If you receive notice that a healthcare organization exposed your information, verify the notice through a contact method you find independently, ask exactly what data was involved, and watch for signs that someone is using it. If you suspect medical identity theft, request and review relevant records, correct errors in writing, check your credit reports, and use the appropriate government recovery or complaint channel. The steps below reflect U.S. federal guidance; the right response depends on the information exposed and how it may have been used.
Verify the breach notice and find out what was exposed
Do not rely only on a phone number, link, or reply address in an unexpected email, text, or letter. Contact the provider, health plan, or other organization using a phone number or website you obtain independently from a trusted source. Ask:
- Whether the organization sent the notice and whether your information was involved.
- What categories of information were exposed, such as contact details, account identifiers, insurance information, or medical records.
- The relevant dates and whether the organization recommends specific actions or offers assistance.
Keep the notice and a record of your conversations, including dates, names, and any promised follow-up. You can also ask a provider or health plan for its Notice of Privacy Practices, which describes how it handles information and your rights; individuals may request a copy at any time. Look for signs that someone used your medical information
Medical identity theft occurs when someone uses another person’s information—such as a name, Social Security number, health insurance account number, or Medicare number—to obtain care, prescriptions, medical devices, or submit insurance claims. It can affect bills, insurance benefits, and the accuracy of medical records. The Federal Trade Commission (FTC) lists these warning signs:

A warning sign is a reason to investigate, not proof by itself that fraud occurred. The FTC explains what to look for and how to respond in What To Know About Medical Identity Theft.
Request records and correct anything you did not receive
If a bill, claim, or other warning suggests someone used your information, contact each relevant doctor, clinic, hospital, pharmacy, laboratory, and insurer. Request copies of the records and claims connected to the suspected use, then compare them with the care you actually received.

- Identify the error. Note the specific service, prescription, claim, or other entry you do not recognize.
- Write to the provider. Explain what is wrong, include a copy of the relevant record, and keep the original. Use a delivery method that lets you confirm receipt.
- Track the response. The FTC says a provider must respond to a request to correct medical records within 30 days and notify other providers that may have the same error.
If a provider refuses to give you records because it believes doing so would protect a thief’s privacy, the FTC advises appealing through the provider’s privacy contact, patient representative, or ombudsman. See the FTC’s guidance, What To Do if Someone Is Using Your Medical Information.
Check your credit reports and dispute unfamiliar medical collections
Review your credit reports for medical collections you do not recognize. The FTC identifies AnnualCreditReport.com and 1-877-322-8228 as ways to obtain reports. If you find a medical billing error, follow IdentityTheft.gov’s “What To Do Next” steps to report it to all three credit bureaus. A collection entry is a signal to investigate and dispute, not by itself confirmation of who created the debt.

Choose the right recovery or complaint channel
If someone used your information to get care or prescriptions
Use IdentityTheft.gov to report suspected identity theft and get a recovery plan based on your situation. Spanish-language guidance is available at RobodeIdentidad.gov.
If you suspect a HIPAA violation
You can submit a complaint to the U.S. Department of Health and Human Services Office for Civil Rights (HHS OCR) through its health information privacy, security, and breach notification complaint process. OCR investigates reported breaches affecting 500 or more individuals; smaller breaches may also be investigated depending on resources and enforcement priorities. A breach appearing in an OCR portal or being investigated does not establish whether your own information was involved.

If you are a consumer, do not use the organization’s breach-reporting form as your recovery plan
The FTC’s Health Breach Notification Rule form is for organizations reporting covered personal health record breaches. It is not the consumer identity-theft recovery tool; use IdentityTheft.gov for personal recovery steps.

For covered entities handling unsecured protected health information, HHS’s 2026 report on calendar year 2024 describes the individual notice requirement as without unreasonable delay and no later than 60 calendar days after discovery. Written notice is generally sent by first-class mail to the individual’s last known address, or by email if the individual agreed to electronic notice. HIPAA does not cover every health-related app or company. Some personal health record businesses outside HIPAA may be covered by the FTC’s Health Breach Notification Rule. Which rules apply depends on the organization and the service involved.
