India does not currently have a single, comprehensive AI statute equivalent to the EU AI Act. As of 25 October 2026, its national approach is set out in principle-based AI Governance Guidelines that recommend building on existing laws and addressing gaps through targeted measures. The EU, by contrast, has an enacted, risk-based AI regulation with defined categories, duties and enforcement roles. That difference matters, but it does not mean AI use in India is unregulated: existing laws may impose binding duties, and India’s data-protection framework is commencing in stages.

Does India have an AI law like the EU AI Act?

Not in the same form. India has government AI Governance Guidelines, but they are a policy framework of principles and recommendations, not a single binding statute that creates the EU Act’s system of AI risk categories and duties. India’s binding requirements instead come from applicable existing statutes, rules and sector-specific requirements, depending on the activity and context.

The distinction is between a framework that recommends how government and other actors should govern AI, and a dedicated regulation that establishes legal obligations for defined categories of AI systems. It is also important not to treat a law’s enactment as proof that every provision is already in force: India’s Digital Personal Data Protection (DPDP) Act, 2023 has a phased commencement schedule.

What is India’s AI Governance Guidelines approach?

The Government of India’s February 2026 backgrounder describes the AI Governance Guidelines as a principle-based national framework anchored in seven “Sutras.” Their stated purpose is to support safe, trusted and inclusive innovation while managing risks across the AI value chain. The guidelines say the overarching goal is “to encourage innovation, adoption and technological progress, while ensuring that actors in the AI value chain are mitigating risks to individuals and society.” (Government of India, India AI Governance Guidelines.)

Build on existing law, then identify gaps

Rather than start with one AI-specific statute covering every system, the guidelines review laws that may already apply to AI-related activity. The areas they identify include data protection, information technology, intellectual property, competition, media, employment, consumer and criminal law. The framework recommends clarifying how existing law applies across the AI value chain, reviewing gaps and considering targeted intervention where needed.

That is a different regulatory design from creating a dedicated statute with AI-specific categories at its centre. It also means that the legal answer may depend on what a system does, what data or activity is involved, and which existing legal requirements apply. The guidelines’ recommendations should not be presented as binding duties unless a recommendation has separately been made law.

Recommendations and institutions

The government material describes recommendations for proportionate obligations and liability, common standards, expert-led governance, regulatory sandboxes and continued review of regulatory gaps. These indicate possible directions for governance; they do not, by themselves, establish that every organization must follow a particular new AI-specific procedure.

A July 2026 parliamentary update describes the AI Governance and Economic Group, Technology and Policy Expert Committee, and AI Safety Institute as institutional mechanisms initiated in relation to the guidelines. The update also places the DPDP Act within the existing accountability framework for personal data. (Government of India parliamentary update, 29 July 2026.)

How does the EU AI Act organize its requirements?

The EU AI Act uses a risk-based structure. It prohibits specified unacceptable-risk practices, imposes requirements on designated high-risk systems, sets transparency requirements for certain situations, and adds no AI Act-specific rules for minimal- or no-risk systems. The obligations therefore depend on the category and use, rather than applying one uniform compliance checklist to every AI tool.

The European Commission’s overview describes requirements for relevant high-risk systems that include risk assessment, data quality, logging, documentation, human oversight, robustness, cybersecurity and accuracy. The exact duties depend on the applicable category and circumstances; this summary is not a substitute for checking the Act’s specific provisions. (European Commission, AI Act overview.)

Question India European Union
What is the central instrument? Government AI Governance Guidelines: principle-based guidance and recommendations, alongside applicable binding statutes, rules and sector-specific requirements. Regulation (EU) 2024/1689: a dedicated AI regulation establishing a risk-based framework.
How are AI risks organized? The guidelines recommend proportionate obligations, review of existing law and targeted action to address identified gaps. The Act distinguishes prohibited practices, specified high-risk systems, transparency cases, and minimal- or no-risk systems.
Where do binding duties come from? From applicable laws and rules, including data-protection requirements when they apply; a guideline recommendation is not automatically a legal duty. From the Act’s applicable requirements for the relevant practice or system category, alongside other EU law.
Who has governance or oversight roles? Government material describes institutional mechanisms initiated in relation to the guidelines, including the AI Governance and Economic Group, Technology and Policy Expert Committee, and AI Safety Institute. The European Commission AI Office and national competent authorities share implementation and enforcement responsibilities with assigned roles.
What is the timing picture? The guidelines are not a single AI statute with one commencement date. DPDP Act provisions have different commencement dates under the 2025 notification. The Act has staged application dates; the Commission’s current overview gives dates in December 2027 and August 2028 for specified high-risk categories.

What does the EU AI Act require that India’s framework does not?

The clearest difference is regulatory specificity. The EU Act expressly organizes requirements around risk categories, including bans for specified practices and requirements for designated high-risk and transparency cases. India’s guidelines instead set out a principle-based approach and recommend proportionate obligations, clarification of existing law and targeted gap-filling. A reader should not infer that every EU duty has an Indian counterpart, or that India’s guidelines alone create equivalent duties.

Prohibited practices and risk categories

The Commission describes specified unacceptable-risk practices as prohibited under the EU framework. The Act also addresses high-risk systems and transparency situations, so it is not simply a list of bans. For minimal- or no-risk systems, the Commission says the Act adds no AI-specific rules. India’s guidelines recommend identifying risks and addressing gaps, but the material described here does not establish an equivalent national AI-law classification into these EU categories.

