A mortgage lender in Poland may require insurance related to the mortgage and may require the borrower to assign claims under that policy to the lender. The law does not set one standard list of covered risks for every bank. Before you buy or renew a policy, get the lender’s minimum coverage requirements in writing; you can choose an insurer whose policy meets them.

What home insurance does a mortgage lender require in Poland?

Article 9(2) of Poland’s Mortgage Credit Act allows a lender to require the borrower to conclude or hold an insurance contract related to the mortgage, or to assign claims under that insurance contract to the lender. The provision does not establish a universal list of insured risks or a single insured amount. The named lender’s written criteria and your mortgage agreement determine what it will accept. Fire and other accidental damage to mortgaged property are examples of cover used in lending practice, not a nationwide rule. PKO Bank Hipoteczny’s 2024 prospectus describes such insurance and assignment of the borrower’s claims to the bank; it does not establish what every Polish lender requires. Can I choose my own insurer for a Polish mortgage?

Yes. The lender must inform you that you may choose an offer from any insurer, provided its policy meets the lender’s minimum accepted scope. This does not mean the bank has to accept every policy you submit: the coverage and policy wording still need to satisfy its criteria. Ask whether the lender requires particular assignment wording or a specific form.

What must the lender tell me before I sign?

Under Article 9(2), the lender must disclose the required policy conditions before the mortgage agreement is signed. Article 29(1)(9) requires the agreement to specify the minimum insurance scope when insurance is required. Article 29(1)(4) also requires the agreement to state rules and costs for establishing, changing or ending security and insurance, including the cost of credit repayment insurance. When a lender offers a bundle of financial products or services with a mortgage, the law requires it to tell the consumer that the mortgage is also available without the additional products or services. The rules on bundled products are distinct from the specific provision allowing qualifying mortgage-related insurance. UOKiK explains the consumer context in its guidance on tied and bundled sales. What to confirm with the bank before buying or renewing cover

Ask the lender for written answers to these points. The law does not supply one national checklist, so confirm the requirements for your particular loan and property.

  • Property and risks: Which property or interest must be insured, and which perils must the policy cover?
  • Insured amount: How should it be calculated? Ask whether the bank uses a valuation, rebuilding cost or another basis; the cited provisions do not establish a universal method.
  • Assignment wording: Must claims be assigned to the lender, and does it require particular wording or its own form?
  • Documents and timing: Which policy and assignment documents will the bank accept, and when must you provide them?
  • Renewals: Must cover remain in force throughout the loan, and how should you submit proof at renewal?
  • Costs: What premium, fee or other insurance cost is included in the offer and recorded in the agreement?

How to compare policies for lender acceptance

Before choosing between offers, compare the terms that affect both coverage and whether the lender will accept the policy:

  • Required risks and exclusions
  • Insured amount and the basis used to set it
  • Deductible
  • Assignment or lender-interest wording
  • Acceptance and documentation process required by the bank
  • Premium and renewal conditions

Ask the lender to confirm acceptance of the specific policy, rather than relying on a general description of the insurer’s cover. The relevant terms are in the policy documents and the bank’s criteria; the cited legal provisions do not set market-wide values for them.

Is fire insurance mandatory for every Polish mortgage?

The cited provisions do not say that every Polish mortgage must have fire insurance, or prescribe a universal set of risks. A lender may set fire cover or other requirements as part of its minimum accepted scope. Check the written requirements for your mortgage rather than treating one bank’s practice as a rule for all lenders.

The cited consolidated legal text identifies its amendment cutoff, so consult the official text for any later amendments relevant to your agreement. The lender’s own written criteria and the insurance provisions in your contract remain essential for determining what policy will be accepted.
