IBM SoftLayer’s reported Iran block did not contradict the sanctions relief announced that year: the United States lifted nuclear-related sanctions under the Iran nuclear deal, not every restriction on Iran, and SoftLayer separately applied its own compliance policy. Contemporary reports said the cloud provider blocked access from Iranian IP addresses beginning February 1, 2016. That is a historical account, not evidence of IBM’s current access policy.

What SoftLayer blocked in February 2016

On February 11, 2016, contemporary reports said IBM’s SoftLayer cloud service was unavailable in Iran because it blocked IP addresses originating there. The reports named Café Bazaar, an Iranian app store, and Elex-Tech, a game developer, among affected customers. The Data Center Knowledge / The WHIR account attributed the measure to SoftLayer’s compliance process and said the company would unblock services if the content was not prohibited under U.S. trade and economic sanctions. A Silicon.co.uk / TechWeekEurope report reproduced wording it attributed to SoftLayer’s legal FAQ: “This policy affects all SoftLayer datacenter locations and environments, and blocks access by IP addresses registered to countries subject to U.S. trade and economic sanctions.” The report said the network-wide blocking was to begin February 1, 2016, and that IBM had not made an official statement at the time. This is a quotation reported in 2016, not a current IBM policy statement. Silicon.co.uk / TechWeekEurope, February 11, 2016.

What the United States changed—and what it did not

On January 16, 2016, after the International Atomic Energy Agency verified that Iran had implemented key nuclear measures, the U.S. Treasury’s Office of Foreign Assets Control (OFAC) announced relief from nuclear-related sanctions described in the Joint Comprehensive Plan of Action (JCPOA). OFAC wrote: “As a result of Iran verifiably meeting its nuclear commitments, the United States is today lifting nuclear-related sanctions on Iran, as described in the JCPOA.” OFAC, “JCPOA Implementation,” January 16, 2016.

That was not a blanket repeal of all Iran-related rules. The relief was specifically nuclear-related; other restrictions and compliance obligations remained. In a May 19, 2016 joint statement, the United States, France, Germany, the United Kingdom, and the EU High Representative said: “This commitment to lift sanctions was fulfilled on Implementation Day, January 16, 2016.” U.S. Department of State, “Statement on Post-JCPOA Business with Iran,” May 19, 2016.

Why sanctions relief did not automatically open SoftLayer

Government sanctions relief and a cloud provider’s operational decision are different things. The JCPOA changed the scope of certain U.S. sanctions; it did not compel every U.S. company to make every product available in Iran. A provider still had to determine whether a particular service, customer, use, or transaction complied with the restrictions that remained. The 2016 news accounts described SoftLayer’s IP-address block as a compliance policy, rather than as a claim that the JCPOA had not taken effect.

That distinction also explains why the reports discussed possible review of content and customer eligibility: a country-level IP restriction could be the provider’s way of managing compliance, while the legal question depended on the specific service and activity. The reports establish what SoftLayer was said to have done then; they do not establish IBM’s present-day operational policy.

Did 2016 sanctions relief permit U.S. cloud services in Iran?

Not as a blanket rule. The relief covered nuclear-related sanctions described by the JCPOA, while other Iran restrictions remained. Separately, current OFAC guidance says 31 CFR § 560.540(a)(1) authorizes fee-based cloud computing services to Iran when they support the exchange of communications over the internet. The authorization has terms and conditions; it does not automatically cover every workload, customer, or transaction. OFAC FAQ topic 1611, including FAQ 441.

The current authorization should not be used to retroactively declare SoftLayer’s 2016 policy unlawful. Nor does a general authorization establish that IBM currently accepts users or traffic from Iran. For present-day legal requirements, consult OFAC’s Iran Sanctions program page, which lists current rules and actions.

Can people in Iran use IBM Cloud now?

The cited 2016 reports only describe the situation at that time. The available sources do not establish whether IBM currently blocks Iranian IP addresses or offers services to customers in Iran. OFAC’s authorization for some qualifying internet-communications cloud services is not confirmation of IBM’s availability or terms. Anyone assessing current access should check IBM’s current service terms and contact IBM directly, and should evaluate the applicable sanctions rules for the specific service and use.
