AI liability insurance can help cover claims tied to an organization’s use, development, or oversight of artificial intelligence—but there is no single standard policy, and ordinary business insurance may leave important gaps. Coverage depends on the policy’s exact AI definition, the event that triggers coverage, exclusions, limits, and whether the claim is made and reported on time. Before relying on an existing policy or buying a specialized one, identify which AI-related losses it affirmatively covers and which it removes.
What is AI liability insurance?
AI liability insurance is an emerging category of insurance protection for claims involving artificial intelligence. It may take the form of a standalone policy or an endorsement added to another policy. Some existing policies may cover certain AI-related claims without naming AI explicitly—a situation often described as “silent” coverage—but that is not the same as clear, affirmative protection.
There is no standardized AI liability form. Ropes & Gray notes that businesses commonly rely on a mix of cyber insurance, technology errors and omissions (E&O), directors and officers (D&O), and commercial general liability (CGL) insurance. Those policies were not designed specifically for AI, and their wording varies by insurer and policy form. The practical question is therefore not simply whether a company has insurance, but whether a particular policy responds to a particular AI-related claim.

A company that develops a model, sells an AI product, deploys a third-party tool, or uses AI to provide professional services may face different claims and policy triggers. A policy that is suitable for an AI developer may not address the risks of an employer using an automated screening system or a business using an agent to carry out transactions.

What can AI liability insurance cover?
Specialized offerings may address claims that ordinary policies do not clearly handle. The available protections differ by insurer and policy; a list of coverage modules is not a promise that every claim involving that risk will be covered.
AI-related management and employment claims
Mayflower Specialty lists AI-D&O coverage addressing allegations such as AI-washing, failed oversight, and misleading statements about a company’s AI. AI-washing generally refers to claims that a company misrepresented its AI capabilities or use. Its AI-EPL module addresses employment-practices claims involving discrimination by screening or ranking tools and dismissals based on AI scores.
Errors, omissions, and agent mistakes
Mayflower’s AI-E&O module lists hallucinated or inaccurate output, model errors and drift, and mistakes by AI agents. These examples illustrate why AI errors may create third-party financial-loss claims even when there has been no security breach. Whether a given loss qualifies still depends on the policy’s wording, exclusions, and conditions.

Mayflower also lists AI DIC Excess, intended for AI claims that fall outside existing D&O, employment practices liability (EPL), or E&O wording. “Difference in conditions” protection is designed to address specified gaps between underlying coverages, but the actual scope, attachment point, and limits must be checked in the policy documents.
Auxilium’s autonomous-operations policy lists losses tied to an agent executing the wrong payment or refund, making a commitment, running up charges, or corrupting records. It also lists response and restoration, regulatory-proceeding defense, financial-loss liability, and a general-liability gap where CGL or umbrella insurance excludes AI. These are examples of risks a specialized form may address, not universal features of AI insurance.

Does cyber insurance cover AI hallucinations or deepfakes?
Cyber insurance is generally aimed at covered security incidents, not every loss involving AI. It may respond when AI is used as part of an attack—for example, AI-powered phishing or some deepfake-enabled attacks—if the event meets the policy’s definition of a covered incident.
Gallagher identifies a major distinction: AI as a tool used in a cyberattack is different from AI itself producing a harmful result. A hallucinated answer, discriminatory decision, copyright or other intellectual-property claim, defamation allegation, financial loss from inaccurate output, or disclosure of data through an output may not meet a cyber policy’s security-incident trigger. A company should not assume that an AI-related loss is covered just because the tool processed data or the event involved technology.
Recommended Free Tools
Cyber policies can also differ on first-party losses, third-party claims, business interruption, response costs, and the definitions that control coverage. Read the insuring agreements and exclusions together: a broad reference to data or technology does not establish that an AI output error is covered.
Will technology E&O cover a company that uses someone else’s AI?
Not necessarily. Technology E&O is built primarily for suppliers of technology products or services facing third-party financial-loss claims. Gallagher cautions that it is generally not the right standalone answer for a company that merely deploys another provider’s AI.
That distinction matters when a business uses a third-party model to screen applicants, generate professional work, advise customers, or automate business operations. The company may face a claim because of how it selected, configured, supervised, or relied on the tool, even if it did not build the model. Ask whether the proposed coverage protects the insured in its actual role and whether it addresses claims connected to third-party models and vendors.

Which insurance lines may respond to AI-related losses?
One AI incident can raise several different kinds of claims, and those claims may fall under different insurance lines—or require an endorsement. Aon’s peril map highlights professional errors, output-related copyright or trademark claims, patent and trade-secret claims, employment discrimination, bodily injury, property damage, privacy, cyber, crime, D&O, and EPL as distinct exposures to consider.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute| Policy or coverage type | Potential relevance to AI | Important limitation to check |
|---|---|---|
| Cyber | May respond to a covered security incident, including some attacks that use AI. | An AI output error or other liability may not satisfy the security-incident trigger. |
| Technology E&O | Designed for technology suppliers and third-party financial-loss claims. | May not be a standalone fit for a company that only deploys another provider’s AI. |
| D&O | May be relevant to allegations about management oversight or statements concerning AI. | Check whether AI-related claims are covered or excluded and how the policy treats the alleged conduct. |
| EPL | May be relevant to employment claims involving AI-assisted screening, ranking, or dismissal. | Confirm how the wording treats automated tools and discrimination allegations. |
| CGL | May be relevant to certain third-party injury or advertising-related allegations. | New generative-AI exclusions may remove specified claims; CGL is not a general solution for AI financial losses. |
| Specialized AI coverage | May expressly address selected AI errors, agent actions, or gaps in other policies. | Covered uses, perils, limits, reporting duties, and availability depend on the specific form. |
This is a mapping aid, not a coverage determination. One incident may involve multiple allegations—for example, a disputed employment decision and a claim about how the decision was communicated. The claim’s facts and each policy’s terms determine which insurer, if any, has a duty to defend or indemnify.
What AI insurance exclusions can remove?
An AI exclusion can remove coverage for defense costs and damages when a claim falls within its wording. The breadth of the exclusion depends on its trigger: wording based on direct causation may be narrower than wording that applies whenever AI played any part in the events.
Dentons describes exclusions that use phrases such as “arising from,” “relating to,” or “involving” AI. Those phrases can produce materially different outcomes depending on the rest of the clause, the policy, and the facts. For example, if an AI tool contributed to a broader decision-making process, a broad “involving AI” exclusion could be more consequential than an exclusion requiring AI to be the direct cause of the loss. Do not infer the result from a headline or summary; review the full endorsement and its definitions.
Gallagher reports that new generative-AI exclusions can remove CGL coverage for bodily injury, property damage, and personal or advertising injury arising from generative AI. CGL also excludes first-party losses and commonly does not cover hallucinations, financial loss, discrimination, bias, data breaches, or business interruption. The exact effect depends on the policy form and any endorsements attached to it.

