If your insurer has declared your damaged car a total loss, first get its written valuation and settlement calculation. Check the vehicle details and comparable cars used to set the value, then respond with specific evidence if something is wrong. Before accepting, also confirm whether you can keep the car, when rental coverage ends, and how any loan or GAP coverage will be handled. The rules and options depend on your policy and state.

1. Get the offer and valuation in writing

Ask the adjuster for the total-loss valuation report, the calculation behind the offer, the vehicle information used, and a written explanation of every deduction or adjustment. Keep your policy, claim number, photos, repair estimate, maintenance records, equipment information, offer letters, and a dated log of calls and emails. The National Association of Insurance Commissioners (NAIC) recommends asking questions, keeping notes, and requesting written explanations.

2. Check whether the valuation fits your car and market

Actual cash value generally refers to what the vehicle was worth as a used car immediately before the crash. A published guide such as Kelley Blue Book can be useful evidence, but it does not automatically determine the settlement. Insurers may also consider comparable vehicles in your area, as the NAIC explains in its consumer auto insurance guidance.

Verify your vehicle details

  • Confirm the VIN, model year, trim, mileage, options, and reported condition.
  • Check that the report correctly reflects the vehicle’s history and equipment.
  • Look at every adjustment and deduction, and ask the adjuster to explain any you do not understand.

Review the comparable vehicles

Check whether the listed cars are genuinely comparable in model, trim, mileage, condition, and geographic market. Save dated examples of local listings that better match your vehicle. A single listing or guide value does not by itself establish the amount legally owed; its usefulness depends on the facts, policy, and applicable state law.

3. Respond with specific evidence

If you find an error, write to the adjuster and identify it precisely: for example, a wrong trim, missing option, inaccurate mileage, or a comparison vehicle that is not a close match. Attach relevant records or dated local listings, explain why they matter, and request a revised written valuation. Keep a copy of your message and the insurer’s response.

NAIC says, “You don’t have to accept a payment you don’t feel is fair.” That is a reason to raise a documented disagreement, not a guarantee of a particular settlement amount.

4. Check your policy’s dispute process

Read the policy for an appraisal clause and ask the insurer how it applies to your disagreement. Whether appraisal is available, what it requires, and how it affects the claim depend on the contract and applicable law. Consider the evidence you have, the policy process, timing, potential cost, and any effect on other claim steps before deciding how to proceed. NAIC also advises consumers disputing a vehicle’s value to check their policy for an appraisal clause in its auto-claim guidance.

If the dispute remains unresolved, contact your state insurance department for consumer assistance or instructions on filing a complaint. The department’s process and authority vary by state; the NAIC complaint guide explains how to find the appropriate state regulator. Provide a clear timeline and copies of the valuation, correspondence, and supporting records.

5. Decide whether to transfer or keep the car

Ask for the settlement calculation under both choices: transferring the vehicle to the insurer or retaining it. NAIC notes that the insurer may take title when it pays a claim and is entitled to salvage value; an owner may negotiate to buy the vehicle back for an agreed salvage value. Keeping it can change the net payment.

Before retaining or driving a damaged vehicle, check with your state motor-vehicle agency about title branding, inspections, registration, and whether the vehicle may legally be driven. These requirements are state-specific. If a lender has an interest in the car, ask how that affects the transfer or retention process.

6. Confirm rental coverage, loan payoff, and GAP

Rental car

Read the rental provision in your policy and ask the insurer to confirm the covered rental end date in writing. NAIC notes that many insurers stop paying for a rental once they have offered a settlement, but the policy and local rules—not a universal deadline—control your situation.

Loan and GAP coverage

Ask your lender for the current payoff amount and confirm how it will receive its share of the settlement. If the claim payment is less than the loan balance, you may still owe the difference. GAP coverage is separate from the auto claim payment: ask your GAP provider whether your contract covers some or all of the shortfall and what documents it requires. The NAIC’s coverage guidance discusses GAP and its role when a loan balance exceeds a vehicle’s value.

What to have on hand before you decide

  • The written valuation, settlement breakdown, policy, and claim correspondence.
  • Accurate vehicle details and evidence supporting any corrections or better local comparisons.
  • Your policy’s appraisal language and the state insurance department’s complaint instructions, if needed.
  • Settlement figures for both transferring and retaining the car, plus relevant title and inspection requirements.
  • The rental end date, lender payoff, and GAP provider’s claim requirements.
