The Chief Justice of India (CJI) addresses urgent legal-system concerns primarily by managing how the Supreme Court responds: deciding which bench should hear a matter, directing its listing through the Court’s established process, and participating as a judge when sitting on that bench. The CJI can help an urgent case reach an appropriate bench quickly, but does not personally replace the Supreme Court, Parliament, the executive or the police.
That distinction is essential. Court administration determines access, timing and bench composition; the constituted bench decides the legal dispute and grants relief within its jurisdiction.
What the CJI’s role covers
The CJI is the head of the Supreme Court of India and combines two functions that are often confused. First, the office has an institutional and administrative responsibility for organizing the Court’s work. Second, the CJI is a judge and decides cases when assigned to a bench. An urgent concern can therefore involve two separate questions: how the matter gets before a bench, and what that bench may lawfully order after hearing it.

The Supreme Court has described the CJI’s roster function as a constitutional convention supported by judicial discipline. In Campaign for Judicial Accountability and Reforms v Union of India (judgment dated 6 July 2018), the Court stated: “Once the Chief Justice is stated to be the Master of the Roster, he alone has the prerogative to constitute Benches.” Read the Supreme Court judgment.

“Master of the Roster” is therefore a precise description, not a title granting unlimited personal control. It concerns constituting benches and directing the assignment or listing of matters. It does not mean that the CJI alone makes every rule of the Court, decides every case or commands government departments.
Three stages of an urgent Supreme Court matter
An urgent legal concern normally moves through three institutional stages. Keeping them separate prevents unrealistic expectations about what an application to the Court or a request for priority can achieve.
1. Bringing a matter under an available legal procedure
A person, organization or government body must invoke a procedure and jurisdiction that the Supreme Court can use. The correct vehicle depends on the dispute, the constitutional or statutory issue, and whether another court or authority must be approached first. The CJI cannot create jurisdiction merely because an issue is politically important or urgent.

The filing must identify the parties, legal basis, material facts, documents and relief sought. A request for priority should explain the concrete harm that delay may cause and why ordinary scheduling would not protect the applicant. Urgency is argued within a proceeding; it is not established simply by addressing a personal letter to the CJI.
2. Registry processing, listing and bench constitution
After filing, the Supreme Court Registry processes the matter under the applicable rules and administrative directions. The Court’s listing system determines when the case is placed before judges. Where a matter requires a specially constituted bench, the CJI’s roster responsibility becomes relevant.
An official record in Tej Prakash Pathak and Others v Rajasthan High Court and Others shows the Court directing the Registry to place matters before the CJI for constitution of an appropriate bench at the earliest, while noting the urgency and the time needed for hearing. This demonstrates a route by which urgency can influence bench constitution; it is not a promise that every urgent request receives immediate or same-day listing.

3. Judicial hearing and orders by the constituted bench
Once a bench is constituted and the matter is listed, the judges on that bench—not the CJI acting alone—consider the pleadings, evidence and law. Depending on the case, the bench may issue notice, call for government records, grant or refuse interim protection, interpret legislation, test executive action against constitutional standards, or issue final directions. The order must remain within the Court’s jurisdiction and procedural rules.
The CJI may be a member of the bench, but the decision is a judicial act of that bench. Bench composition and case listing are administrative steps that make adjudication possible; they do not predetermine the result.
What “Master of the Roster” means—and what it does not
The 2018 judgment also drew a boundary around Article 145 of the Constitution, which concerns the Supreme Court’s rule-making power. The Court explained: “The power to frame Rules under Article 145 is, therefore, conferred upon the entire Court, which power includes power to frame the Roster and direct hearing/ listing of matters.” The full decision provides the surrounding context.

These two statements operate together. The CJI has the recognized prerogative to constitute benches as Master of the Roster, while the Supreme Court as an institution holds the Article 145 rule-making authority. The distinction protects both efficient administration and the collective character of the Court’s procedural framework.

Judicial responses to serious public emergencies
When an urgent concern is already before it, the Supreme Court can use ordinary judicial powers in an intensive way. It may require affidavits and status reports, ask governments to disclose what they have done, set deadlines, protect vulnerable people, and monitor compliance through subsequent hearings. Those measures remain tied to a pending case and to legal standards such as constitutional rights, statutory duties and the separation of powers.

