Fallout: New York went offline after its creator said ZeniMax Media contacted him about the project’s fallout.nyc domain and intellectual property. What was Fallout: New York?
Chris First presented Fallout: New York as a browser-playable fan game built with Claude and AI agents. PC Gamer reported that the project included quests, dialogue trees, V.A.T.S. and a working Pip-Boy. Those are descriptions in the reporting, not features independently verified here.
In a September 28, 2026 social post quoted by Yahoo Tech, First described the project this way: “Quests. Dialogue trees. V.A.T.S. A working Pip-Boy. Zero texture files. Zero sound files. Every building, weapon, face and sound is generated by code.” That is the creator’s account of how it was made, rather than an independent technical assessment.
Why did the project go offline?
According to PC Gamer, ZeniMax Media told First that the fallout.nyc domain infringed its intellectual-property rights. Yahoo Tech reported that First posted an image that appeared to show a notice concerning trademark infringement and copyrighted material. The reporting says the project was taken offline after the contact.

The notice itself has not been independently authenticated in the cited coverage, and there is no reported court ruling establishing infringement. It is therefore more accurate to describe this as a reported enforcement contact and takedown, not a judicial decision or a proven account of the notice’s exact legal claims.
Was Fallout: New York AI-generated?
First said he directed Claude and a group of AI agents to make the game. PC Gamer relayed his description of wanting something “exactly like Fallout,” rather than merely inspired by it. That wording helps explain why the project drew attention to its resemblance to the franchise; it should not be treated as a legal admission.

AI involvement does not, on its own, explain the reported takedown. The coverage connects ZeniMax’s contact to the domain and intellectual-property concerns. It does not establish a general rule that AI-made or noncommercial fan games are unlawful.
Why did a PC Gamer writer support the takedown?
Chalk’s PC Gamer piece is an opinion article, and its title states his reaction plainly: he was happy to see the project forced offline. His argument rests on his negative assessment of this game and its overt use of Fallout’s identity, alongside a contrast with large volunteer fan projects. Those are the writer’s judgments, not findings about the legal merits or a neutral measure of the project’s quality.

That distinction matters: a reader can disagree with Chalk’s view of the game without changing the underlying reported facts. The coverage does not establish that every fan project deserves the same response, or that every use of a franchise by fans is legally equivalent.

The reports say Fallout: New York went offline, but they do not establish whether copies or later versions are accessible now. The story names Fallout 3 and Fallout: New Vegas as official alternatives. PC Gamer’s cited Steam sale prices were temporary, so they should not be treated as current prices; check the live storefront for current availability and cost.
