A missing, inaccurate or technically non-compliant e-invoice can force a correction, weaken the buyer’s evidence for an input-VAT deduction, delay accounting or reporting, and trigger penalties. The exact result depends on the country whose VAT rules apply, the transaction (B2B, B2C, B2G, domestic or cross-border), the type of defect and whether a correction or reporting deadline has passed. There is no single EU-wide fine or rule that makes every defective invoice automatically unusable.
Start by identifying the issuing and receiving countries, the transaction type and the reporting period. Then classify the problem: no invoice, missing field, wrong VAT or total, wrong recipient, or failure to use a required structured format. Those facts determine what the supplier must do, what the customer can document, and whether a tax authority may impose a penalty.
Why the consequence depends on jurisdiction and transaction
The European Union has a common VAT invoicing framework, but member states add national rules, deadlines, formats and sanctions. The European Commission explains that invoices are generally required for most business-to-business supplies, subject to exceptions, while national legislation determines many practical details. A domestic sale, an intra-EU supply, an export, a consumer sale and a public-sector transaction may each have different invoicing requirements.

- Defect and timing: note whether the document is absent, incomplete, numerically wrong, addressed to the wrong recipient, technically invalid, late or already included in a VAT return.
Those distinctions matter more than whether the file is called a PDF, XML or electronic invoice. A file sent by email is not automatically a compliant structured e-invoice.
What a compliant e-invoice must contain
Under the EU baseline described by the European Commission, an invoice commonly needs an issue date, a unique sequential number, supplier and customer identification, a description and quantity of goods or services, prices, the applicable VAT rate and VAT amount. Depending on the transaction, it may also need a reverse-charge statement, exemption wording, an intra-EU supply reference or other national information. When the required information is present, the Commission says the invoice acts as evidence that allows the business to deduct VAT in the relevant member state.
National exceptions can change both the list and the timing. Some supplies can use simplified invoices; other transactions require additional references. A buyer should therefore compare the document with the rules for the actual supply instead of applying a generic internet checklist.
Structured format is a separate compliance question
EU guidance on the EN 16931 model treats compliance as more than having electronic characters in a file. Invoice-level compliance includes mandatory information, correctly structured data, correctly calculated amounts and permitted values. A receiver that is required to accept e-invoices must be able to process an invoice compliant with the applicable CORE model or a national CIUS (Core Invoice Usage Specification). A visually correct PDF can still fail a structured-invoicing mandate if its data cannot be parsed or contains a prohibited value.
National implementation controls which syntax, access point, network, validation rules and effective dates apply. Confirm the required format with the tax authority or official e-invoicing specification for the relevant country and transaction before treating a technical rejection as a mere software issue.
What can happen to the buyer
Input-VAT deduction becomes harder to support
A defective invoice can leave the buyer without the normal documentary evidence for an input-VAT claim. That does not mean every error automatically destroys the deduction. Some systems allow a correction, substitute evidence or a substance-over-form remedy when the material conditions of the transaction are demonstrably met. The buyer should not assume that an informal email or an altered copy is enough; the remedy and deadline are national questions.

