Activate the school’s incident-response plan, report the suspected attack internally, contain further access, and involve the data protection officer (DPO) and senior leadership immediately. The school must then establish which staff records may be affected, assess the risk to those people, preserve an accurate timeline, and decide whether regulators and affected individuals must be notified under the law that applies in its jurisdiction.

A cyberattack does not automatically prove that personal data was stolen. It does require a disciplined investigation. Keep technical recovery, legal decisions, safeguarding, employment issues and communications coordinated through named roles rather than improvised by individual staff members.

1. Raise the alarm and activate the response plan

Anyone who notices suspicious encryption, a compromised account, unusual forwarding rules, missing files, a threatening ransom note or another sign of attack should use the school’s incident-reporting route at once. Do not wait for certainty or attempt an unsanctioned fix that could destroy evidence.

In UK schools, the Department for Education (DfE) cyber-security core standard directs staff to report incidents to IT support and the senior-leadership digital lead. Those leaders activate the incident-response plan, contain risk, notify relevant people, capture information, investigate and report to governors or trustees. Near misses should be recorded as well as confirmed breaches.

The US Department of Education’s Privacy Technical Assistance Center similarly says that, if an education agency, district or school is the victim of ransomware, preparation and a prompt response reduce the impact and duration of the incident. That is operational guidance, not a substitute for the law in the school’s jurisdiction.

Actions for the first hour

  1. Use the emergency reporting channel. Tell IT support, the incident lead and senior leadership what was observed, when and on which device or account.
  2. Protect accounts and systems under IT direction. IT may isolate devices, disable compromised credentials, block malicious connections or suspend affected services. Staff should not independently wipe machines, pay a ransom or reconnect isolated equipment.
  3. Preserve evidence. Keep ransom notes, alert messages, suspicious emails, screenshots, log extracts and relevant device details. Record times in a consistent time zone.
  4. Open the incident log. Assign an incident number, owner and deputy. Note each decision, action, person responsible and time.
  5. Bring in the DPO or privacy officer. The technical event and the privacy assessment must proceed together, even while facts are incomplete.

2. Establish whether staff personal data is involved

A cyberattack and a personal-data breach are related findings, not interchangeable labels. UK DfE guidance defines a personal-data breach as personal data being lost, stolen, destroyed, changed without permission or accessed without permission. Encryption, deletion, accidental disclosure and unauthorised viewing can all be relevant; a stolen device is not required.

Work with IT and the DPO to identify what happened and what remains uncertain. Check systems, accounts, cloud services, email, file shares, HR platforms, payroll, backups and paper-to-digital workflows that may have been reachable from the compromised environment.

Catalogue the information and people affected

List each data set, its location, the relevant dates and the categories of people involved. Basic staff details such as names and work email addresses are personal data. The investigation may also find employment records, identity documents, home addresses, absence or disciplinary information, payroll data, bank details, authentication information or special-category information such as health data.

Record whether data was merely inaccessible, viewed, copied, altered, deleted, encrypted or transferred outside the school. Do not describe information as “safe” until the investigation supports that conclusion. Conversely, do not state that data was exfiltrated solely because ransomware was deployed; that remains a question for evidence.

Separate facts, hypotheses and unknowns

  • Observed fact: what an alert, log, person or system directly shows.
  • Working hypothesis: a plausible explanation still being tested.
  • Unknown: a question requiring further evidence, such as whether files were downloaded.

This distinction prevents premature statements to staff, regulators or the media and gives investigators a clear list of questions to resolve.

3. Keep a secure, contemporaneous incident record

The record should be accurate, timely, secure and consistent. UK DfE incident-recordkeeping guidance expects schools to retain a factual account under their applicable records-retention rules. A breach record should include the affected personal data, the DPO’s assessment, decisions about notification and any regulator notification.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Minimum log fields

  • Incident number, date and time of discovery, and the time zone used.
  • Reporter, incident lead, deputy and every decision-maker.
  • Systems, accounts, devices, suppliers and physical sites involved.
  • Data categories, estimated record counts and affected groups, with confidence levels.
  • Containment, forensic, recovery and communication actions, each with an owner and timestamp.
  • Evidence preserved, evidence still requested and assumptions that may change.
  • Risk assessment, DPO advice, regulator decisions and reasons for those decisions.
  • Service disruption, backup status, restoration tests and known data-loss periods.

Restrict the log to people who need it, protect it from alteration and back it up in a way that will remain available if the main network is compromised. Do not put unnecessary sensitive staff details into broad email chains.

4. Assess risk and decide on notification

Notification depends on the likely harm to the people affected and on the jurisdiction governing the school. Consider identity theft, financial fraud, account takeover, discrimination, distress, physical or safeguarding risks, exposure of confidential employment matters and the scale and sensitivity of the records. Consider the effectiveness of any encryption or other controls, but do not assume a control worked without evidence.

UK schools: the ICO 72-hour rule is risk-based

In the UK, if the school determines that a personal-data breach is likely to create a risk to data subjects, UK DfE guidance says to notify the Information Commissioner’s Office (ICO) within 72 hours of becoming aware of the breach. If the risk is high, the school should also inform affected people so they can take protective steps. The DPO should advise on the assessment and the regulator contact; the school remains responsible for the decision and record.

In the UK, the 72-hour instruction is not a rule that every cyber incident must be reported. A school should document why it concluded that notification was or was not required. If impact or notification is unclear, UK DfE advises contacting the ICO helpline.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Outside the UK

There is no single worldwide deadline or threshold. The school’s DPO, privacy officer or legal adviser should identify the applicable national, state, provincial, sectoral and contractual rules and the correct supervisory authority. Confirm whether employee records have special requirements and whether affected individuals, insurers, law enforcement, unions or contractual partners must be contacted. Do not import the UK 72-hour deadline into another country.