Dentons also notes optional ISO/Verisk endorsements effective January 1, 2026 that remove defense and indemnity for certain losses connected to generative AI. Their existence does not establish that a particular policy includes them. Ask the insurer or broker for the current form and every endorsement, including any version effective for the policy period being reviewed.
How can a company check whether its policies cover AI?
Start with the actual policy documents rather than a proposal, product page, or verbal assurance. Ask a licensed broker to map the company’s AI uses to the relevant insuring agreements, exclusions, endorsements, and reporting conditions.
- Inventory the use. Record which teams use AI, what each tool does, whether it makes or recommends decisions, what data it receives, and whether it can take actions such as sending payments or changing records.
- Identify the insured’s role. Separate development, resale or supply, deployment of a third-party tool, and use of AI within a professional service. Explain which role the business performs to the broker.
- Collect the complete forms. Obtain the current policy, declarations, schedules, endorsements, and applicable definitions. A marketing description is not a substitute for the wording that governs a claim.
- Trace the trigger. For each relevant coverage, ask what event must occur, whose conduct must be alleged, and whether the policy requires direct causation or applies more broadly to claims involving AI.
- Check the loss categories. Review treatment of IP, privacy, discrimination, bodily injury, property damage, regulatory proceedings, financial loss, and first-party response or restoration costs.
- Review claim handling and limits. Confirm the defense duty, consent-to-settle provisions, sublimits, retentions, aggregates, and any other conditions that could affect the amount or handling of a claim.
- Verify reporting and reach. For claims-made coverage, identify the applicable reporting requirements and deadlines. Confirm territorial scope and whether the policy is available for the relevant state or jurisdiction.
- Get the answer in writing. Ask the broker to explain which identified use is covered, which form responds, and what exclusions or conditions could change that answer.
Marketing language such as “AI protection” or “AI-ready” does not establish affirmative coverage. Ask whether the policy is affirmative, silent, or exclusionary, and whether it covers the specific tools and activities the company actually uses. A policy described as AI coverage may apply only to selected risks or insured roles.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What governance practices can help with underwriting?
Insurance does not replace responsible AI oversight. The National Association of Insurance Commissioners (NAIC) states that insurers using AI remain responsible for compliance with insurance laws, regulations, insurance standards, and consumer-protection rules. For businesses seeking coverage, documented governance can also help an underwriter understand how AI is controlled and monitored.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →- Maintain a model inventory: record tools, model owners, business uses, and the systems or data flows they depend on.
- Name accountable owners: make clear who approves use, monitors performance, and escalates problems.
- Keep decision and system logs: preserve records that can help reconstruct what a tool produced or did and how people used its output.
- Use human review for high-stakes decisions: define when an employee must check or override an AI recommendation before action.
- Monitor bias and drift after deployment: review whether outcomes or model behavior change over time.
- Document vendors and data flows: know which outside providers are involved and what information moves between systems.
- Prepare an AI-specific incident-response plan: set out how to contain a harmful output or action, preserve records, and escalate the event.
These controls do not guarantee insurance eligibility or coverage. They provide a clearer account of how AI is used and managed; the insurer’s underwriting criteria and policy terms still govern.

How much does AI liability insurance cost?
There is no responsible general premium benchmark or claims-frequency figure to apply across jurisdictions based on the available published information. Because AI insurance forms are not standardized, a single price comparison can be misleading.
Premiums and terms must be assessed for the specific insured, its activities, the coverage requested, and the form offered. Ask a licensed broker about insurer availability in the relevant jurisdiction and request the limits, retentions, exclusions, and covered uses alongside any quote. A low premium is not useful if the policy excludes the loss the company is trying to insure.
Frequently Asked Questions
Can a company be liable if an AI system makes the decision?
Potentially, but responsibility depends on the facts, applicable law, and the company’s role in selecting, configuring, supervising, and acting on the system. An insurer’s coverage decision is a separate question governed by the policy language.
Does an AI policy cover claims against my AI vendor?
Do not assume so. A policy issued to your company may address your own covered liability without insuring the vendor, and contracts between the parties may allocate responsibilities separately from insurance.
Should we notify our insurer after a harmful AI output?
Check the policy’s notice and reporting conditions promptly and contact your broker or insurer if the event could become a claim. Preserve relevant prompts, outputs, logs, and decision records under your organization’s incident-response process.
Can an AI insurance endorsement override an exclusion in another policy?
It depends on how the endorsement is written, what policy it attaches to, and whether it grants coverage or only changes specified terms. Ask for the complete issued forms and have the broker explain how they interact.
