Data sovereignty is more than choosing an EU data-centre region. It is the organisation’s effective ability to control where data is stored and replicated, which laws can compel access, who can administer systems, how encryption keys are held, what evidence is available, and whether the business can move or delete its data. An EU region is one control, not a complete sovereignty conclusion.
A European business can use a US-headquartered cloud provider and still meet GDPR obligations in some circumstances. It must first map every data flow and access path, select a valid transfer mechanism for personal data leaving the European Economic Area (EEA), assess the destination country’s laws, and obtain contractual, technical and operational safeguards. The same analysis should cover backups, support, telemetry, subprocessors and remote administration—not just the production database.
What data sovereignty covers
Data sovereignty describes effective control over data and the systems that store or process it. For a cloud customer, control has several dimensions:
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →- Location: the primary region, replicas, backups, disaster-recovery copies, logs and telemetry.
- Jurisdiction: the laws that apply to the provider, its parent company, subprocessors and administrators, including laws that may allow a foreign authority to demand access.
- Administration: where support and engineering staff are located, what privileged access they have, and whether access can be performed remotely.
- Technical control: encryption in transit and at rest, customer-controlled keys, hardware security, privileged-access management and tamper-resistant logs.
- Legal and audit evidence: processor terms, transfer mechanisms, audit reports, certifications, government-request procedures and proof of deletion.
- Portability: usable exports, documented APIs, interoperability, switching assistance, predictable exit costs and the ability to restore the workload elsewhere.
The European Commission describes tech sovereignty as Europe’s ability to act independently in the digital world by developing and controlling key technologies, data and infrastructure while reducing reliance on non-EU providers. For a private business, that principle becomes a practical question: can you make and enforce decisions about your data even when the software is operated by another company?

Why an EU cloud region is not enough
Selecting a region in the EU reduces some geographic risk, but it does not by itself settle GDPR transfer or foreign-access questions. Personal data can leave the EEA through several less-visible paths:
- A support engineer outside the EEA views a ticket, diagnostic dump or live session.
- A subprocessor stores monitoring data, crash reports or identity records in another country.
- Backups or disaster-recovery replicas are created in a global service rather than the selected region.
- Telemetry, billing records and security logs contain identifiers and are routed centrally.
- A provider’s parent company or administrator is subject to a foreign disclosure law even when the server is physically in Europe.
For that reason, ask for a complete processing map. It should identify each data set, purpose, system, country, recipient, retention period and access method. Treat a provider’s “EU data residency” label as a statement about a specified service configuration, not as proof that every related process remains in the EU.
Can a European business use a US cloud provider and remain GDPR compliant?
Potentially, yes. GDPR does not impose a blanket ban on US providers. Compliance depends on the service, the data, the recipient entities and the safeguards used for any transfer outside the EEA.
Approved transfer routes
The European Commission identifies several routes for lawful transfers of personal data:
- An adequacy decision for the destination country or an approved sector.
- Standard contractual clauses (SCCs).
- Binding corporate rules for an eligible corporate group.
- An approved certification or code-of-conduct mechanism with enforceable commitments.
- Limited derogations for exceptional situations, such as explicit consent or a necessary contract, which are not a routine substitute for a transfer framework.
The current SCC sets were adopted on 4 June 2021. The relevant module depends on whether the exporter is a controller or processor and on the recipient’s role. A cloud customer should also have a GDPR-compliant processor agreement and a clear subprocessor-approval process; SCCs do not replace those duties.

When the EU-US Data Privacy Framework can help
The European Commission adopted the EU-US Data Privacy Framework adequacy decision on 10 July 2023. It allows personal-data transfers to participating US companies, with safeguards intended to limit intelligence access to what is necessary and proportionate and an independent redress mechanism.
This route applies only to a company that is actually listed as participating and only to the services and data covered by its certification. Verify the provider’s current participation, the precise service, all relevant subprocessors and the onward-transfer terms. “US provider” and “EU region” are not, by themselves, legal conclusions.

