The “$16 million” headline refers to multistate settlements announced in November 2022—not a new settlement. Across 40 states, the package addressed two separate Experian data incidents, from 2012 and 2015, plus T-Mobile’s vendor oversight related to the 2015 breach. Eligible people affected by the 2015 incident were offered five years of free credit monitoring, but the 2022 announcement does not establish that enrollment is still open.

What did the $16 million settlement cover?

Ohio reported a combined total of $16.1 million across 40 states. The total consists of three distinct resolutions:

Ohio’s November 7, 2022 announcement described the Experian resolutions as $13.67 million combined, alongside T-Mobile’s $2.43 million resolution. State figures such as Texas’s approximately $1.63 million and Minnesota’s $280,685.67 are those states’ reported shares, not competing estimates of the multistate total. What happened in the 2015 Experian breach?

In September 2015, Experian disclosed unauthorized access to part of its network that stored personal information for its client T-Mobile. The information concerned people who applied for T-Mobile postpaid service or device financing between September 2013 and September 2015. Ohio said more than 15 million people who submitted credit applications with T-Mobile were affected.

The exposed information listed by Ohio and Minnesota included names, addresses, dates of birth, Social Security numbers, and identification numbers such as driver’s license and passport numbers. Minnesota said the breach did not compromise Experian’s consumer credit database or T-Mobile’s own systems. The compromised location was Experian’s network holding information for T-Mobile applicants, not either of those systems.

How was the 2012 incident different?

The 2012 matter involved an identity thief posing as a private investigator who gained access to sensitive personal information in Experian Data Corp.’s commercial databases. It was a separate incident from the 2015 breach involving T-Mobile applicants. Its resolution included requirements for third-party vetting and oversight, incident investigation and reporting to attorneys general, and a “Red Flags” program.

What changes did the settlements require?

Experian’s security and governance measures

For the 2015 incident, Experian agreed to strengthen its information-security program and governance. The measures included executive reporting and staff training, due diligence when acquiring businesses, and data minimization and disposal practices. Technical and operational controls covered encryption, network segmentation, patching, intrusion detection, firewalls, access controls, logging and monitoring, penetration testing, and risk assessments. The resolution also barred Experian from misrepresenting its privacy and security protections to clients.

T-Mobile’s vendor oversight

T-Mobile agreed to improve how it manages vendors and sub-vendors. Its commitments included keeping an inventory of vendors with criticality ratings, setting security requirements, assessing and monitoring vendors, and using remedies for noncompliance—including ending a contract.

Was this the same as T-Mobile’s 2021 breach?

No. This settlement concerned the 2015 incident at Experian involving data held for T-Mobile applicants. Ohio and Minnesota expressly said T-Mobile’s related settlement was unrelated to the separate T-Mobile breach announced in August 2021.

Can affected consumers still enroll in free credit monitoring?

The 2015 settlement provided eligible affected consumers with five years of free credit monitoring and two free credit-report copies per year during that period. Minnesota said people who had been class members in the 2019 class action could enroll, and that the enrollment window would remain open for six months when the settlement was announced in 2022. That historical announcement does not show that enrollment remains open now. Check the current official settlement information for eligibility and enrollment status before relying on the benefit.
