Short answer: The February 2026 US–India announcement is an interim framework, not a fully operative free-trade agreement. It describes an 18% US reciprocal tariff for originating Indian goods in listed sectors, with possible removal for certain categories if the Interim Agreement is successfully concluded. India agreed in principle to eliminate or reduce tariffs on all US industrial goods and a broad range of US food and agricultural products. A separate Indian government notice dated July 25, 2026 reports an additional 10% US Section 301 duty on imports from India for final forced-labour measures. Neither the final entry-into-force date nor a complete product-level tariff annex is established in the official material available as of October 19, 2026.

What the February 2026 US–India deal actually is

The February 2026 document is a framework for an Interim Agreement, with negotiations continuing toward a broader Bilateral Trade Agreement. It is therefore a policy commitment that still needs implementing text, an effective date and customs instructions before companies can treat every promised rate as legally available at the border.

It is not accurate to describe the announcement as a completed US–India free-trade agreement. A free-trade agreement normally has operative chapters, tariff schedules, rules of origin, customs procedures and a defined entry-into-force mechanism. Those shipment-level details are not all published for this framework. Until they are, a company should distinguish between what the governments announced and what a customs entry can claim.

What is established

  • The framework states that India will eliminate or reduce tariffs on all US industrial goods and a wide range of US food and agricultural products.
  • For originating Indian goods in listed sectors, it states an 18% US reciprocal tariff.
  • It says certain categories may receive removal of the reciprocal tariff if the Interim Agreement is successfully concluded.
  • A separate July 25, 2026 Indian government notice reports a final 10% ad valorem Section 301 duty associated with forced-labour measures on imports from India, reduced from a 12.5% proposal.

What is not yet established

  • A definitive entry-into-force date for the Interim Agreement.
  • A complete HS-code tariff annex showing the treatment of every Indian product.
  • The final exclusions, quotas, product definitions and documentation rules for conditional categories.
  • A universal tariff rate that applies to every Indian-origin shipment.

Those gaps matter because customs treatment is determined at the product and entry level. A broad sector description cannot replace an HTS classification, origin analysis and the latest implementing notice.

How much will Indian goods pay when imported into the United States?

There is no single all-in rate for every Indian product. An importer must build a duty stack. The 18% figure is the headline reciprocal rate stated for originating Indian goods in listed sectors; it is not automatically the only charge and it is not necessarily effective for every item today.

Potential layer How to treat it as of October 19, 2026 What determines the amount
Ordinary HTS duty Still part of the calculation unless a later notice changes it The exact US HTS classification, customs value and any normal preference or exemption
18% reciprocal tariff Headline rate stated in the February framework for originating Indian goods in listed sectors Whether the product is covered, qualifies as Indian-originating and falls within an effective category
Conditional reciprocal-tariff relief Possible for specified categories after successful conclusion of the Interim Agreement Final implementing text, product schedule, effective date and any conditions
Section 301 forced-labour measure Separate 10% additional ad valorem duty reported in the July 25, 2026 notice Whether the HTS line and shipment fall within the final measure and its effective-date rules
Other trade remedies or national-security measures Check separately; the framework does not erase them automatically Product-specific orders, exclusions, quotas and current US notices

“Additional” means a separate layer, not a replacement for the ordinary duty. For example, if a product is subject to an ordinary HTS duty, the reciprocal layer and the reported Section 301 layer, the importer must determine how each is assessed and whether any notice changes the order of calculation. Do not simply add percentages to a supplier’s invoice without confirming the legal basis and customs-value treatment.

Why origin changes the result

The 18% framework rate is described for originating Indian goods. Shipping a product from India does not by itself establish Indian origin. Origin rules examine where the good was wholly obtained or sufficiently produced or transformed, and the applicable rule can differ by product. USTR explains that rules of origin determine whether a good is originating and qualifies for preferential tariff treatment under an agreement.

A US importer should obtain a production and sourcing explanation, identify non-Indian inputs, test the applicable origin rule and retain the supporting records. If a finished product is assembled in India from components made elsewhere, the assembly may or may not confer origin; the answer depends on the rule for the classified product.

What the deal changes for US exporters selling to India

India committed in the framework to reduce or eliminate tariffs on all US industrial goods and a broad group of US agricultural products. The named agricultural coverage includes dried distillers grains (DDGs), red sorghum used for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits.

The commercial benefit is prospective until India publishes implementing notifications and product-level schedules. A US exporter should not quote a customer a “duty-free” price solely because the framework lists the product category. Confirm the Indian tariff line, the notification’s effective date, any quota or licensing condition and the documents required at clearance.

Non-tariff measures in the framework

The announcement also addresses barriers beyond the headline duty. It refers to medical-device barriers, information and communications technology (ICT) import licensing, standards and food and agricultural non-tariff measures. A lower customs duty does not automatically remove a registration, conformity assessment, labeling, import-license or sanitary requirement.

For a regulated product, map the customs tariff and the market-access requirement separately. A shipment can be eligible for a lower tariff and still be delayed because the importer lacks an Indian license, test report, labeling statement or food-safety document.

Is this a free-trade agreement?

No—not yet in the legally complete sense. The governments announced a framework for an Interim Agreement and are working toward a broader Bilateral Trade Agreement. Until final text enters into force, the announcement should be treated as a negotiating and policy framework rather than a blanket preferential program.

The distinction affects contracts. A purchase agreement that assumes a future zero duty should state who bears the duty if the schedule, date or product coverage changes. Incoterms, price-adjustment clauses and termination rights should reflect that uncertainty instead of assuming the framework has already changed the tariff schedule.

