In the United States, AI output is not automatically copyrighted and a prompt alone is not enough. Protection generally exists only where a human author determines sufficient expressive elements—through original material, creative selection and arrangement, or meaningful modifications. Using AI as an assistive tool does not by itself eliminate protection for a human-authored work. Training an AI system on copyrighted works is a separate, fact-specific question: recent decisions reached different results depending on lawful acquisition, competition, copying, storage, and evidence of market harm. This guide explains the rules and the practical records creators and companies should keep as courts and the U.S. Copyright Office continue to develop the law.

What does AI copyright law currently allow?

Current U.S. law starts with a human-authorship requirement. The Copyright Office said in its January 29, 2025 announcement that generative-AI outputs can be protected “only where a human author has determined sufficient expressive elements.” A system that produces an image, text, music track, or video autonomously does not become an author merely because a person typed an instruction.

The rule does not mean every work made with software is unprotected. Human-written passages, photographs, drawings, edits, sequencing, and other original contributions can remain protected when AI is used as a tool. The Copyright Office’s Part 2 report states: “Neither the use of AI as an assistive tool nor the incorporation of AI-generated content into a larger copyrightable work affects the availability of copyright protection for the work as a whole.”

That protection applies to the human-authored portions and to the overall arrangement a person actually creates. It does not automatically grant exclusive rights over an unmodified machine output, nor does it answer whether the model used someone else’s protected material unlawfully.

When can an AI-assisted work receive copyright?

An AI-assisted work is most defensible when the human contribution determines the expressive result rather than merely requesting a general idea. The relevant question is not how many prompts were typed, but which expressive choices a human made and how those choices appear in the final work.

Human-authored material remains protected

If you write an article, compose lyrics, draw characters, or shoot photographs yourself and use AI for brainstorming, spelling suggestions, color tests, or other assistance, your original expression can still qualify. Keep the underlying files so you can identify what you created and what the system supplied.

Creative arrangement can supply authorship

A person may select, coordinate, and arrange AI-generated elements into an original compilation, book, game, presentation, or audiovisual work. Protection attaches to the human-authored selection, ordering, transitions, and other expressive structure, not automatically to every generated component considered separately.

Meaningful modification can matter

Substantial human edits—rewriting passages, repainting details, changing composition, recording and mixing performances, or otherwise reshaping an output—can create protectable expression. The more the final appearance reflects deliberate human decisions, the stronger the authorship argument; simply accepting the first result is weaker evidence.

Does a prompt give me copyright?

No. A prompt by itself is not enough under the Copyright Office’s current guidance. A detailed instruction can communicate an idea, mood, subject, or desired result without determining the specific expressive elements that appear in the output.

Human involvement Likely copyright significance What to document
One broad prompt followed by unedited output Usually insufficient for copyright in the output itself Prompt and original file, while recognizing the prompt alone does not establish authorship
Iterative prompting with selection among many results May support protection for human selection or arrangement, depending on the final work Prompt history, rejected versions, selected elements, and layout decisions
Human-written or human-drawn material incorporated into output Those original portions can remain protected Drafts, source files, timestamps, and the boundaries between human and generated material
Extensive editing, repainting, rewriting, or recomposition Can support protection for the resulting human modifications and overall work Layered files, edit logs, and before-and-after versions

Copyright does not protect an abstract idea, style, or concept merely because a prompt describes it. It protects original expression that a human actually authored.

Is AI-generated material inside a larger work protected?

Often, yes—but protection is measured at the level of the human-authored work and its components. A novel can contain a generated background image while the author’s prose, plot arrangement, and editing remain protected. A video can include generated effects while the human’s script, performances, shot choices, and sequence supply protectable expression.

The generated insert may remain outside the author’s exclusive rights if no human determined its expressive details. That distinction matters when licensing, registering, or enforcing rights: identify the human-created portions instead of claiming ownership over every pixel, sentence, or note produced by a system.

Is training an AI model on copyrighted works legal?

There is no single U.S. rule that resolves every training-data dispute. Courts apply ordinary copyright and fair-use principles to the particular works, copies, purpose, product, and evidence before them. The key questions are:

  1. Are the source works original and protected? Facts and public-domain material raise different issues from highly original books, illustrations, or software.
  2. How were copies obtained? Licensed or otherwise lawful acquisition can present a different case from downloading pirated collections.
  3. Does the AI product compete with the source or its market? A system that substitutes for the original service or product may face a different fair-use analysis from a genuinely transformative use.
  4. Is there evidence of memorization or substantial reproduction? Outputs that reproduce protected expression can create separate exposure from the act of training.
  5. Is there measurable market substitution or dilution? Courts examine whether the use harms existing or plausible markets, not merely whether a model was trained on protected works.

These factors overlap, but none is a universal safe harbor. A favorable decision involving one dataset or model does not automatically legalize another company’s ingestion, storage, or outputs.

What do the recent U.S. cases show?

Recent decisions illustrate why broad statements such as “training is always fair use” or “AI training is always infringement” are unreliable.

