Short answer: an Australian exchange being registered with AUSTRAC means it is supervised for anti-money-laundering and counter-terrorism-financing (AML/CTF) purposes. It does not mean the exchange holds an Australian financial services licence (AFSL), that your coins are segregated or insured, or that you are protected from losses. A separate AFSL-based regime for digital-asset and tokenised-custody platforms is being implemented, but ASIC’s 15 October 2026 consultation says its draft requirements—including financial resources and custody standards—are preliminary. Your crypto disposals can generally create capital-gains-tax (CGT) consequences, and proposed CARF reporting will make provider data more visible to tax authorities.

The regulatory labels answer different questions

Australia does not use one universal “crypto licence” that settles every risk. The relevant supervision depends on what the asset is, what the business does and which legal entity provides the service. Treasury’s foundational explanation says a crypto asset’s classification turns on its features and use. If it is a financial product, the Corporations Act and ASIC regulation can apply; if it is not, Australian consumer law generally remains relevant. One service can involve both financial and non-financial products.

AUSTRAC registration: an AML/CTF obligation

Since 2018, digital-currency exchanges linked to Australia have generally had to enrol with AUSTRAC. Registration requires customer identification, ongoing due diligence, transaction monitoring and suspicious-matter and other AML/CTF reporting. The purpose is to reduce money-laundering and terrorism-financing risk.

AUSTRAC registration does not establish that customer assets are held separately from the operator’s money, that an independent custodian controls them, that losses are insured, or that customers will be repaid if the operator fails. It also does not mean AUSTRAC has assessed an exchange’s investment merits, token prices, cybersecurity or solvency. Keep using the registration as one compliance check, not as a safety certification.

AFSL coverage: conduct and financial-product regulation

Treasury’s September 2025 exposure draft and the government’s November 2025 bill introduced categories for digital-asset platforms and tokenised-custody platforms. A platform within the final scope would need an AFSL and would be subject to obligations such as acting efficiently, honestly and fairly; avoiding misleading conduct and unfair contract terms; explaining how assets are held; maintaining governance and risk controls; and providing accessible dispute-resolution arrangements.

That reform is not the same as saying every exchange already needs an AFSL. The status of a particular service depends on the final law, transitional relief and whether its activities fall inside the regulated categories. An exchange can be AUSTRAC-registered while its particular spot-trading service is not yet AFSL-covered.

What the new platform regime is intended to change

The November 2025 government release described a framework designed to make the operator’s responsibilities visible to customers. It said platforms would have to give clear information about how assets are held and what rights customers have, maintain strong governance and risk controls, and provide dispute resolution and compensation pathways when things go wrong.

The exposure draft also described a proposed maximum penalty for certain breaches: the greater of $16.5 million, three times the benefit obtained, or 10% of annual turnover. That was a proposal in the exposure-draft release, not a blanket penalty that can be assumed for every future breach.

The proposed small-platform exemption

Treasury proposed an exemption for a platform that both holds less than $5,000 per customer and facilitates less than $10 million in transactions per year. Both conditions matter. Falling below only one threshold would not satisfy the proposed test, and the figures describe the platform’s qualifying activity, not a promise that each customer is protected up to $5,000.

The exemption is a regulatory-scope test, not a consumer-safety badge. A platform below the thresholds can still have hacking, insolvency, withdrawal, pricing or operational risks. Check the final legislation and ASIC’s final instruments before relying on the exemption; the thresholds were presented as part of the reform process.

What is covered, and what may be outside a transition

ASIC’s CP 381 feedback summary recorded transitional concerns and a no-action position associated with an Australian Financial Services (AFS) licence-lodgement window no later than 30 June 2026. It noted exclusions for crypto lending or “earn” products and most crypto derivatives, and conditions including Australian Financial Complaints Authority membership. The same material referred to an updated no-action position through 30 September 2026. That date has passed, so a provider’s current relief, replacement instrument or licence status must be checked directly rather than assumed from an old announcement.

ASIC’s CP 392, released on 15 October 2026, is the current implementation consultation for the Corporations Amendment (Digital Assets Framework) Act 2026. It proposes guidance and standards for digital-asset platforms and tokenised-custody platforms, including asset holding, transactional and settlement standards and financial requirements. ASIC expressly warns that the preliminary instruments are illustrative and that their final form may change considerably.

What “capital requirements” mean for a customer

Capital rules apply to the platform or licence holder, not to the market price of your bitcoin, ether or other token. Their policy purpose is to reduce the chance that an operator cannot meet obligations after insolvency, theft, cyberattack, poor controls or a major operational failure. They do not stop a token from falling in value and do not turn a volatile asset into a guaranteed deposit.

Financial resources

ASIC’s consultation discusses financial-resource requirements, but the final amount and calculation method are not settled in the material currently available. A platform may ultimately need enough liquid resources for the risks and scale of its business, with evidence that it can continue operating and meet customer claims during stress. Do not treat a marketing statement such as “well capitalised” as a regulatory figure unless the operator identifies the applicable rule and reports its compliance.

Custody, segregation and trust arrangements

The central practical question is who legally owns and controls the assets while you use the platform. Proposed standards address client-asset holding and segregation or trust arrangements. Those controls are intended to keep customer property identifiable and separate from the operator’s estate, but the legal effect depends on the final rules, the contract and the asset type.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask for the exact legal entity named in your account agreement, whether assets are held on trust or under another segregation model, where private keys or equivalent control are maintained, and what happens if the entity becomes insolvent. A platform can be compliant in one service and use a different entity or arrangement for another.