Transfer-impact assessment
The Commission’s 2021 SCC guidance expects the parties to document a transfer-impact assessment (TIA). A useful TIA records the specific circumstances of the transfer, the law and practices in the destination country and the additional safeguards that reduce identified risks.
How to perform a cloud transfer-impact assessment
- Inventory the data. Classify personal, special-category, confidential, regulated and non-personal data. Record formats, identifiers, volumes and retention periods.
- Map every transfer and access route. Include production, support, troubleshooting, telemetry, identity services, backups, disaster recovery, subprocessors and administrator access. Note the country in which data is stored and the country from which it can be accessed.
- Identify each recipient. Record the legal entity, ownership, role, sector, processing-chain length and whether the recipient is a processor, subprocessor or independent controller.
- Select the legal mechanism. Check for an adequacy decision or verified Data Privacy Framework participation. Otherwise select the appropriate SCC module, binding corporate rules, certification, code of conduct or narrowly applicable derogation.
- Study destination-country laws. Assess government-access powers, surveillance rules, disclosure procedures, judicial oversight, independent remedies and the practical likelihood of compelled access for this type of service and data.
- Specify technical safeguards. Document encryption in transit and at rest, key ownership and location, hardware-security controls, tokenisation or pseudonymisation, tenant isolation and administrator-access restrictions. Explain whether the provider can decrypt data and under what conditions.
- Define operational safeguards. Require least-privilege access, approval and time limits for support sessions, immutable access logs, alerting, incident notification and a process for challenging an unlawful request. State when and how the customer will be notified, subject to legal restrictions.
- Decide whether residual risk is acceptable. If the provider can access plaintext and the destination law creates an unacceptable risk, change the architecture, use stronger customer-held keys, remove the transfer or choose another service.
- Keep the assessment current. Revisit it after a legal change, new subprocessor, new region, material product change, security incident or government-access event.
What a sovereign cloud means
“Sovereign cloud” is not a single legal status or universally standard product label. In procurement, it generally means a service designed to give the customer stronger control over location, jurisdiction, operations, technical keys and continuity than a globally operated public-cloud service.
Ask what the label actually guarantees. A credible specification should state:

- Which legal entity operates the service and where that entity and its parent are incorporated.
- Where customer content, metadata, backups and logs are stored and replicated.
- Whether personnel outside the chosen jurisdiction can access systems, and how such access is approved and recorded.
- Who controls encryption keys, whether keys remain in the customer’s jurisdiction and whether the provider can use them.
- How government requests are received, challenged, disclosed and logged.
- Which independent audits, certifications or European criteria apply, and which service components they cover.
- How the customer exports, deletes and verifies data at contract termination.
Sovereignty can be achieved through architecture and contracts, not only through a provider’s marketing category. Conversely, a product called sovereign may still leave gaps in support access, telemetry or exit rights unless those details are written into the service terms.

A procurement framework for comparing cloud services
Use the following questions during due diligence. Require documentary answers rather than a general residency statement.
| Comparison axis | Questions to ask | Evidence to request | Warning signs |
|---|---|---|---|
| Location and replication | Where are primary data, replicas, backups, logs, telemetry and disaster-recovery copies kept? | Region architecture, data-flow diagram, retention settings and a list of all storage locations. | “EU hosted” without backup, support or metadata details. |
| Jurisdiction and access | Which entities and laws govern the service? Where are administrators and subprocessors located? | Corporate structure, subprocessor register, access policy and government-request procedure. | Unrestricted global support access or no notification commitment. |
| Technical control | What is encrypted, who controls keys, and how are privileged actions recorded? | Key-management design, hardware-security information, access logs and audit reports. | Provider-only keys, shared administrator accounts or logs that cannot be exported. |
| Legal evidence | Which GDPR processor terms, SCC module, adequacy route or certification applies? | Signed data-processing agreement, SCCs, current certification and audit reports. | Reliance on a logo or region selector without contractual coverage. |
| Portability | Can all data, configuration and audit history be exported in usable formats? What assistance and fees apply? | Export specification, API documentation, deletion certificate and tested migration plan. | Proprietary formats, high exit fees or undefined deletion timelines. |
| Operational resilience | Can the service operate if a cross-border route is suspended? How are outages and incidents handled? | Recovery objectives, staffing model, incident process and continuity test results. | No regional-failure plan or support dependent on a single foreign location. |
Technical controls that make sovereignty real
Encryption and key custody
Encryption in transit and at rest is a baseline. For sensitive workloads, evaluate customer-managed or customer-held keys, separation of duties, hardware security modules, key rotation, emergency revocation and whether provider staff can obtain plaintext. Encryption is most protective when the provider cannot unilaterally access the keys needed to decrypt the content.
Privileged access and logging
Require named accounts, multifactor authentication, just-in-time elevation, dual approval for sensitive actions and session recording where lawful. Logs should be immutable, retained for a defined period and exportable to a system the customer controls. Confirm that support personnel cannot bypass these controls through an emergency channel.
Deletion and recovery evidence
Define deletion for active storage, replicas, caches, backups and snapshots. Ask how long copies persist, how cryptographic erasure works and what certificate or audit evidence is supplied. Test restoration in an alternative environment so that a sovereignty plan does not depend on one provider’s continued availability.