Belgium illustrates the point. Its official e-invoicing FAQ says that, for a transaction within the structured e-invoicing obligation, the buyer needs a structured electronic invoice to exercise deduction. It also describes a conditional substance-over-form exception where material conditions are satisfied. This is a Belgian example, not an EU-wide entitlement.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Clear out junk files and repair common Windows errors3Scan for outdated or missing drivers - takes under a minuteAn invoice addressed to the wrong recipient
Receiving an invoice for goods or services supplied to someone else is a more serious defect than a typographical error. Belgian guidance says the recipient should reject such an invoice, may not use it to deduct tax, and should not include it in its accounts. The issuer must account for the wrongly issued document under the applicable procedure and issue a corrective document, in practice a credit note, before invoicing the actual customer.
Failure to receive a required structured invoice
In a jurisdiction with a mandatory structured system, a buyer may need technical means to receive invoices through the prescribed channel. Belgian guidance states that a buyer can face an administrative fine for lacking those means. Other countries may use different penalties, grace periods or enforcement approaches, so the Belgian result should not be generalized.
Buyer response by defect type
| Buyer’s situation | Likely practical risk | Immediate action |
|---|---|---|
| No invoice received | Insufficient evidence for the purchase and VAT claim; possible late-booking or reporting problem | Request the invoice through the legally required channel and hold the deduction until the applicable evidence is obtained or a permitted alternative is confirmed |
| Missing mandatory field | Invoice may fail formal requirements and invite a correction request or challenge | Ask the issuer for a corrective invoice that references the original |
| Wrong VAT rate or amount | Over- or under-claimed input VAT and possible interest or adjustment | Reconcile net amount, rate and tax; obtain a corrected document and amend records or returns when required |
| Wrong recipient | No deduction for the named recipient; risk of misstated accounts | Reject it, do not post it, and notify the issuer so the document can be cancelled or credited and reissued |
| Invalid structured data | Technical rejection, inability to process or failure to meet a mandate | Preserve the rejection message, correct the data or syntax and resend through the approved route |
What can happen to the issuer
The supplier carries the primary duty to issue an invoice that is timely, accurate and compliant with the required format. A missing invoice, omitted mandatory information or inaccurate VAT can require a correction and can expose the supplier to an administrative or tax fine. Late issuance may be treated differently from a content error, and a failure to use a mandated network can be a separate offence.
Belgian sanctions as a country-specific example
Belgium’s Federal Public Service Finance says that existing fines for failure to issue invoices and for non-compliant invoices also apply to structured e-invoices. Its FAQ describes a proportional tax fine for an unissued structured invoice, missing mandatory information or inaccuracies, under Table C of the annex to Royal Decree No. 41 of 30 January 1987. It separately identifies non-proportional fines for late issuance and certain other legal or technical failures.

The same Belgian guidance summarizes a Royal Decree of 8 July 2025 that introduced fines for a first failure to have the technical means to issue and receive structured invoices: €1,500 for the first offence, €3,000 for the second and €5,000 for subsequent offences, subject to the recurrence and other conditions stated in Belgian law. These figures apply to the Belgian rules described by that authority; they are not EU-wide penalties. Check the current decree and effective dates before relying on an amount.

How issuer exposure differs from buyer exposure
| Defect | Issuer’s issue | Buyer’s issue |
|---|---|---|
| Invoice never issued | Possible failure-to-invoice fine and late reporting consequences | No normal invoice evidence for deduction or accounting |
| Mandatory information missing | Non-compliant invoice and possible proportional fine | Need to obtain a corrected document to support the claim |
| Incorrect VAT calculation | Incorrect output-tax reporting; correction and potential interest or penalty | Input tax may be overstated or understated until corrected |
| Late issuance | Separate timing offence in some national systems | Delayed posting and possible period-matching problem |
| Wrong recipient | Must reverse or credit the document and issue it to the actual customer | Must reject it and keep it out of the accounts |
| Structured-format failure | Resend in the mandated syntax or channel; possible technical sanction | May be unable to process or deduct until a valid structured invoice arrives |
How to correct a missing or incorrect e-invoice
The common correction-document principle
The EU VAT Directive provides that a document or message that amends an invoice and refers to the original specifically and unambiguously is treated as an invoice. This supports the use of a credit note, debit note or other corrective invoice, but it does not create one universal workflow. The national rules decide whether the original must be cancelled, whether a separate correction document is required, how VAT is reported and how quickly the correction must be made.
- Freeze the record. Keep the original file, transmission record, validation result and accounting entry. Do not overwrite the original or silently edit a posted invoice.
- Classify the defect. Identify the missing field, wrong value, recipient error, duplicate, late issue or technical-format failure. Recalculate the net amount, VAT and total.
- Check the applicable national procedure. Verify whether the country requires a credit note, a replacement invoice, a corrective invoice or an amended VAT return.
- Reference the original clearly. Include the original invoice number and date, state that the document is corrective, and explain the reason and the amounts being changed.
- Send through the required channel. If structured e-invoicing is mandatory, transmit the correction in the same approved network or syntax unless the national specification says otherwise.
- Align both ledgers and returns. The supplier and buyer should retain matching original and corrective documents and adjust VAT records in the period required by local law.
- Monitor acceptance. Save the recipient’s technical acknowledgement or rejection and resolve validation errors rather than assuming that transmission equals legal receipt.
Spain: a concrete corrective-invoice procedure
The Spanish Tax Agency says a corrective invoice is mandatory when an invoice omits one or more required elements or when VAT amounts were determined incorrectly, among other listed situations. Correction should be made as soon as the issuer becomes aware of the circumstances, provided four years have not elapsed in the situations described by the agency.
Spanish guidance requires the corrective invoice to identify its corrective status, explain the reason, identify the original invoice or invoices, state the correction and meet the general invoice requirements. This is a Spain-specific procedure. A business operating elsewhere must use its own country’s rules for deadlines, numbering and VAT-return treatment.

