There is no blanket UK rule that either licenses or prohibits AI research collaboration. Whether a project needs a licence or additional security review depends on the specific technology and information being shared, who can access it, the partner and destination, the intended end use, and any rights or control granted over research assets. Export controls, Trusted Research and Innovation (TR&I), the National Security and Investment (NSI) Act, ATAS and sanctions are separate checks; more than one can apply to the same collaboration.

When do UK export controls apply to AI research?

UK strategic export controls cover specified military and dual-use goods, software and technology, as well as certain technical assistance. A licence may be required when an item falls within the UK consolidated control list or when end-use or end-user concerns trigger a catch-all control. The applicable framework includes the Export Control Act 2002 and the Export Control Order 2008, alongside relevant dual-use controls. The government’s strategic export guidance was updated on 23 April 2026; exporters are responsible for checking whether a licence is required.

The question is not whether an activity is labelled “AI,” but whether the particular hardware, software, algorithm, technical data, model capability or assistance is controlled and how it will be transferred or used. UKRI notes that data and algorithms can be subject to export-control considerations. A transfer need not involve shipping equipment: sending information overseas, providing technical instruction or enabling access to controlled material may be relevant.

Technical assistance can include instructions, training, working knowledge, consulting, skills and technical data. The Export Control Joint Unit (ECJU) identifies applied research in fields including telecommunications and information technology as potentially high-risk. That is a reason to screen relevant work carefully, not evidence that all AI research is controlled. The ECJU’s academic guidance asks institutions to consider both whether technology is controlled and whether even non-controlled items could be diverted to a weapons of mass destruction (WMD) programme.

Screen the project, not just the software label

  • What is involved? Identify the specific model, source code, weights or other model artefacts, data, hardware, documentation and specialist knowledge.
  • What will happen? Establish whether material will be sent, shown, discussed, uploaded, licensed or made accessible remotely, and to whom.
  • Who and where? Check the partner, relevant individuals, affiliations, destination and any onward-transfer route.
  • Why will it be used? Consider the stated end use and any credible diversion or military/WMD concern.
  • What rights are granted? Review licences, access terms, governance rights and other arrangements that could confer control over research assets.

These are screening questions, not a substitute for classification against the relevant control-list entry or case-specific advice. An overseas co-author, international student or cloud platform does not by itself establish that an export licence is needed.

Does academic research have an export-control exemption?

Some exemptions may apply, but “academic research” is not a general exemption. The ECJU academic guide describes exemptions for technology or software already in the public domain, qualifying basic scientific research, and the minimum technical information needed for certain non-nuclear dual-use patent applications. Each exemption has conditions, and end-use, end-user and destination concerns can still matter.

Basic scientific research

Basic scientific research is experimental or theoretical work undertaken solely to gain fundamental knowledge, without being directed at a specific practical aim or technical problem. This exemption applies only to controlled dual-use technology, not technology on a military list. Applied work or unpublished technology can mean that advanced postgraduate research, including an MPhil or PhD project, does not qualify wholly for the exemption.

Planned publication is not the same as public-domain information

Research does not become public domain simply because publication is intended. The ECJU guide warns that sending controlled research overseas for peer review or publication may require a licence before publication. Assess the actual material and transfer, including draft papers, code, model artefacts, technical documentation, data, training and troubleshooting.

Can export controls apply to cloud access or online collaboration?

Yes. ECJU guidance includes e-Research and e-Science among online or distributed activities where export controls can apply. The relevant question is whether a person outside the UK will receive or access controlled technology or technical assistance, not simply where a server is physically located.

For a cloud or remote setup, establish who can access source code, technical data, software, model artefacts and specialist instructions; where those people are located; what the platform’s access controls allow; and whether the interactions communicate controlled technology. A UK-hosted service does not automatically make overseas access or technical exchanges irrelevant.

What does UKRI Trusted Research and Innovation require?

UKRI’s TR&I principles and expectations are a proportionate, risk-based approach to safeguarding research while enabling effective collaboration. UKRI expects organisations it funds to comply with relevant law and undertake appropriate partner due diligence. Its principles also address partner governance and ownership, relevant state affiliations, collaboration agreements, cybersecurity awareness, sharing of knowledge and facilities, and limiting data access to people with a clear need for it and only for as long as needed. The methods and risk appetite used to apply the principles can vary between institutions.

UKRI defines TR&I as “the protection of the UK’s intellectual property, sensitive research, people, and infrastructure from potential theft, misuse and exploitation.” Its principles, version 2.0, were published on 13 June 2025. TR&I supports institutional risk management; it does not itself create a legal export prohibition or replace export-control analysis.

Partner due diligence

Before agreeing to an international collaboration, ECJU recommends considering whether a transfer will occur, whether diversion is a concern, and whether partner organisations or individuals have links or activities that warrant scrutiny. Possible checks include open-source information, sanctions or restrictions lists, and public information about military or defence involvement. A risk signal should prompt proportionate review rather than an automatic conclusion that the partnership cannot proceed.

When can the NSI Act affect an AI research collaboration?

The NSI Act is separate from export controls. It can apply to qualifying acquisitions of UK-connected entities or assets when statutory control tests are met and a national-security risk may arise. AI is one of 17 sensitive areas for mandatory notification of certain qualifying acquisitions of entities that meet the legal conditions and thresholds. Asset acquisitions are not subject to mandatory notification, but qualifying asset acquisitions may still be called in for assessment.

Relevant research assets can include software, trade secrets, databases, source code, algorithms, patents and other intellectual property, as well as specialised laboratory equipment. A sponsorship, collaboration, licence or spin-out arrangement may warrant NSI review if it gives a party control, or greater control, over a qualifying entity or asset, including future assets. Public funding or an academic purpose does not automatically exempt an acquisition. NSI clearance does not replace an export licence, and an export licence does not clear an NSI matter.

How do ATAS, sanctions and foreign-interference rules fit in?

ATAS

The Academic Technology Approval Scheme (ATAS), administered by the Foreign, Commonwealth & Development Office (FCDO), applies to certain foreign students and researchers studying or conducting research in specified sensitive technology-related fields in the UK. It is an approval scheme for eligible people and subjects, not a general export licence. Check the current subject and eligibility rules for the person’s circumstances; the public guidance was updated on 24 March 2026.

Sanctions and embargoes

Sanctions can prohibit exports or make the destination, end user or intended end use decisive; a sanctions licence may be needed for an export prohibited by sanctions legislation. Check the rules applying to the specific destination and parties at the time of the proposed transfer rather than relying on a static country summary.

Foreign Influence Registration Scheme

UKRI identifies the Foreign Influence Registration Scheme (FIRS) as relevant where an arrangement involves political influence activity in the UK at the direction of a foreign power. Routine research collaboration alone should not be treated as triggering FIRS; assess whether the actual arrangement and activity fall within the scheme’s current rules.

Where can a UK research organisation get specialist guidance?

The Research Collaboration Advice Team (RCAT) provides the research sector with advice on national-security concerns in international collaboration, including AI among the topics listed in its 2026 update. RCAT reported more than 3,800 engagements with institutions across the UK and management of more than 500 cases in 2026; those are overall activity figures, not counts of AI-specific risks or evidence against any particular partner. ECJU can be contacted with specific export-licensing questions.

The Department for Education’s guidance, Protecting UK higher education from foreign interference, published on 9 February 2026, is a complementary resource for higher-education providers on recognising, preventing and reporting foreign interference while protecting people, research and academic freedom. Institutions should route a proposed transfer, agreement or access grant through their export-control and research-security processes, and seek specialist advice when technical classification, partner risk or the rights being granted are unclear.
