A “prosecutor’s office” is the broader term for an office that prosecutes cases, so a DA’s office is one type of prosecutor’s office—not a separate, competing kind. Titles, authority, and duties vary by jurisdiction.
What does a district attorney do?
A DA’s central job is to prosecute criminal cases that fall within the office’s jurisdiction. The office acts on behalf of the state or other government named in the applicable law; it does not represent an individual crime victim as a private lawyer would.
State law defines the office’s responsibilities. For example, North Carolina directs district attorneys to prepare trial dockets, prosecute specified criminal actions and infractions in district and superior courts, advise justice officers in their districts, and represent the state in certain juvenile cases. The statute assigns state appeals to the attorney general. North Carolina General Statutes § 7A-61 is an example, not a nationwide job description.
New York law describes a district attorney’s duty as conducting prosecutions for crimes and offenses cognizable by the county’s courts, subject to statutory exceptions and related duties. New York Executive Law § 700. Pennsylvania law likewise directs district attorneys to conduct county prosecutions in the name of the Commonwealth. Pennsylvania Consolidated Statutes, Title 16, § 1402.

Deciding whether to bring charges
Prosecutors make charging decisions under the rules that apply in their jurisdiction. California’s official guidance says state law gives a locally elected prosecutor discretion in filing criminal actions. It describes the decision as assessing whether a jury weighing conflicting evidence would find the defendant guilty beyond a reasonable doubt. The guidance also says state attorney general intervention is limited to specified circumstances, including disqualification or an obvious abuse of prosecutorial discretion. That explanation reflects California’s framework; it should not be treated as a uniform rule for every state or as a prediction about any particular case.

Is a district attorney the same as a prosecutor?
A prosecutor is a role: a lawyer who brings and handles criminal cases for the government. District attorney is a title used in some jurisdictions for a public prosecutor with a defined local or regional area of responsibility. In ordinary usage, a DA is a prosecutor, and the DA’s office is a prosecutor’s office.
Other jurisdictions use titles such as county prosecutor, state’s attorney, or county attorney. The U.S. Department of Justice groups district attorneys, county or city prosecutors, and some state attorney general offices among state and local prosecutors. Connecticut, for instance, uses state’s attorneys and a Division of Criminal Justice for criminal prosecution; the state attorney general principally handles civil jurisdiction. Connecticut Division of Criminal Justice: About Us. Texas law includes district attorneys, criminal district attorneys, and some county attorneys performing district attorney duties within its definition of “state prosecutor.” Texas Code of Criminal Procedure, Article 2.01.
How a DA’s office differs from other prosecuting offices
The title alone does not tell you the office’s full authority. To understand what a particular office handles, compare its jurisdiction, legal authority, case types, represented government, and any additional responsibilities.

These differences matter because the name “DA” does not establish a single set of boundaries or powers across the country. For a specific county or case, consult the current office’s official materials and the controlling state law.

State and local prosecutors generally handle cases arising under state law, while U.S. Attorneys prosecute federal cases on behalf of the United States. The Department of Justice explains: “The U.S. Attorney’s Office represents the United States in federal cases, meaning they arise from federal law created by Congress.” U.S. Department of Justice: Federal Prosecutors.

Federal and state laws can overlap, so conduct may fall within both state and federal jurisdiction. In some circumstances, state and federal prosecutors may each pursue a matter under their respective laws. The applicable facts and law determine whether either office can act.
Finding the right office for a local question
If you need to identify the prosecutor responsible for a particular location or type of case, check the relevant government agency’s official website and the state statutes defining its authority. Do not assume the office with “district attorney” in its name handles every prosecution in the area. This overview explains general U.S. terminology; it is not legal advice about a live case.
