A workplace sick leave policy should tell employees how to report an absence, how leave is reviewed and documented, what happens to benefits, and how a return to work is planned. It should also keep distinct the employer’s paid leave rules, FMLA rights, and any ADA accommodation process. The federal rules are only a baseline: requirements can change with the employee’s work location, employer, and applicable agreements.

What should a workplace sick leave policy include?

A useful policy makes the process clear before an absence occurs. It should identify the policy’s scope and explain how employer-provided leave works alongside statutory leave and accommodation obligations. An employer’s paid sick leave balance is not the same thing as an employee’s possible FMLA entitlement.

Scope and coordination

  • Define which employees the policy covers, what qualifies as sick leave under the employer’s rules, and how an employee requests it.
  • Explain how employer-provided paid leave may coordinate with FMLA leave. FMLA leave may be unpaid or may run at the same time as employer-provided paid leave when the law allows and the requirements are met.
  • Describe how the process connects to disability accommodation, workers’ compensation, and any state or local leave programs without treating them as interchangeable.
  • Identify where employees can find location-specific rules. Paid leave accrual, carryover, permitted uses, payout, and notice requirements can vary by state or locality.

Absence reporting and communication

  • State the reporting channel, who must receive notice, and the expected timing. Explain what an employee should do when advance notice is not possible and how to report a change in expected absence or return date.
  • Explain who will handle leave administration and how that person or team communicates decisions, documentation requests, leave designation, extensions, and return planning.
  • For FMLA leave, distinguish general policy information from the individualized notices required in a particular case. Department of Labor guidance identifies notices about rights and responsibilities, certification, consequences of failing to provide certification, benefits, restoration, and leave designation.
  • Explain whether and how an employee on FMLA leave may be asked for periodic updates about status and intent to return. Under DOL guidance, an unequivocal statement that the employee does not intend to return generally ends the employer’s FMLA obligations to maintain health benefits and restore the employee, subject to applicable requirements. Saying that a return may be impossible while still wanting to return is different.

When does FMLA apply?

FMLA rights depend on both employer coverage and employee eligibility; they are not a universal sick leave entitlement. The U.S. Department of Labor’s March 2025 Fact Sheet #28G identifies employee eligibility criteria that include at least 12 months of employment and 1,250 hours of service in the preceding 12 months, alongside covered-employer requirements. These criteria should not be used as general eligibility rules for an employer’s sick leave bank or another leave program.

For an employee who qualifies and an employer covered by the law, FMLA provides qualifying job-protected leave, continuation of group health benefits on the same terms and conditions as if the employee had continued working, and restoration rights. A policy should make clear that the leave administrator—not an informal attendance or payroll process—handles required notices, certification, designation, and tracking.

What documentation can the employer request?

A policy should distinguish documentation used to evaluate an FMLA leave request from a fitness-for-duty certification requested before return. It should tell employees where to send documents, who may access them, and how the employer handles confidential medical information. Requests should be limited to what applicable law permits.

FMLA certification and fitness for duty

  • The DOL says an employee generally must be given at least 15 calendar days to provide requested FMLA certification, subject to the rules described in Fact Sheet #28G.
  • An employer may require fitness-for-duty certification only where its policy or practice requires similarly situated employees to provide it and the employee has been told of the requirement. The employee must also be told whether the certification must address the job’s essential functions.
  • The certification generally concerns the health condition that caused the FMLA leave. An employer generally may not require a fitness-for-duty certificate after every intermittent absence.
  • If a properly requested certificate is not provided, a return may be delayed when the required notice was given.

Fitness-for-duty certification is not the same as deciding whether an employee needs an ADA accommodation. A doctor’s release does not by itself establish that no workplace adjustment is needed.

Records and privacy

Keep records sufficient to show notices, leave dates and designation, certifications, benefit handling, employee communications, accommodation discussions, and the return decision. Route medical and leave information to authorized personnel and handle it confidentially under applicable law. OSHA injury and illness recordkeeping is a separate matter: OSHA says employers are responsible for recordkeeping decisions and must apply health-care-provider recommendations when determining days away from work or restricted work for recordkeeping purposes.

What happens to benefits and the employee’s job?

During qualifying FMLA leave, group health coverage must continue on the same terms and conditions as if the employee had continued working. Taking FMLA leave cannot cause an employee to lose benefits accrued before leave. For non-health benefits, the DOL says employers generally follow the established policy for comparable leave.

On return from FMLA leave, the employee is generally entitled to the same job or an equivalent position with equivalent benefits, pay, and other terms and conditions. The law does not give an employee greater restoration rights than they would have had if they remained at work. An employer seeking to deny restoration must be able to show the employee would not otherwise have remained employed; exceptions and their application are fact-specific.

How should the return-to-work process work?

The policy should set a clear point of contact and explain when an employee should contact the employer before the expected return date. It should provide a way to report a changed return date or request additional leave, and it should explain who will discuss any work restrictions and next steps. Apply a properly noticed FMLA fitness-for-duty requirement consistently and within its limits.

If the employee can return with restrictions

Handle restrictions separately from the FMLA restoration process. Under the ADA, a qualified employee with a disability may be entitled to reasonable accommodation, depending on the circumstances and whether the accommodation would cause undue hardship. EEOC guidance says leave itself can be an accommodation and the employer may need to continue the interactive process as the return date approaches, when more leave is requested, or when a provider’s note describes restrictions.

The discussion should identify relevant limitations, consider effective accommodations, assess alternatives, and document the decision. Possible options include schedule or duty changes, other adjustments, additional leave, or reassignment to a vacant position where applicable. A blanket requirement that an employee be fully healed or return without restrictions can violate the ADA if the employee can perform the job’s essential functions with reasonable accommodation and no undue hardship applies.

How can a policy protect fairness and compliance?

  • Train managers to route leave requests and medical information through the designated process rather than making informal eligibility or medical judgments.
  • Review attendance rules, leave coding, discipline, and manager communications so they do not penalize employees for exercising protected leave rights. DOL FMLA materials describe protections against interference and retaliation, including a prohibition on counting FMLA leave as a negative factor in employment actions.
  • Keep leave administration, medical confidentiality, accommodation discussions, and any separate safety or injury recordkeeping decisions distinct, while maintaining the records needed for each process.
  • Before issuing or revising a policy, check the law for each employee’s work location and review relevant collective bargaining agreements and sector-specific requirements. Federal FMLA and ADA rules do not resolve state, local, workers’ compensation, wage-replacement, or agreement-specific obligations.
