The answer depends on three separate things: what human-authored expression the song contains, what the service’s contract says about its output, and what uses that contract permits. This article explains the U.S. position and uses Suno as a service-specific example; other countries and generators may differ.
Copyright ownership and a generator’s contract are different questions
A service may assign or describe rights to an output without establishing that copyright exists in every generated lyric, melody, or recording. Copyright protects eligible human-authored expression; a platform’s terms can separately set out who may use its output and under what conditions.
Keep these questions distinct:
- Does copyright exist? That depends on the applicable law and the human-authored expression in the work.
- What does the contract allocate? The generator’s terms may assign rights it has in its output or place conditions on access and use.
- What can you do with the track? Commercial use, downloading, remixing, or distribution may be subject to service-specific restrictions even if you have some rights.
How U.S. copyright treats AI-generated music
Copyright requires human authorship
The U.S. Copyright Office says an original work must be independently created by a human author with at least a minimal degree of creativity, and fixed in a tangible medium. A recorded song is fixed, but recording alone does not establish human authorship. See the Copyright Office explanation of copyright.
AI assistance does not automatically disqualify a work
The Copyright Office’s January 2025 report says using AI as an aid, or including AI-generated material in a larger human-created work, does not automatically prevent copyright protection. The key issue is which expressive elements came from a human and which were determined by the machine. As Register of Copyrights Shira Perlmutter put it, “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” See the Copyright Office’s AI initiative and its Part 2 report on copyrightability.

There is no fixed number of prompts, edits, or hours that automatically makes a generated song copyrightable. The relevant question is the actual human contribution—not simply whether someone typed a prompt or operated the software.
Lyrics and music can have different authorship outcomes
If you wrote the lyrics yourself, those words may be protected as human-authored text even if the generator produced the music. Likewise, expressive musical material you actually created may be assessed separately from machine-determined elements. A prompt by itself is not, under the U.S. guidance described by Suno, authorship of the resulting song.

What Suno’s terms say—and do not say
Suno’s help page, edited September 4, 2026, distinguishes its account tiers. It says Suno regards songs made on the free Basic plan as owned by Suno, while users may use those songs for non-commercial purposes. It says songs made while subscribed to Pro or Premier are owned by the user. Suno also cautions that its output may not qualify for copyright protection. These are Suno’s statements, not rules for other generators. See Suno’s copyright and ownership guidance.
Suno’s Terms of Service further say that Pro or Premier users receive an assignment of Suno’s rights, title, and interest in Suno-owned output generated from their submissions, subject to the Terms and applicable commercial-use restrictions. The Terms do not warrant that copyright vests in the output. Basic-plan output is restricted to lawful, personal, non-commercial use; commercial exploitation is subject to conditions, including obtaining a permitted download through an approved channel.

Remixes have a separate rule
For the remix feature covered by the Suno Terms, the terms describe a remix as jointly owned in equal shares by the user and remixer to the extent copyright vests, and limit the remix to personal, non-commercial use. This provision applies to that described feature; it should not be assumed to create joint copyright in every kind of remix or generated track.
Before you distribute, monetize, or register a song
- Identify the service, tier, and creation date. Find the terms that applied when the track was generated; platform terms can change.
- Separate your contribution from generated material. Keep track of which lyrics, musical expression, or other elements you created, rather than treating the prompt alone as authorship.
- Check the use conditions. Confirm that the applicable terms permit your intended commercial use, and review any download, credit, remix, or other requirements before distribution or monetization.
- For U.S. registration, claim the human-authored material accurately. Follow the Copyright Office’s current instructions and describe only the material you authored. Suno says users may register lyrics they wrote without assistance; registration of a larger AI-generated output requires significant human contribution, which the Copyright Office determines, and Suno cannot guarantee acceptance. - Keep useful records. Save lyric drafts, recordings, arrangement notes, and project or version history as practical evidence of what you contributed. This is prudent recordkeeping, not a legal threshold.
- Check the law where you are. The U.S. sources here do not establish rules in other countries. Consult the relevant national copyright office; for a commercial release, dispute, or cross-border question, consider advice from a qualified attorney in the relevant jurisdiction.
When registration matters in the United States
In the United States, copyright generally arises automatically when an eligible original work is fixed; registration is not required to have copyright. For a U.S. work, however, registration or refusal is required before filing an infringement lawsuit. The Copyright Office explains these points in its copyright overview.

The Copyright Office’s AI initiative page says it received more than 10,000 comments by December 2023. That figure describes public participation in the initiative, not how often AI-generated songs qualify for copyright. The sources cited here establish no frequency rate or numeric threshold for sufficient human contribution.

This is a U.S.-centered explanation, not a global rule. Other countries may apply different standards, and another generator’s contract may allocate rights differently from Suno’s. The Copyright Office’s Part 2 report addresses copyrightability of generative-AI outputs; its AI initiative page lists Part 3 on AI training as pre-publication and says a final version is forthcoming. Those materials do not resolve every question about training or its relationship to the copyright status of an individual generated song.