Belgium: wrong-recipient documents
For an invoice sent to the wrong Belgian recipient, the recipient should reject it and exclude it from the accounts. The issuer must account for the error under the Belgian guidance and include the wrongly invoiced amounts in a corrective document, generally a credit note, before documenting the supply for the actual customer.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Can you deduct VAT without a correct invoice?
Usually, the safest answer is to delay or qualify the claim until the required invoice evidence is corrected. The invoice is a central proof document, but EU rules and national case law can recognize exceptions where the underlying supply, supplier, VAT amount and other material conditions are established. Whether an exception is available, what substitute evidence is acceptable and whether a later correction cures the defect are all jurisdiction-specific.
Do not claim input VAT from an invoice for a supply you did not receive, from a document addressed to another business, or from a fabricated or altered file. If the amount or rate is wrong, claim only what the applicable rules permit and correct the accounting when the supplier issues the proper document.

Deadlines, reporting and penalties
A correction can affect more than the invoice register. If the original VAT return has already been filed, the supplier or buyer may need an amended return, a voluntary disclosure, a correction in a later period or payment of interest. Some systems impose a deadline for issuing a corrective invoice; others distinguish the deadline for correction from the deadline for recovering overpaid or underpaid VAT.

Later amendments or national measures can change the answer.
Preserve authenticity, integrity and legibility
The consolidated VAT Directive defines an electronic invoice as one containing the required information and issued and received in any electronic format. From issue through the end of the storage period, the business must ensure authenticity of origin, integrity of content and legibility. Internal controls that create a reliable audit trail can be used to support those qualities.
In practice, retain the original electronic file, delivery and receipt metadata, validation responses, approval records, purchase evidence and every linked correction. Restrict edits to controlled correction documents, keep a clear link to the original invoice and document who approved the change and why. A printout or screenshot may help a reviewer, but it should not replace the legally required electronic record where structured retention is mandated.
A practical response checklist
- Identify the issuing country, customer country and transaction type.
- Confirm whether a structured e-invoice mandate applies and which syntax or network is required.
- Compare the invoice with the mandatory fields for that exact transaction.
- Recalculate net, VAT rate, VAT amount and total, including reverse-charge or exemption wording where relevant.
- Check the legal name and tax identifiers of both parties and verify that the goods or services were supplied to the named recipient.
- Ask the issuer for a formal corrective document; do not erase or rewrite the original.
- Record any technical rejection and resend through the approved channel.
- Review whether an already-filed VAT return, payment or deduction must be amended.
- Check national deadlines, penalty provisions and any transition rules in force on the correction date.
- Keep an audit trail linking the original invoice, correction, delivery evidence, accounting entry and VAT-return treatment.
Bottom line
A missing or incorrect e-invoice is a compliance defect whose consequences are determined locally. The normal remedy is a properly referenced correction, not an informal edit. Buyers should protect their VAT deduction with a valid invoice and reject documents for supplies they did not receive; issuers should correct content, timing and structured-format failures promptly. Use the European framework as a starting point, then verify the current national rule and deadline before filing or paying tax.
