What the CLARITY Act would do
The Digital Asset Market Clarity Act of 2025, or CLARITY Act, is a proposal to establish rules for U.S. digital-asset markets. In practical terms, the proposal concerns three connected questions: how tokens and related activity are categorized, what registration and compliance duties trading firms face, and how oversight is divided between the Securities and Exchange Commission and the Commodity Futures Trading Commission. Those are proposed arrangements, not rules currently established by this bill.
Where the bill stood
Congress considered H.R. 3633 in House proceedings in July 2025, according to the Congressional Record. That records House activity; it does not show that the bill became law or received Senate approval.

Chan-Wei’s October 3, 2026 column says the Senate failed to advance the measure and that there was no practical path to revive it before the end of that year. The official House sources cited above do not verify the Senate event or its procedural details, so that account should be understood as the columnist’s description rather than an independently confirmed legislative record.
Why Chan-Wei says it stalled
Chan-Wei attributes the setback to ethics concerns. His column frames the dispute as a tension between the desire for predictable market rules and questions about conflicts of interest and public trust. The column also says senators Cynthia Lummis and Thom Tillis, whom it describes as departing senators, had played important roles in the effort. Chan-Wei argues that their departure makes a near-term revival less plausible; that is his assessment, not a confirmed account of what a future Congress will do.
Why clear rules matter—and what remains uncertain
Chan-Wei argues that regulatory uncertainty can discourage institutional investment and weaken public confidence. He also presents a clearer framework as a potential support for financial inclusion and lower cross-border payment costs. The bill’s scope points to the policy choices at stake: which regulator oversees which assets and firms, what firms must do to register and comply, and how lawmakers address ethics and public trust alongside market structure. The committee report substantiates the first two as elements of the proposal; the ethics concern is part of Chan-Wei’s account of the controversy.

He says previous attempts had repeatedly stalled and predicts the next Congress will have to restart the work. That forecast is not a confirmed future event.

The underlying policy problem remains distinct from the fate of this particular bill: lawmakers still have to decide how U.S. securities and commodities rules should apply to digital assets and market participants. The CLARITY Act proposed one approach, but House consideration and the columnist’s account of a Senate setback do not establish that its framework will be enacted.