Insurance, responsible managers and settlement controls

ASIC’s consultation also raises professional-indemnity insurance, responsible-manager capacity and settlement standards. Insurance can respond only to the risks and limits in the policy; it is not a guarantee that every coin balance is reimbursed. Responsible managers are people who demonstrate the competence and oversight required by the licence, while settlement standards address how transactions and asset movements are completed and reconciled. The final requirements remain subject to consultation.

How to check an exchange before depositing money

Use the following sequence for the exact service you plan to use, not merely for the brand name shown on an app.

  1. Identify the legal entity. Record the company name, Australian registration details and the entity named in the terms of service. A trading name may not be the licensed or registered entity.
  2. Check AUSTRAC registration. Search the AUSTRAC public register and confirm that the entity and activity are current. Registration confirms AML/CTF supervision only.
  3. Check AFSL status and scope. Search ASIC’s professional registers for an AFSL or authorised-representative relationship. Read the authorised services and conditions; an AFSL entry does not automatically cover every token, lending product or derivative offered in the same app.
  4. Read the custody disclosure. Look for the legal owner of assets, trust or segregation language, omnibus-wallet arrangements, rehypothecation or lending rights, withdrawal limits and the insolvency process.
  5. Confirm complaints and external dispute resolution. Find the internal complaints process and whether the relevant entity belongs to the Australian Financial Complaints Authority when that membership is required or offered.
  6. Review financial and governance information. Look for audited or otherwise explained financial resources, responsible managers, security controls, incident history and the limits of any professional-indemnity cover.
  7. Test tax records before trading heavily. Confirm that statements export dates, quantities, Australian-dollar values, fees, wallet addresses and transaction IDs. A registration badge does not calculate your CGT.
What you see What it tells you What it does not tell you
AUSTRAC registration The business is subject to AML/CTF enrolment, customer-identification and reporting duties. It does not prove asset segregation, insurance, AFSL coverage or repayment after insolvency.
AFSL covering the service The covered activity is inside ASIC’s financial-services licensing framework and its conduct obligations. It does not protect you from market losses or mean every product in the app is covered.
Proposed small-platform exemption The platform may fall below the proposed $5,000-per-customer and $10-million-per-year scope thresholds. It is not a safety certification or a $5,000 compensation promise.

Tax: when crypto activity can create CGT

Treasury says crypto assets will generally be treated as capital assets, but the result depends on the asset’s rights and your circumstances. A sale, swap, payment for goods or services, or other disposal can be a CGT event. Swapping one token for another is therefore not automatically tax-free merely because no Australian dollars reached your bank account.

Records to keep

  • Date and time of each acquisition and disposal.
  • Quantity and Australian-dollar value at the relevant time.
  • Fees, commissions and other costs included in the cost-base calculation.
  • Wallet addresses, transaction IDs and the exchange account used.
  • Statements showing transfers, deposits, withdrawals and balances.
  • Evidence of the purpose and beneficial ownership of transfers between wallets.

A transfer between wallets you control is not automatically a sale. The key question is whether beneficial ownership changed. Complex arrangements—such as lending, staking, wrapped tokens, liquidity pools, business trading or frequent professional activity—can change the tax analysis, so obtain advice rather than applying a simple “every transfer is taxable” rule.

CARF and what tax authorities may learn

Treasury’s consultation on the Crypto-Asset Reporting Framework (CARF) describes annual, standardised reporting by crypto-asset transaction providers and information sharing between participating tax authorities. If enacted, providers would have stronger obligations to collect and transmit account and transaction information, increasing the chance that overseas and domestic activity can be matched with tax records.

The consultation page does not establish a final commencement date. Do not claim that CARF reporting has already started or assume a particular first reporting year; verify the enacted legislation and implementation timetable. You should nevertheless keep complete records now, because provider reporting does not replace your own tax-return obligations.

Questions to put to a platform’s support or compliance team

  • Which legal entity holds my assets, and is that entity AUSTRAC-registered?
  • Is this specific spot-trading, custody, staking, lending or derivatives service covered by an AFSL? If so, what licence or authorisation number applies?
  • Are customer assets held on trust or otherwise segregated, and can the operator lend, rehypothecate or commingle them?
  • What happens to withdrawals and wallet control if the operator becomes insolvent?
  • What financial-resource and professional-indemnity requirements apply, and what exclusions or limits does the insurance have?
  • Which complaints route applies, and is the responsible entity a member of the Australian Financial Complaints Authority?
  • Can I export a complete, machine-readable tax history including fees and wallet addresses?

Why the reform matters without changing investment risk

Treasury has said the framework is intended to support innovation while making digital assets safer for consumers. Assistant Treasurer Daniel Mulino described the 2025 proposal as a way of “legitimising the good actors and shutting out the bad” while giving businesses certainty and consumers confidence. The policy case is about better operator conduct, custody and failure planning—not a government guarantee of token value.

Government ministers cited a Digital Finance Cooperative Research Centre estimate of up to $24 billion a year in economy-wide productivity and cost savings from digital-finance innovation. That is an economy-level estimate, not an expected return from holding crypto and not evidence that any individual platform or token will appreciate.

A practical decision rule

Before depositing, separate three decisions: compliance (is the entity registered or licensed for this activity?), counterparty protection (how are assets held and what happens on failure?), and tax administration (can you reconstruct every disposal and cost base?). Compare platforms on all three, as well as supported products, fees and spreads, withdrawal controls and the quality of their records. Do not rank them solely by an AUSTRAC badge, and do not treat a proposed capital rule or exemption as a promise that your coins cannot lose value.
