A screenshot records what was rendered at a particular moment. Its value depends on whether you can show where it came from, when and how you captured it, that the file was preserved, and how it connects to the legal issue. Courts and agencies apply their own evidence rules, so treat a screenshot as one part of an evidence package rather than proof of every disputed fact.
This guide explains how to capture, preserve, authenticate and corroborate website evidence, how copyright and trademark questions differ, and how to avoid common mistakes when a page is dynamic, restricted or later changed.
What a website screenshot can—and cannot—prove
A screenshot can show visible text, artwork, photographs, logos, product presentation or other page content as it appeared to the person viewing it. That may help document alleged copying, public use of a mark, marketplace presentation or possible consumer confusion.
By itself, however, an image of a page usually does not establish all of the following:

- who created or owns the material;
- the exact date the material was first published or viewed by consumers;
- whether the page was visible to the public, an account holder or only a particular location;
- whether content was authorized, licensed or later altered;
- that the file has not been cropped, edited or substituted; or
- that the evidence satisfies the forum’s admissibility rules.
WIPO describes screenshots, analytics and metadata as forms of digital evidence whose effectiveness depends heavily on collection, preservation, authentication and compliance with jurisdiction-specific requirements. The practical objective is therefore to preserve the source and context, not merely to save attractive pixels.
Start with the fact you need to establish
Before opening a browser, write one sentence identifying the proposition the capture is intended to support. Examples include “the competitor displayed our registered logo on its product page on 29 September 2026” or “this article contained our photograph without the licensed credit.” This prevents a large, unfocused screenshot collection and tells you what context must remain visible.
Record the page context
- Copy the complete URL, including the path and query string.
- Record the access date and exact time with the time zone.
- Note the browser, device or viewport, operating system and whether a mobile or desktop view was used.
- State whether the page was public, behind an account, paid, password-protected or location-dependent.
- Record relevant account, country, language, currency or other conditions that affected what you saw.
- Describe the capture method and the person who performed it.
Do not log in, bypass a paywall or evade an access control unlawfully. EUIPO practice indicates that password or payment restrictions do not automatically bar a screenshot in that particular trademark context, but the circumstances and governing rules still matter.
Step-by-step evidence workflow
1. Capture the complete page
Use a full-page capture when the relevant material is below the fold, while also making focused captures of the exact logo, paragraph, image or product panel. Keep enough of the browser-rendered page to identify the site, page title and surrounding context. If a page loads content only after scrolling, wait for it to appear and note that behavior.
2. Preserve an untouched original
Save the first file exactly as produced. Do not crop, annotate, recompress, resize or overwrite it. Create a separate working copy for arrows, highlights or redactions and label that copy as an annotation. Keep the original and working files in separate directories with stable filenames.
3. Preserve related material
Where lawful and proportionate, retain downloaded page files, relevant emails, invoices, licence documents, source-page information, transaction records, analytics, social-media posts and a screen recording of a multi-step interaction. These materials can help show authorship, publication, consumer exposure, sequence and context—facts a single still image may not establish.
4. Keep a collection log
A simple spreadsheet or text log should connect each file to its URL, capture time, time zone, operator, device or browser context and purpose. For a series of pages or a transaction, preserve the order and explain what each step demonstrates.

5. Verify integrity when stakes justify it
Generate a cryptographic hash of the preserved file if your counsel, court or agency expects one, and store the hash with the collection record. A hash can show that a later file matches the preserved bytes; it does not prove that the original page was truthful, that the timestamp is accurate or that the evidence is admissible.

Use access-controlled storage with backups. A portable external SSD can be a practical additional copy, but no particular storage medium is legally required by the general guidance. Keep a record of transfers and avoid editing the only copy.
How to capture a page yourself
- Open the URL in a current browser and verify the address bar, page title and relevant content.
- Set the viewport or device emulation that matches the context you need to document. Record the setting.
- Allow images, fonts and lazy-loaded sections to finish. Note any cookie banner, login state, geolocation or consent choice that changes the page.
- Use the browser’s full-page screenshot command, then make focused captures of material that needs closer inspection.
- Save the files without editing. Immediately duplicate them into a working folder for annotations.
- Write the URL, time zone, browser context, method and operator into your collection log.
- Preserve related records and, where appropriate, a hash or trusted timestamp.
Manual capture is inexpensive and lets you see the page directly, but it can be difficult to reproduce a dynamic page, a geo-targeted result or a capture requiring many URLs. Browser extensions may also inject their own overlays, so inspect the result before relying on it.