Compliance duties and oversight

For relevant EU high-risk systems, the Commission lists matters such as risk assessment, data quality, logging, documentation, human oversight, robustness, cybersecurity and accuracy. Enforcement is shared: the AI Office has responsibility for specified general-purpose AI model obligations and certain system categories, while national competent authorities oversee designated AI system rules. (European Commission, AI Act enforcement framework.)

India’s guidelines recommend common standards, expert-led governance and proportionate obligations, while the government describes several institutional mechanisms. These are not the same as the EU Act’s defined allocation of responsibilities and category-specific legal duties. The comparison is about the form and specificity of the frameworks, not a claim that India lacks enforceable rules in other applicable areas.

How does India’s DPDP Act affect AI regulation?

The DPDP Act matters when digital personal data is processed. It is part of India’s existing legal context for AI, but it is not a general AI statute: its relevance depends on whether the activity falls within its subject matter and on which provisions have commenced.

Enactment and commencement are separate

The DPDP Act, 2023 received assent on 11 August 2023. The Act provides for commencement by government notification, including different dates for different provisions. The official commencement notification of 13 November 2025 set a phased timetable: certain provisions commenced on publication, specified provisions are scheduled one year after publication, and many substantive provisions are scheduled eighteen months after publication. As of 25 October 2026, the eighteen-month date has not arrived. (DPDP Act, 2023; official commencement notification, 13 November 2025.)

Consequently, it is inaccurate to say the whole Act became operational when it received assent, or to assume that every provision is in force because some provisions have commenced. The provision and its scheduled or actual commencement date need to be checked for the question at hand. MeitY’s official document collection lists the Digital Personal Data Protection Rules, 2025 and the Act’s enforcement timeline, and describes the Rules as subject to phased commencement as well. (MeitY, Digital Personal Data Protection Rules 2025 listing.)

When do the EU AI Act’s staged dates apply?

The EU Act entered into force on 1 August 2024, but its requirements do not all apply on one date. The Commission’s overview, as of 25 October 2026, gives 2 December 2027 for specified high-risk uses in Annex III and 2 August 2028 for high-risk AI systems embedded in regulated products. These dates relate to the specified categories; they should not be generalized into a single start date for the entire Act.

The Commission page also reports that an AI Omnibus agreement entered into force on 27 July 2026 and adjusted the high-risk implementation timeline. Because dates and transitional provisions are consequential, readers should verify the Commission’s current overview and the applicable legal text before relying on a deadline. (European Commission, AI Act overview and implementation timeline.)

How should an organization compare the frameworks in practice?

Start with the jurisdiction and conduct, not with the assumption that one country has rules and the other does not. A useful first-pass review identifies whether the organization is subject to EU AI Act requirements, which Indian laws or sector rules may apply, and whether personal data is being processed under provisions that have commenced. This is an orientation method, not a compliance determination.

  1. Identify the activity and setting. Describe what the AI system is used for, who uses or supplies it, and the sector or process involved. This helps determine which existing Indian legal or sector-specific requirements may be relevant and whether an EU Act category needs to be examined.
  2. Check the EU risk category if the Act may apply. Determine whether the use is among specified prohibited practices, a designated high-risk use, a transparency case or a minimal- or no-risk use. Consult the Act and the Commission’s current explanation rather than treating the category summary here as a legal test.
  3. Map the Indian legal basis separately. Review the applicable Indian statutes, rules and sector requirements. Treat the AI Governance Guidelines as policy guidance and recommendations; verify whether a recommendation has separately become a binding rule before describing it as mandatory.
  4. Check personal-data provisions by date. If digital personal data is involved, identify the DPDP Act and Rules provisions relevant to the activity and confirm their commencement status under the notification and current MeitY materials.
  5. Record uncertainty and obtain specific advice where needed. A system’s classification, the application of a law and the commencement of a provision can turn on facts not established by a high-level country comparison. Seek qualified legal advice for a decision about a particular organization or system.

What is the practical takeaway from the comparison?

India’s approach is currently more principles-led and grounded in existing law, with recommendations for targeted review, standards and governance capacity. The EU AI Act is a dedicated, category-based regulation with specified prohibitions, high-risk requirements, transparency duties and assigned enforcement roles. India’s framework is not equivalent in legal form or specificity, but that does not make Indian AI activity law-free: applicable existing laws can still create binding obligations.

For both jurisdictions, legal status and timing matter as much as the headline framework. India’s guidelines are not a single commencement event, and the DPDP Act is phased. The EU Act has staged application dates that the European Commission says were adjusted in 2026. This comparison is a current overview as of 25 October 2026, not legal advice or a finding about any particular system’s compliance.

Frequently Asked Questions

Does the EU AI Act replace the GDPR?

No. The Commission describes the AI Act as operating alongside other EU law, and the material summarized here does not attempt a full GDPR comparison. A system can therefore raise questions under more than one legal framework.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can an Indian company use this comparison to decide whether its AI system is compliant?

No. The answer depends on the system’s purpose, data, deployment and other facts, as well as the exact laws and provisions in force. A jurisdiction-specific legal review is needed for a compliance decision.

Are there reliable figures showing which country’s AI rules are more effective?

The official material summarized here establishes framework details and legal dates, not comparable outcomes such as AI-related harms, regulatory costs, adoption or enforcement results. It does not support a numerical ranking of effectiveness.