Question UK guidance example Other jurisdictions
Who decides? The school, advised by its DPO and leadership. School decision-makers under local privacy law and policy.
When is a regulator considered? When the breach is likely to create a risk to data subjects. Thresholds vary; verify the applicable authority’s rule.
Deadline Notify the ICO within 72 hours of awareness when the risk test is met. Not established by the cited sources; may differ by law and sector.
Notice to affected people Inform people where the risk is high so they can take protective steps. Requirements, content and timing vary.

5. Assign responsibilities clearly

Every school has a different structure. The response plan should name deputies and define who can make decisions when the headteacher, DPO or IT lead is unavailable. Outsourcing technical work does not outsource the school’s governance, compliance or stakeholder-communication responsibilities.

Role Core responsibilities during the incident
Headteacher and senior leadership Activate and oversee the plan, approve major decisions, involve the DPO and recovery team, maintain the decision log and escalate to governors or trustees.
IT support or provider Investigate and contain the compromise, identify affected systems, protect evidence, check backups and estimate disruption and restoration timing.
DPO or privacy officer Determine whether personal data is involved, assess risk, advise on regulator and individual notification, and coordinate with the regulator when appropriate.
Business manager, HR and communications Coordinate operational updates, consider payroll and employment impacts, maintain approved staff messaging and manage provider or insurer contacts.
Safeguarding lead Assess whether exposed information creates a safeguarding concern for staff, pupils or families and follow the school’s safeguarding process.
Governors or trustees Receive escalation, challenge the response constructively and support policy, resource and control improvements.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

6. Communicate accurately and calmly

Use the communication plan and authorised spokespeople. Coordinate wording among leadership, HR, the DPO, IT, safeguarding and legal advisers. Give staff practical instructions, such as where to obtain verified updates, whether to reset a password, how to report suspicious follow-up messages and how payroll or other services are being handled.

Say what is known, what is still being investigated, what action the school has taken and when the next update is expected. Avoid naming an attacker or claiming that records were accessed unless evidence supports it. Do not speculate about individual staff members, promise that no harm is possible or minimise the event. The UK National Cyber Security Centre’s chief-executive guidance warns against misrepresenting or downplaying a cyber incident.

7. Contact providers, insurers and authorities

Follow the school’s incident plan and local reporting process. Tell managed-service providers, cloud providers, payroll partners and other affected suppliers what they need to investigate and preserve. A supplier’s notice to the school does not complete the school’s own privacy assessment or legal duties.

Check cyber-insurance wording before making commitments. Policies may require use of approved forensic, legal or communications providers and may impose notification conditions. In the UK, DfE ransomware guidance also refers schools to relevant authorities, affected service providers and private insurers where cyber cover applies. The Department for Education’s RPA emergency assistance is for eligible RPA members; confirm current contacts and eligibility directly.

Report criminal activity to the appropriate law-enforcement body where advised by the plan or legal counsel. Preserve evidence and avoid negotiating with an attacker without qualified advice. Payment decisions involve legal, sanctions, insurance, recovery and ethical issues and should not be improvised by school staff.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Recover systems without reintroducing the threat

Recovery is a controlled technical process, not simply switching systems back on. IT should identify a clean restoration point, verify that backups completed successfully and are not themselves encrypted or compromised, and test restored systems before returning them to service.

  1. Maintain isolation while the attack path and compromised credentials are investigated.
  2. Prioritise services by safeguarding, payroll, teaching, communications and legal needs.
  3. Reset or revoke credentials and tokens according to the forensic plan, including supplier and administrator accounts.
  4. Validate backups and restoration procedures in a controlled environment.
  5. Restore, monitor and document each service, including the period of possible data loss.
  6. Tell decision-makers what remains unavailable, what data may be missing and what workarounds are approved.

Do not delete logs or rebuild systems before the response team has preserved the evidence needed to determine scope and notification obligations.

9. Review causes and complete corrective action

After containment and recovery, review what happened, how the attacker gained access, why controls did or did not work and how decisions were made. Include near misses and supplier performance, not only confirmed data loss.

Turn lessons into owned actions

  • Assign each control change to a named owner with a due date.
  • Prioritise multi-factor authentication, privileged-access control, patching, network segmentation, secure configuration, phishing resilience and tested offline or otherwise protected backups where the assessment supports them.
  • Update the incident plan, contact lists, escalation thresholds, supplier clauses and staff reporting instructions.
  • Exercise the revised plan with leadership, IT, HR, communications, safeguarding and governors or trustees.
  • Retain the breach decision, evidence and corrective-action record under the school’s retention rules.

The objective is not merely to close the ticket. It is to show what the school knew, when it knew it, why it chose each action and how the resulting risk has been reduced.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Practical decision checklist

  • Has the suspected incident been reported to the designated IT and senior-leadership contacts?
  • Is the response plan active, with an incident lead, deputy and secure log?
  • Are affected systems isolated under qualified IT direction?
  • Has the school established whether personal data may be involved and whose records are at issue?
  • Has the DPO or privacy officer documented the risk assessment?
  • In the UK: has the school checked whether the ICO 72-hour, risk-based notification rule applies?
  • For other locations, has the school verified the relevant regulator, threshold and deadline?
  • Are communications factual, authorised and consistent across staff and external audiences?
  • Have providers, insurers and relevant authorities been contacted under the plan?
  • Have backups been verified and restoration risks documented?
  • Are lessons, owners and deadlines recorded after recovery?