Copyright and trademark questions are different
Copyright
Copyright generally protects original expression appearing on a website, such as writing, artwork and photographs. It does not protect facts, ideas, procedures, systems or methods of operation as such. As WIPO puts it: “Copyright law does not protect ideas or concepts; it only protects the way these are expressed in a particular work.” A screenshot of copied text or an image can document the alleged copying, but retain creation records, licences, registrations where applicable and chain-of-title documents to establish the right itself.
Copyright registration requirements vary. WIPO notes that registration is not a prerequisite under the Berne Convention, while some countries provide registration or deposit systems. Follow the rules of the country and forum handling the dispute.
Trademark
Trademark disputes focus on issues such as genuine use, source identification, consumer confusion and infringement. A screenshot can show how a mark appeared in a listing, advertisement, social post or checkout flow. WIPO’s discussion of an Oriflame matter illustrates that online product images and social-media evidence may be considered when genuine use is assessed; that case does not mean every screenshot proves trademark use.

Authentication, timestamps and admissibility
Authentication asks whether the exhibit is what you claim it is. EUIPO’s CP12 practice separates initial genuineness and veracity checks from the evidence’s ultimate weight. Concerns include later amendment, alteration, forgery, an editable page, a discrepancy between upload and print dates and the credibility of the source.

If you submit metadata, explain how it was obtained, which fields were extracted and what source supplied them. A timestamp can associate particular data with a time; it does not independently prove authorship, first publication, consumer exposure, page content outside the captured view or admissibility. A trusted timestamp or specialist capture provider can strengthen the chronology when the stakes justify its cost, but it does not replace authentication or corroboration.
There is no global rule that screenshots are automatically admissible, sufficient or conclusive. WIPO reports an Indian Delhi High Court example in which digital evidence was declined without a certificate required under Section 65B of India’s Evidence Act. That is an illustration of a jurisdiction-specific requirement, not a universal certificate rule. Chinese trademark administrative provisions issued for their stated Chinese enforcement context call for records of the original storage medium, extraction method and process, file details and an integrity verification value; those provisions should not be transplanted to other forums.
Common failure modes and fixes
The capture has no URL or time
Cause: the operator saved only the image. Fix: recapture with the address bar or page identifier visible and create a log containing the full URL, time zone and method.
A cookie banner or chat widget obscures the claim
Cause: the page state was not recorded or cleaned. Fix: make one capture showing the page as encountered, then a separate clearly labeled working capture after lawful consent or dismissal. An automated service can document its cleanup settings and verdict.
The page changes between captures
Cause: dynamic content, personalization, experiments or geolocation. Fix: record account, location, viewport and timezone; capture the sequence; preserve supporting files and independent captures where practical.
The file was cropped or recompressed
Cause: an annotated exhibit replaced the original. Fix: retrieve the untouched original, keep annotations in a different filename and record every transformation.

Cause: chronology is confused with authenticity or ownership. Fix: explain exactly what was timestamped and corroborate identity, source, rights and page context separately.

An automated request returns a blank, blocked or timed-out page
Cause: bot checks, scripts, network dependencies, access controls or a page that has disappeared. Fix: verify the URL manually, use an appropriate wait or device context, preserve the failed result and response status, and do not represent an unsuccessful capture as evidence of what the page contained.

Compare provenance and repeatability, preservation of source files and context, timestamp verifiability, handling of restricted or geo-dependent pages, cost and exportability, and the rules of the target jurisdiction. No method eliminates the need for a clear collection record and corroboration.
Before you rely on a screenshot
- Have you stated the exact fact the exhibit is meant to prove?
- Does the original retain the full URL, date, time zone and capture context?
- Can another person understand who collected it, how and in what sequence?
- Are untouched originals separated from annotated or cropped copies?
- Have you preserved evidence of authorship, licence, registration or chain of title?
- Have you corroborated publication, public exposure, analytics or transaction facts where those matter?
- Have you checked the rules of the court, agency or platform in the governing jurisdiction?
- Have you avoided unlawful access, circumvention or misleading presentation?
When to obtain legal advice
Consult counsel before sending a demand, filing a takedown that could trigger a counterclaim, accessing restricted material, relying on evidence collected in another country or submitting a capture in active litigation. A lawyer can identify the controlling evidentiary rule, advise on preservation notices and determine whether additional testimony, records or technical extraction is needed.

Can I use a screenshot from a private, password-protected page?
Possibly, depending on how you lawfully accessed it and the rules of the forum. Record the access conditions and obtain jurisdiction-specific advice; access status can affect weight, privacy and admissibility.
Should I submit the screenshot as PNG, JPEG or PDF?
Use the format that preserves the relevant detail and is accepted by the court or agency. Keep the original response file and document any conversion; format alone does not authenticate the exhibit.
Does a blockchain or trusted timestamp prove who owned the website content?
No. It can support when a particular file existed, but ownership, authorship, authorization and the truth of the page still require separate evidence.
How long should I retain captured website evidence?
Keep it for the applicable limitation period, dispute hold or counsel’s retention instruction, including originals, logs, hashes, related records and backups. The required period differs by claim and jurisdiction.
