Short answer: Federal authorities hold Bitcoin after a seizure because it may be evidence, alleged crime proceeds, or property connected to a crime, and the ownership claim may still be contested. A seizure puts the coins in custody; it does not automatically make them government property. The Department of Justice (DOJ) generally directs agencies to preserve cryptocurrency in the form seized until criminal or civil forfeiture is final. After final forfeiture, the U.S. Marshals Service (USMS) can arrange liquidation, unless a different legal disposition applies. A March 6, 2025 executive order adds a major exception for qualifying Bitcoin deposited into the Treasury Department’s Strategic Bitcoin Reserve: that Bitcoin is directed not to be sold, subject to court orders, statutory duties, victim compensation and other specified exceptions.

What “seized Bitcoin” actually means

When agents take control of Bitcoin in a criminal investigation or civil forfeiture case, the government has custody of the asset. The legal owner may still be the defendant, another claimant, or an unidentified person whose rights have not yet been decided. That distinction matters because the government cannot treat every seized coin as an asset it is free to spend.

Forfeiture is the legal process that transfers ownership to the United States. It can occur through a criminal judgment, a civil forfeiture proceeding, or an administrative forfeiture when the applicable requirements are met and no valid claim defeats it. Until that process is complete, the coins are better described as “seized” or “in government custody,” not as money the government definitively owns.

Status What it means Can ordinary liquidation begin?
Seized Authorities control the cryptocurrency while an investigation or forfeiture case proceeds. Ownership may be disputed. Generally no. DOJ policy calls for keeping it in the form seized until forfeiture is final.
Forfeited A final criminal, civil or administrative order transfers the property to the United States. Usually yes, subject to claims, statutory requirements, court orders and current disposition policy.
Sold or otherwise disposed The government has converted or transferred the asset under an authorized disposition method. The transaction has occurred; proceeds are handled under the governing forfeiture rules.

Why authorities do not immediately sell seized Bitcoin

Preserving the property while ownership is contested

The DOJ Asset Forfeiture Policy Manual states: “Cryptocurrency should be kept in the form it was seized and not liquidated (i.e., converted to fiat currency or other cryptocurrency) until a final order of forfeiture is entered or an administrative forfeiture is final.” This is a custody rule, not a prediction about Bitcoin’s price.

Bitkey Bitcoin Hardware Wallet, No Screen - Self-Custody, No Seed Phrase
  • BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
  • SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
  • NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
  • 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
  • BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.

If the government sold coins before a final forfeiture and a court later ordered their return, it might have to compensate the owner for the value of the property, including a price increase that occurred while the case was pending. Keeping the same asset avoids turning a disputed ownership question into a liability caused by an early sale.

Avoiding avoidable price exposure

Bitcoin can move substantially between the day of seizure and the end of a case. Converting it early would expose the government to the risk that the sale price is lower than a later restitution or return obligation. Holding the original cryptocurrency preserves the possibility of returning that cryptocurrency rather than replacing it with an amount of dollars calculated after the fact.

Maintaining control for the forfeiture case

Control of the private keys is important in a civil forfeiture action. If the government cannot secure or control the asset, it may be unable to establish that the property is available for a judgment. Operational custody therefore supports both security and the legal process.

Who holds and controls seized Bitcoin?

USMS as the principal DOJ custodian

For assets held under DOJ-enforced laws and certain interagency arrangements, the Justice Manual gives the U.S. Marshals Service primary authority over management and disposal of seized assets in its custody and of assets that have been forfeited. USMS may use contractors and specialized services to secure, transfer or liquidate cryptocurrency.

Investigating agencies and temporary wallets

An agency that makes a seizure may first move the coins into a government-controlled self-custodial wallet or cold-storage system. The 2025 DOJ manual directs agencies to consult USMS about whether a particular cryptocurrency can be stored and liquidated by USMS or its contractor, and to transfer custody under the prescribed procedures.

A government-controlled wallet is an operational arrangement, not a retail wallet purchase. It can involve offline key storage, access controls, documented transfers and evidence procedures. The existence of an address visible on a blockchain does not by itself reveal which agency controls it or whether the balance is still tied to a pending case.

Treasury-agency property

Assets seized by Treasury agencies follow a different custody framework. The Justice Manual describes Treasury property custodians, generally contractors, operating under Treasury guidelines. Therefore, “the government’s Bitcoin wallet” is not necessarily one wallet or one department; custody depends on the agency, the statute and the interagency arrangement.

What happens from seizure to disposition

  1. Secure the coins. Investigators document the seizure, preserve relevant evidence and move the cryptocurrency into a government-controlled wallet or approved custody arrangement. Key handling and transaction records are maintained so the asset can be identified later.
  2. Start the forfeiture process. Prosecutors may seek criminal forfeiture as part of a conviction, or civil forfeiture against the property itself. Administrative forfeiture may apply when the law allows it and no timely, valid claim requires a judicial case.
  3. Give interested parties a chance to claim the property. Owners, lienholders and other third parties can contest forfeiture under the applicable procedure. A balance shown in a case inventory is therefore not necessarily a final government holding.
  4. Resolve the case and claims. A court order or final administrative decision determines whether the United States receives title, whether some or all coins must be returned, and whether victims or other claimants have rights to money or property.
  5. Choose an authorized disposition. Once forfeiture is final, USMS or the responsible custodian can arrange liquidation, transfer, retention or another lawful use. The method depends on the asset, the case and applicable policy.
  6. Account for the proceeds. Sale proceeds enter the applicable asset-forfeiture and statutory accounting systems. Distribution can involve victim compensation, law-enforcement purposes, equitable sharing with state or local partners and other purposes authorized by law.

