Tell people when they are interacting with AI and label covered generated or manipulated content.
  8. Protect evidence. Retain technical documentation, instructions, test results, approvals, logs, training records, incidents, and corrective actions in a controlled location.
  9. Prepare incident response. Define how staff detect, contain, investigate, notify, and remediate serious failures or security events.
  10. Review change. Reassess when the model, data, supplier, geography, user group, or purpose changes, and schedule legal review against current official guidance.

What should an individual AI user do?

Look for an AI disclosure and treat generated output as a draft rather than automatic truth. Do not paste confidential, personal, or regulated information into a tool unless you understand the provider’s controls and your organisation permits it.

  • Ask for human review when an output affects employment, credit, education, healthcare, benefits, safety, or another important opportunity.
  • Check the source of factual claims and preserve the original context when forwarding generated material.
  • Use the provider’s complaint or correction channel when an output is harmful or wrong.
  • Report unexpected behaviour through your organisation’s incident process instead of silently working around it.

How should you compare AI obligations across jurisdictions?

A side-by-side assessment prevents a voluntary framework from being mistaken for a statute or a European deadline from being applied to a US use case. Record the answer to each axis for every system.

Comparison axis Questions to answer
Role Who is the provider, deployer, importer, distributor, or operator?
Risk class Is the practice prohibited, high-risk, transparency-risk, or minimal-risk?
Market and reach Where is the supplier established, where is the system offered, and where are affected people located?
Controls Are testing, data governance, logs, human oversight, notices, labels, incident reporting, or conformity assessment required?
Timing What is the effective date, transition period, and category-specific extension?
Enforcement Which authority, contract, procurement term, or sector regulator can require action, and what remedies or penalties apply?

What are the most common compliance mistakes?

Assuming “voluntary” means irrelevant

A voluntary UK code or NIST framework can be incorporated into a contract or procurement requirement. Record the instrument that creates the obligation and implement only the controls relevant to the use case.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating a general-purpose model as automatically low risk

Risk follows the application and affected people. A general model used in a high-impact workflow may require controls that do not apply to a casual drafting use.

Relying on a one-time approval

Models, prompts, vendors, and data change. Continuous monitoring, logs, incident handling, and reassessment are necessary because a previously acceptable system can move into a different risk or jurisdictional category.

Putting a notice where users will not see it

A disclosure that is technically present but absent from the actual conversation, message, or media can fail its transparency purpose. Test the user-facing experience and the downstream copies of generated content.

Frequently Asked Questions

Can a small business ignore the EU AI Act if it has no EU office?

Not automatically. Supplying a covered system into the EU or serving an EU-based deployer can create obligations even when the vendor is established elsewhere. Check the system’s market activity, role, and risk category rather than relying on company size or headquarters.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do AI contracts make voluntary standards enforceable?

They can. A customer, tender, insurer, or internal policy may require named practices from a voluntary framework, making those practices contractual or operational duties for that relationship. Keep the contract version and acceptance evidence with the AI system’s compliance records.

What evidence helps prove that an AI system was supervised?

Keep dated oversight assignments, training completion, review samples, override or escalation records, incident tickets, and change approvals. These records show who could intervene and what happened in practice, rather than merely asserting that a human was involved.

Do transparency labels have to stay with AI-generated content?

Where a rule requires generated or manipulated content to be identifiable, design labels to survive the channels in which the content is shared. Test exports, reposts, and automated messages, and document how the label is preserved or restored.

How often should an AI compliance review be repeated?

Repeat it whenever the model, provider, data, purpose, user population, or operating country changes, and whenever an applicable law or transition date changes. A scheduled review calendar is useful, but event-triggered reviews catch the changes a calendar can miss.