In proceedings concerning Manipur, the Court took up the situation, required information from the government and directed remedial, rehabilitative and preventive steps. The official record shows how judicial scrutiny can address alleged failures affecting rights and public safety while using orders, reporting and follow-up hearings rather than direct administration of the state. The same record emphasizes that law and order and state security are essentially matters for the executive. The Court can decide whether government action or inaction violates legal obligations and can direct lawful remedial measures, but it is not the police command, disaster-management department or civil-service administrator.

- No unilateral replacement of the Court: The CJI cannot personally decide an issue that has not been placed before a competent bench or issue an order in the name of the entire Court without judicial process.
- No general executive command: The office does not run ministries, direct police operations or manage public services. Government authorities remain responsible for administration, subject to the Constitution and judicial review.
- No guaranteed emergency listing: A claim that a matter is urgent does not automatically produce a same-day hearing. Registry requirements, jurisdiction, existing schedules, the need for a properly constituted bench and the time required for submissions all matter.
- No bypass of procedure by correspondence: A direct representation to the CJI may not substitute for filing the correct case, complying with procedural requirements or making an urgency request through the recognized channel.
- No control over every Court rule: Article 145 authority belongs to the Supreme Court as a whole, as the 2018 judgment expressly explains.
How an applicant should present a genuinely urgent concern
The exact filing instructions can change, so applicants should consult the current Supreme Court Rules, Registry notices and official filing guidance before acting. The following checklist describes the substance an urgency request ordinarily needs without promising a particular listing outcome.
- Identify the legal route and jurisdiction. Explain why the Supreme Court, rather than another forum or authority, can grant the requested relief.
- State the immediate harm. Give dates, impending actions, threatened rights or irreversible consequences. General assertions that an issue is important are weaker than specific evidence of time-sensitive harm.
- Ask for defined relief. Separate interim protection sought before a full hearing from the final remedy. The bench must be able to understand exactly what order is requested.
- Attach the essential record. Include the decisions, notices, orders, correspondence and other documents necessary to verify the urgency. Explain any unavoidable omission.
- Follow Registry requirements. Use the prescribed format, authorization, fees, service and filing method in force when the matter is lodged. Defects can delay consideration even where the underlying issue is serious.
- Make the priority request through the case process. The urgency application or oral request should be connected to the filed matter and supported by counsel’s explanation; it should not rely on an informal appeal to the CJI.
- Prepare for a preliminary hearing. The first listing may address maintainability, notice, jurisdiction or interim protection rather than decide the entire dispute. Bring a concise chronology and the narrowest order needed to prevent immediate harm.
Because current administrative directions are not permanent, a litigant should verify the latest instructions directly with the Supreme Court Registry or a qualified advocate. No general article can guarantee how a particular filing will be listed.

Why these boundaries matter during urgent crises
Separating roster administration, adjudication and executive implementation helps an urgent response remain both fast and lawful. The CJI’s ability to constitute an appropriate bench can prevent a time-sensitive matter from being lost in ordinary scheduling. Collective adjudication then supplies an independent legal assessment, while government agencies carry out orders and continue the functions assigned to them by law.
This structure also makes responsibility traceable. The Registry records how a matter is filed and listed; the bench gives reasons for judicial orders; and the executive must report or implement within the scope of those orders. If an order is disputed, parties use review, appeal or other remedies provided by law rather than treating the CJI’s administrative office as an alternative executive channel.
Bottom line
The CJI’s distinctive contribution to an urgent legal-system concern is organizational access to the Supreme Court: constituting the appropriate bench and directing listing through established procedures. The bench—not the CJI alone—decides the legal issue and grants relief. Courts can demand information and order remedies, as the Manipur proceedings illustrate, but law enforcement and public administration remain executive responsibilities. Anyone seeking urgent intervention should therefore combine a legally maintainable filing, a precise evidence-backed explanation of harm and compliance with the Registry’s current instructions.