How the new measures affect an importing company

1. Classify the exact product

Start with the complete commercial description, material composition, function, degree of processing and packaging. Determine the US HTS code at the level used for entry, not just a four-digit industry label. A mistaken classification can change the ordinary duty, determine whether the reciprocal measure applies and trigger a different Section 301 line.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

2. Establish origin

Document the country where the good qualifies as originating under the applicable rule. Keep supplier declarations, bills of materials, manufacturing records and transformation analysis. The shipping port, seller’s address or country printed on a freight document is not a substitute for origin evidence.

  • Please Note: To reach 10Gbps speed, keep the cable under 3.3 ft. For USB A Male to USB C adapters, try flipping the USB C connector. USB C Male to USB A adapters support bidirectional 10Gbps transfer within 3.3 ft

3. Determine customs value

Build the value used for duty assessment and preserve the commercial invoice, assists, commissions, packing charges, freight and insurance information relevant to the valuation method. USTR customs guidance emphasizes that customs valuation must be fair and uniform. Ask a broker or counsel to resolve related-party pricing, royalties or assists before filing.

4. Build the duty stack

  1. Record the ordinary HTS duty for the confirmed classification.
  2. Test the product against the 18% reciprocal framework coverage and any published effective date.
  3. Check whether the final 10% Section 301 forced-labour measure applies to the HTS line and entry date.
  4. Review other product-specific trade remedies, quotas, exclusions or national-security measures.
  5. Document why each layer applies or does not apply.

5. Check current implementation notices

Before shipment, review the latest USTR, US Customs and Border Protection and India Department of Commerce notices. Look for effective dates, exclusions, quota administration, filing instructions, required declarations and corrections to product lists. The February framework’s category language is not a substitute for those notices.

6. Recalculate landed cost and pricing

Update the customs-value model, brokerage, merchandise-processing charges, freight, insurance, inland transport, storage and financing. Then decide whether the importer, exporter or customer bears a change in duty under the sales contract. Run scenarios for the ordinary duty alone, the ordinary duty plus 18%, and the ordinary duty plus every applicable additional layer; label each scenario as effective, conditional or unconfirmed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Retain an audit file

Keep the classification rationale, origin analysis, invoice, packing list, transport records, valuation support, broker instructions and any certificate or declaration used. Customs formalities are a necessary part of international trade, and a company must be able to explain its claim after entry, not only when the shipment is booked.

Do shipments need a certificate of origin?

The framework does not establish one universal certificate format for every US–India shipment in the official material available by October 19, 2026. Whether a certificate, declaration or other origin statement is required will depend on the final implementing rules, the product and the treatment being claimed.

Importers should nevertheless prepare origin evidence now. Ask the exporter for a signed origin statement or supplier declaration when appropriate, maintain the manufacturing and component records that support it and make sure the document identifies the shipment and product clearly. Do not claim preferential or conditional treatment merely because a certificate exists; the underlying origin rule and effective tariff schedule must also be satisfied.

Trade scale and why the policy matters

USTR’s 2026 country profile estimates total US goods-and-services trade with India at $239.6 billion in 2025. US goods trade was $149.1 billion, consisting of $103.8 billion in US goods imports from India and $45.4 billion in US goods exports to India. The resulting US goods trade deficit with India was estimated at $58.4 billion.

The negotiation baseline cited a 17% average applied Indian tariff and a 3.3% average applied US tariff for 2024/2025. Those are averages, not rates for an individual shipment. Averages help explain the bargaining context but cannot be used to price a specific HTS line.

Common mistakes and how to avoid them

  • Calling the announcement a signed FTA: Use “interim framework” until final text and an entry date are published.
  • Applying 18% to every Indian product: Test the listed sector, product schedule, origin and effective date.
  • Ignoring the separate 10% measure: Check the final Section 301 scope independently of the reciprocal tariff.
  • Using the ship-from country as origin: Analyze production and transformation under the applicable origin rule.
  • Quoting a future Indian tariff reduction too early: Wait for India’s notification and product-level schedule.
  • Assuming lower duty removes regulation: Verify medical-device, ICT, standards, labeling and food-safety requirements separately.
  • Using a rounded industry code: Classification must match the technical product description and HTS line.
  • Failing to preserve records: Keep valuation, origin and classification evidence for the required retention period and any customs inquiry.

A practical decision checklist

  • What is the exact product and HTS/HS code?
  • Where does the product qualify as originating, and what evidence supports that conclusion?
  • What is the customs value and which valuation method applies?
  • Is the ordinary duty known?
  • Is the 18% reciprocal layer effective for this product, or only described conditionally?
  • Does the separate 10% Section 301 measure cover the HTS line and entry date?
  • Are there quotas, exclusions, licensing rules or other trade remedies?
  • Which party bears duty changes under the contract and Incoterm?
  • Have the latest USTR, CBP and India Department of Commerce notices been checked?
  • Can the company produce its classification, origin and valuation file if customs asks?

Bottom line for 2026 planning

Model the US–India framework as a developing tariff regime, not as an already effective free-trade agreement. For Indian-origin goods, use the stated 18% reciprocal rate as a scenario for listed sectors, test any conditional relief only against final implementing text and separately investigate the reported 10% Section 301 duty. For US exports to India, the promised reductions cover all industrial goods and a broad agricultural list, but the commercial rate is not reliable until India publishes its schedules and notifications. Shipment-level decisions still turn on classification, origin, customs value, effective dates and records.