Case What the court or report addressed Practical lesson
Thomson Reuters v. Ross Intelligence (Third Circuit, September 29, 2026) The court held Westlaw headnotes copyrightable and found Ross’s use to train a competing legal-research platform was not fair use. Originality, commercial purpose, direct competition, and ordinary copyright analysis still matter when an AI-related tool is involved.
Bartz v. Anthropic (June 2025 ruling report) Training Claude on books was treated as fair use in the circumstances presented, while copying and storing more than seven million allegedly pirated books was treated separately as infringement requiring further proceedings. Transformative training and the provenance and retention of source copies must be analyzed separately.
Kadrey v. Meta Judge Vince Chhabria dismissed the authors’ claims on the record before him after finding insufficient evidence of market dilution. The ruling was limited. The judge expressly said: “This ruling does not stand for the proposition that Meta’s use of copyrighted materials to train its language models is lawful.”
Thaler v. Perlmutter (D.C. Circuit, March 2025) The court upheld the human-authorship requirement for an image created wholly by generative AI. An autonomous output cannot obtain U.S. copyright merely because a person owns or operates the system.

The Copyright Office’s fair-use index lists Kadrey v. Meta as “Fair use found” and Bartz v. Anthropic as a mixed result. Those labels summarize particular records; they are not blanket approvals for all model training.

Why do lawful acquisition and storage matter?

The Bartz ruling separates two acts that are often described as one: using books to train a model and making or retaining copies of books obtained from an allegedly pirated library. A court may view the training purpose as transformative while still finding that the copying or storage itself infringes.

For a business, provenance therefore needs its own audit trail. Record whether a dataset came from a license, public-domain source, a user upload, a purchase, or a web crawl; retain the license terms; and track whether raw files are stored after ingestion. A model policy that discusses only “training” and ignores acquisition and retention leaves a major gap.

How should creators document human authorship?

Creators can make later registration, licensing, or dispute review easier by preserving evidence while a project is being made.

  1. Keep dated drafts and source files. Save text drafts, layered artwork, audio sessions, code commits, and project files rather than only the exported result.
  2. Preserve prompts and output history. Keep the prompts, generated alternatives, selections, and discarded versions in a folder associated with the project.
  3. Mark your edits. Use version history or notes to show rewriting, repainting, cropping, sequencing, mixing, and other creative decisions.
  4. Separate components. Identify which elements were supplied by a person, generated by a system, licensed from another party, or taken from the public domain.
  5. Write a short authorship memo. Describe the human decisions that determine the final expressive form while the details are fresh.

These records do not guarantee protection, but they make the human contribution easier to evaluate than a single flattened export with no history.

What should businesses check before releasing AI-assisted content?

Companies should treat copyright review as a chain-of-custody and output-review process, not as a one-time prompt approval.

Before data is ingested

  • Identify the owner and copyright status of each source category.
  • Confirm the permission, license, or other legal basis for making copies.
  • Limit collection to what the project needs and document retention periods.
  • Check model terms for restrictions on uploads, outputs, and commercial use.

Before an output is published

  • Review for verbatim or near-verbatim passages, recognizable images, distinctive characters, and other substantial reproduction.
  • Check whether the result could substitute for a licensed source, database, or professional service.
  • Have a human editor make and record substantive creative decisions.
  • Route high-risk material—especially competing legal, news, educational, or entertainment products—to qualified counsel.

After release

  • Keep the input, output, editing history, approvals, and source-provenance records together.
  • Provide a process for responding to a rights-holder complaint and preserving the disputed version.
  • Reassess the project when a court decision, license term, or model version changes.

These controls manage risk; they are not a promise that a particular use is noninfringing.

What remains unresolved in 2026?

The national picture is still developing. The Copyright Office’s AI initiative includes analysis of generative-AI training, licensing, and liability, and its work is not a substitute for a final rule covering every dataset or output. The Copyright Society reported in 2026 that nearly one hundred active U.S. copyright lawsuits were challenging generative-AI models.

Open questions include whether model ingestion itself creates an actionable reproduction, how courts should assess memorized outputs, when a generated result is substantially similar to a protected work, and how to measure market substitution for new AI services. The American Bar Association describes the area as unsettled and notes that Ross involved a nongenerative tool competing with Westlaw, unlike many generative-model cases.

Until more appellate decisions and possible legislation arrive, apply the five comparison questions—protected source, lawful acquisition, competition, reproduction or memorization, and visible human choices—to the exact facts of the project. Do not extrapolate from a headline or a single favorable ruling.

What is the practical bottom line for an AI project?

A person can claim copyright most confidently in original expression they wrote, drew, recorded, selected, arranged, or materially changed. A prompt alone does not create ownership of an autonomous output. For training, fair use remains fact-specific, and lawful sourcing, separate storage decisions, competition, and evidence of copied expression can change the result. Preserve the records that show both where the data came from and what humans contributed, and obtain legal advice when the project relies on large copyrighted datasets or competes directly with a protected market.

Frequently Asked Questions

Can I copyright an AI-generated image if I selected the best version from hundreds?

Selection can support a copyright claim in a larger human-authored arrangement, but choosing a favorite output does not automatically transfer authorship of every generated detail to you. The strength of the claim depends on the expressive selection, arrangement, and modifications visible in the final work.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should I do if an AI output appears to copy a book or song?

Pause publication or distribution of the disputed version, preserve the prompt and output history, and compare the material with the suspected source. Keep a record of the review and consult qualified copyright counsel before releasing a replacement or making a public accusation.

Does a fair-use ruling for one AI model protect other models?

No. Courts decide the record in front of them, including the dataset, acquisition method, product purpose, competition, storage, and evidence of market harm. A different model or business may present materially different facts.

How should a company handle AI training data that came from users?

Track the user’s permission and the terms that govern reuse, identify whether the upload contains third-party protected material, and document deletion or retention decisions. User-provided data is not automatically cleared for model training merely because it was submitted to a service.