How the Marshals Service sells forfeited Bitcoin

Liquidation follows final forfeiture

USMS liquidation normally becomes available after a final forfeiture order or final administrative forfeiture. The agency must also account for any court-directed return, third-party interest or statutory restriction before selling the coins.

Sales can use a contractor or a pooled offering

DOJ policy describes periodic auction liquidation in which cryptocurrency from one case may be pooled with assets from other cases and offered together. That description explains a possible operating model, not a promise that every future sale will use a public auction or a particular platform. Current USMS notices and contracts control the mechanics for a specific sale.

Timing figures are historical, not guarantees

A 2022 DOJ Office of the Inspector General audit reported that USMS typically sold cryptocurrency 30 to 60 days after forfeiture during the period it examined. The same audit described a planned contractor requirement to liquidate within five business days. Those figures are historical findings and a contract plan reported at that time; they are not a universal current deadline. A case can take longer when claims, security, valuation, court instructions or operational arrangements require it.

Timing reference What the source reported How to interpret it today
30–60 days Typical interval between forfeiture and sale in the period reviewed by the 2022 OIG audit. Historical operating observation, not a guaranteed schedule.
Five business days Planned liquidation requirement for a contractor described in that audit. A plan reported in 2022, not proof of present performance or a rule for every case.

Why a sale may not be visible immediately

Blockchain balances can remain at a government-controlled address while litigation, notice periods, title review, security checks or transfer arrangements are pending. A transfer to a contractor may also occur before the final sale. Conversely, a movement of coins on-chain does not necessarily mean they were sold for dollars; it may be an internal custody transfer.

What changed with the Strategic Bitcoin Reserve in 2025?

Executive Order 14233, signed March 6, 2025, directed the Treasury Department to establish custodial accounts known collectively as the Strategic Bitcoin Reserve. The Reserve is to be capitalized with qualifying Bitcoin held by Treasury that was finally forfeited and is not needed for statutory requirements or released under the order. Agencies were also directed to review their authority to transfer qualifying holdings and report their digital-asset holdings.

The order says: “Government BTC deposited into the Strategic Bitcoin Reserve shall not be sold and shall be maintained as reserve assets of the United States utilized to meet governmental objectives in accordance with applicable law.” That no-sale direction applies to qualifying Bitcoin that is actually deposited into the Reserve. It does not mean every Bitcoin seized by every federal agency has already been transferred there.

Exceptions and legal limits

The order preserves room for a competent court order and for a determination by the Attorney General or another relevant agency head that assets or proceeds can and should be used for identifiable and verifiable victims, law-enforcement operations, equitable sharing with state and local partners, or listed statutory requirements. The White House’s 2025 digital-assets report likewise describes victim compensation and statutory objectives as continuing considerations.

The Reserve policy therefore changes the default disposition of qualifying deposited BTC, but it does not erase the forfeiture process, third-party rights, victim claims or a court’s authority. It also does not automatically govern other cryptocurrencies held outside the Reserve. The order treats non-Bitcoin assets through a separate United States Digital Asset Stockpile framework and the applicable legal exceptions.

Silk Road-related Bitcoin: an example of the legal path

In November 2021, agents seized more than 50,676 Bitcoin from James Zhong in connection with the Silk Road investigation. DOJ later reported final forfeiture orders covering Bitcoin in that case. The example shows why headlines about a seizure and later headlines about forfeiture are different events: the first concerns custody during the case, while the second reflects adjudicated transfer of title.

DOJ’s 2022 release attached a dollar valuation to the Bitcoin at the time of seizure. That figure was tied to the market value then and should not be read as the coins’ current value or as the amount ultimately realized in a later disposition.

Common misunderstandings about government-held Bitcoin

  • “Seized means owned.” No. Seizure is control during a legal process; ownership generally changes only after final forfeiture.
  • “The government sells as soon as it takes the coins.” DOJ policy generally prohibits liquidation before final forfeiture because the property may have to be returned.
  • “Every federal Bitcoin balance is in the Strategic Bitcoin Reserve.” No. The 2025 order required reviews and accounting and applies its no-sale direction to qualifying BTC deposited into the Reserve.
  • “A blockchain transfer proves a sale.” No. It may be a move between government wallets, a contractor transfer or another custody step.
  • “The 30-to-60-day window is a current promise.” No. It was a historical OIG finding for the period reviewed.
  • “One large case reveals the government’s total Bitcoin holdings.” No. Cases can involve different agencies, legal statuses, wallets and reporting periods.

Federal scope and state-law differences

This explanation covers the federal DOJ and Treasury frameworks described above. State and local forfeiture laws can use different notice rules, custodians, sale procedures and revenue-allocation requirements. Even within the federal government, the responsible agency and statute can change the custody and disposition path. To understand a particular address or case, identify the seizing agency, the forfeiture type, the date of the final order and any court or victim-related restrictions.

What to check when a reported Bitcoin sale is announced

  1. Confirm whether the report describes a seizure, a final forfeiture or an actual sale.
  2. Check which agency had custody and whether USMS, Treasury or a contractor handled the asset.
  3. Look for the date and legal status of the forfeiture order.
  4. Determine whether the coins were qualifying BTC deposited in the Strategic Bitcoin Reserve.
  5. Read the sale notice for the method, lot size, eligibility rules and timing instead of assuming every sale is an auction.
  6. Separate the value at seizure from the sale proceeds and date each number.

The bottom line

The government holds seized Bitcoin because custody protects evidence and preserves the property while courts and claimants determine ownership. DOJ policy generally keeps the cryptocurrency in its original form until forfeiture is final. After that point, USMS may liquidate it through an authorized process, although historical sale intervals are not current guarantees. Since March 2025, qualifying forfeited BTC that is deposited into the Strategic Bitcoin Reserve is directed not to be sold, but court orders, victim compensation, law-enforcement needs and other statutory exceptions still matter.
