Yes, TikTok could still face a U.S. ban as a legal possibility. Its return to Apple’s and Google’s U.S. app stores in February 2025 followed a delay in enforcement; it did not repeal the federal law. The Trump administration later said a proposed U.S.-based joint venture could satisfy the law’s divestiture requirements, with a qualifying agreement executed by the Committee on Foreign Investment in the United States (CFIUS) as a key condition. The available records do not independently establish that CFIUS executed such an agreement or confirm the apps’ live store listings as of September 30, 2026, so they do not show that another removal is imminent.
Why TikTok returned to the app stores
The Associated Press reported that TikTok returned to Apple’s and Google’s U.S. app stores on February 14, 2025, after President Donald Trump delayed enforcement of the law. The app had been removed on January 18 to comply with the law, and TikTok’s U.S. service had previously been suspended for less than a day.
The return addressed whether the app could be distributed through those stores at that time. It did not, by itself, settle TikTok’s longer-term status under the law.
What the law restricts
The Protecting Americans from Foreign Adversary Controlled Applications Act restricts app stores from distributing, maintaining, or updating covered applications, and restricts internet hosting that enables those activities. The White House’s January 20, 2025 executive order said the prohibitions took effect on January 19, 2025.

That order directed the attorney general not to enforce the Act for 75 days while the administration considered a course of action. A later Department of Justice response described an extended enforcement period through January 23, 2026, along with relief from liability for Google for specified conduct during the covered periods. Those statements describe enforcement and past liability; they are not a repeal of the statute by Congress.
How the proposed divestiture could affect TikTok’s status
In a September 25, 2025 executive order, the White House described a proposed U.S.-based joint venture intended to meet the law’s divestiture requirements. The order said ByteDance and its affiliates would own less than 20 percent, while the new venture would control the algorithms, code, and content-moderation decisions. It also described keeping U.S. user data outside foreign-adversary control and having trusted security partners monitor software updates, algorithms, and data flows. These are the administration’s descriptions of the proposed safeguards, not independently audited findings about how the arrangement operates.

The order said the proposal would qualify as a divestiture once implementation agreements were executed. It amended an earlier divestment order so that the prohibition would cease if CFIUS executed an agreement with investors consistent with the September order. That makes the execution of a qualifying agreement a central condition in the administration’s stated framework.
A White House fact sheet issued the same day described ByteDance as holding less than 20 percent and selecting one of seven directors, and named Oracle as the proposed security provider and cloud operator. That fact sheet describes the plan; it does not independently establish the current ownership, governance, or operating arrangements.

A third-party reproduction of a July 2026 Department of Justice Office of Legal Counsel opinion says the TikTok USDS joint venture was finalized in January 2026 and that ByteDance’s minority shareholder position did not amount to control. Because the available records do not include an official DOJ-hosted copy or a CFIUS execution notice, that account alone does not establish that the agreement condition was met.

The Act’s restrictions remain the relevant legal mechanism. Under the administration’s September 2025 order, the prohibition would cease if CFIUS executed an agreement consistent with the order. If an arrangement did not qualify, stopped meeting applicable conditions, or if the law or enforcement posture changed, distribution through app stores could again be at risk.
