Start with the state utility commission’s live docket—not headlines or the utility’s summary. Find the filing, confirm its deadline and hearing dates, then examine whether the utility is asking to recover new costs, change how approved costs are divided among customers, or both. Submit a specific, evidence-based comment through the commission’s official process.
1. Find the live rate-case docket and its deadlines
Search your state utility commission’s website for the utility’s name, “rate case,” “rate increase,” or the docket number printed on your bill insert or notice. The docket is the authoritative place to check what is proposed and how the public may participate.
- Confirm the filing title and the utility involved.
- Check the case’s current stage, public-hearing dates, written-comment deadline, and submission instructions.
- Use the docket’s stated filing format and portal; deadlines and procedures differ by state and case.
- Save the docket page and a copy or confirmation of anything you submit.
A utility’s requested increase is a proposal, not a final bill change. The regulator reviews the record and may approve, modify, or reject the requested costs and rates.
2. Work out what the utility is actually asking to change
Separate two questions: what costs the utility wants to recover, and how approved costs would be collected from different customer groups. Disagreement about a new power plant or grid upgrade is not the same as disagreement about which customers should pay for it.

Cost recovery: are the requested expenses justified?
Look for proposed generation, transmission, and local distribution spending; construction timing; and the utility’s explanation of why the investment is needed. Ask whether the evidence supports the cost and schedule, and whether the project is sized for a forecast of data-center demand that may change.
Rate design: who would pay approved costs?
Check whether the filing proposes a new or revised rate for large customers, and how the utility assigns costs to that customer class versus households and other businesses. California’s general rate case process illustrates the distinction: the commission first determines the utility’s justified revenue requirement, then considers how to allocate that approved amount among customer classes. The allocation phase does not approve additional costs. This is a California example, not a procedure that applies in every state.
3. Examine the assumptions behind large-load costs
The U.S. Department of Energy identifies fair cost allocation, stranded-asset risk, and resource adequacy as important rate-design concerns for data centers and other large electricity users. In the filing, look for evidence about:

- Load forecasts and timing: How much power does the utility expect the facility to need, and when will demand ramp up?
- Utilization: Does the cost plan assume the facility will use all the power it requests or reserves?
- System investments: Which generation, transmission, or local distribution upgrades are attributed to the large customer, and which costs are spread among other customers?
- Commitments and protections: Are there minimum payments, deposits, collateral, termination charges, or other safeguards if the project is delayed, reduced, or cancelled?
- Reliability: Do the proposal’s ramp schedule, curtailment terms, backup power plans, or resource-adequacy provisions address potential effects on service?
- Transparency: Can customers and case participants inspect the forecasts and cost evidence needed to assess the proposal?
Some information may not be public. The Minnesota Public Utilities Commission notes that customer-demand, infrastructure-cost, schedule, and rate details may be treated as trade secrets. If key evidence is withheld, you can ask the commission to explain how the proposal can be evaluated and how other customers are protected using the available record.

If the docket contains more than one tariff, settlement, or plan, compare the actual terms rather than relying on labels such as “large-load protection.” The following are questions to apply to the filed alternatives, not provisions that every proposal necessarily contains.

| Public access to evidence | Can customers and case participants review the assumptions and cost evidence supporting the proposal? |
5. Write a focused public comment
A useful comment identifies the case and the decision you want the commission to make, then points to a concrete part of the filing or a specific unanswered question. Avoid claiming that data centers caused a particular increase in your household bill unless the docket evidence supports that conclusion. The reviewed official sources do not establish a reliable nationwide percentage of household bill increases caused by data-center demand.

You can use this outline and adapt it to the commission’s rules:
- Identify the case: Give the utility name and docket number.
- State your concern: For example, explain that you want the commission to examine whether large customers pay for incremental costs caused by their demand.
- Point to the record: Name the relevant filing, tariff, forecast, cost estimate, or missing information. Be precise about what the filing says or does not make clear.
- Ask for a specific action: Request that the commission require better evidence, clarify who bears a cost, or consider a minimum-payment or cancellation-risk protection if supported by the case.
- Submit through the official route: Follow the docket’s instructions, meet its deadline, and keep a copy or confirmation.
For example, rather than asserting that “the data center is raising my bill,” you could ask the commission to explain whether the proposed tariff recovers the utility’s incremental costs from the large customer and who would pay if forecast demand fails to materialize. Tailor the question to what the filing actually contains.
6. Know which forum and participation route fit your concern
For a household rate increase by a regulated utility, begin with the state commission’s retail-rate docket. Federal Energy Regulatory Commission actions can concern interstate transmission and large-load interconnection, but FERC’s 2026 fact sheet says those actions do not displace state commissions’ authority over retail rates, terms, and conditions. Do not send every retail-rate concern to FERC: the right forum depends on what the utility filed.

FERC’s RM26-4-000 docket concerns a federal process for interstate transmission interconnection and accepts comments through eComment, eFiling, or paper filing; its docket page asks commenters to reference RM26-4-000. FERC describes large loads generally as demand greater than 20 megawatts. That federal process is relevant only if the issue you want to address is within that docket’s scope.
An ordinary public comment is not necessarily the same as formally becoming a party. In California, members of the public may submit comments without party status; a person seeking to participate as an intervenor must follow the formal process. In an Ohio case, the Office of the Ohio Consumers’ Counsel describes hearing testimony entering the case record and provides a docket comment route. Follow the current instructions for your case rather than assuming another state’s process applies.

Check whether your state consumer counsel, a citizens’ utility board, a community group, or a legal aid provider is active in the case. These organizations may help you understand the record or identify participation options. Availability and eligibility vary, and an organization’s involvement does not mean it represents you. Formal intervention can involve procedural obligations beyond submitting a public comment.

What state examples can—and cannot—tell you
Minnesota
The Minnesota Public Utilities Commission describes state requirements for large customers to bear necessary electrical upgrade costs and for utilities to propose special rates for large customers. Minnesota’s rules illustrate one state’s approach; they are not nationwide requirements.
Ohio
The Office of the Ohio Consumers’ Counsel reports that a settlement adopted by the Public Utilities Commission of Ohio on July 9, 2025, required new large data centers to pay at least 85% of the electricity capacity they contract for, for up to 12 years, even if they use less. OCC also reported an industry appeal in November 2025. Because that reported appeal may affect the rule’s status, check the current commission and court records before treating the settlement terms as operative today.
California
California’s general rate case process is useful for understanding the distinction between establishing justified costs and allocating approved revenue among customer classes. It should not be treated as the national model for rate cases.