Non-personal data and the EU Data Act
The EU free-flow framework aims to let organisations store and process non-personal data anywhere in the EU. Public authorities can still access that data for regulatory purposes even when it is held in another Member State or in the cloud.
The Data Act has applied since 12 September 2025. It supports interoperability and switching between data-processing services and sets conditions for certain third-country government requests concerning non-personal data held in the Union. Providers should take reasonable measures such as encryption, audits and certification and should inform customers where possible. The Act does not prohibit cross-border data flows; it is intended to ensure that protection afforded to data in the EU travels with data transferred outside the EU.
Do not assume that classifying a dataset as non-personal removes all obligations. A log or device record may become personal data when it can be linked to an individual, and a single cloud environment often contains both categories. Classify data at field and use-case level, then apply the stricter controls where categories mix.
Portability, switching and exit risk
Sovereignty includes the ability to leave. Before signing, document an exit runbook covering:
- Full export of content, metadata, identities, permissions, configurations and audit logs.
- Open or widely supported formats and APIs, with conversion tools where formats are proprietary.
- Provider assistance, staffing, duration and price during migration.
- Any egress, extraction, termination or professional-service fees.
- Deletion deadlines for production, replicas and backups, plus verifiable evidence.
- A test restoration in another region or provider, including application dependencies and encryption keys.
Run a small exit test before committing a critical workload. A provider that claims easy switching but cannot produce a complete, usable export creates concentration risk even if its hosting location is acceptable.

Putting the decision into practice
For a low-risk collaboration service
Map user and support data, verify the processor agreement and transfer mechanism, restrict support access, enable EU storage and retention controls, and ensure exports and deletion are available. Reassess when subprocessors or service regions change.
For regulated or highly confidential workloads
Require jurisdictional and administrator-location commitments, customer-controlled keys, strict regional replication, independently auditable privileged access, short notification windows and a tested recovery environment. Complete the TIA before production data is loaded, and obtain legal review of destination-country law and the chosen SCC module.
For a multi-cloud architecture
Maintain one processing map across providers. Standardise identity, key management, logging and export formats so that a transfer or outage in one service does not force data through an unassessed route. Record which provider is responsible for each subprocessor and interface.
Ongoing governance checklist
- Review the processing map at least whenever architecture, region or subprocessor changes.
- Revalidate adequacy status, Data Privacy Framework participation and certifications.
- Test government-request, incident-notification and support-access procedures.
- Sample privileged-access logs and verify that customer-held keys remain under the intended control.
- Run restoration and export tests on a schedule appropriate to the workload.
- Update the TIA after relevant legal decisions, new surveillance powers, incidents or material service changes.
- Keep contracts, SCCs, audit reports, deletion evidence and test results together for procurement and supervisory review.
The practical test is straightforward: can the business show, with contracts, architecture diagrams, logs and tested procedures, where its data goes, who can reach it, which law can compel access, how that risk is mitigated and how the business would leave? If any answer depends only on a provider’s region label, sovereignty is not yet established.
