The key differences are how the product is structured, which rules apply, how prices and payouts work, and what protections or complaint channels may be available. In the United States, the legal treatment of sports-related event contracts on federally registered markets is contested; check the rules and regulator position for your location rather than assuming either product is legal everywhere.
How prediction-market contracts and sportsbook wagers work
Prediction-market event contracts
The Commodity Futures Trading Commission (CFTC) describes an event contract as a financial contract tied to whether an event occurs, does not occur, or reaches a specified extent. Many are presented as yes-or-no contracts. Their displayed prices can reflect traders’ estimates of an outcome’s probability, but a price is not proof that the estimate is accurate.
On many venues, buyers and sellers interact through an order book. Depending on the contract, a holder may be able to sell or otherwise exit a position before settlement at the then-current price. Fees, liquidity, contract terms, and exit options vary by venue and market. A thin market or a fast-moving event can make an early exit difficult or costly.
Sportsbook wagers
A sportsbook accepts wagers under its own house rules and the gaming framework that applies where the customer is located. Odds and the stake determine the potential payout under those rules. Cash-out options, if offered, are product-specific; do not assume a wager can be closed early.

For either product, the label—“contract,” “bet,” “yes/no,” or “investment”—does not by itself establish the legal treatment or the amount at risk. Read what you pay, how any payout is calculated, whether and how you can exit, what source determines the result, what can void the position, and how disputes are handled.
What differs in the U.S. regulatory framework

The CFTC says DCMs must register and comply with the Commodity Exchange Act and CFTC regulations, including market-integrity obligations. Its consumer guidance says exchanges must maintain rules addressing manipulation and insider trading, and advises customers to understand fees, penalties, payout terms, and settlement determinations. On March 12, 2026, the CFTC’s Division of Market Oversight issued an advisory reminding DCMs of their obligations, including considerations relevant to sports event contracts. The division said DCMs should take proactive steps to ensure their markets evolve in compliance with federal law and regulations; that statement concerns exchange obligations, not a guarantee of customer protection or profit.

Why the legality question is unsettled
The CFTC asserts that federal law gives it exclusive authority over event contracts on registered markets. State regulators have challenged some sports-related offerings under state gambling laws, while the federal agency has sued states over their actions. In a March 2026 advance notice, the CFTC said it had withdrawn earlier proposed rules for reconsideration amid state actions and litigation. The notice sought comments; it did not resolve the dispute.
Connecticut illustrates the conflict, but its actions are not a nationwide ruling. On December 3, 2025, the state Department of Consumer Protection (DCP) said KalshiEX LLC, Robinhood Derivatives LLC, and Crypto.com lacked Connecticut sports-wagering licenses and ordered them to stop offering sports-event contracts to state residents. The agency cited state rules concerning age, technical standards, integrity controls, house rules, self-exclusion, and consumer remedies. In September 2026, Connecticut officials announced further actions and said the state’s licensed-sportsbook framework and gambling safeguards apply. These are Connecticut’s enforcement position and actions, not a final judicial determination for every state or every platform.

Accordingly, do not treat a platform’s availability, a federal registration claim, or the product’s label as a definitive answer to whether you may use a particular sports contract where you live. The applicable law and access can change; verify the latest position for your location and the exact product.
What to compare before risking money
Potential loss, fees, and liquidity
- Loss exposure: Any speculative position can lose money. A binary-style contract may limit a buyer’s loss to the amount paid or another amount specified in its terms, but there is no universal loss cap. Check the contract and account terms, including any fees or other obligations.
- Exit price: An event-contract price can move before settlement. Even if a contract can be sold early, there may not be enough liquidity to exit at a reasonable price. A sportsbook cash-out, when available, is governed by that operator’s offer and terms.
- Total cost and payout: Compare transaction or trading fees and the actual amount payable under the contract with the sportsbook’s odds, stake, and payout calculation. A headline price or promotion alone does not show the full cost.
Settlement, integrity, and recourse
- Settlement: Find the precise event definition and the source used to determine the result. Check what happens if the event is postponed, disputed, or otherwise affected by a rule that permits cancellation or voiding.
- Integrity controls: The CFTC says registered exchanges must monitor for manipulation and insider trading. Connecticut’s DCP alleged that the named platforms lacked state gaming integrity controls and could expose users to people with privileged information. That is a regulator’s allegation about those offerings, not a finding about every event-contract market.
- Complaint options: Identify the legal entity operating the product, its account and dispute terms, and the relevant regulator or complaint channel before depositing funds. A regulator’s involvement does not guarantee recovery of losses.
Connecticut’s DCP said the rules of the platforms named in its December 2025 notice had not been reviewed by the state gaming regulator and that the agency could not recover consumer losses in disputes involving those unlicensed platforms. This illustrates why local authorization and recourse matter; it does not establish what remedies are available for every platform or jurisdiction.

Age limits and responsible-play tools
Age thresholds and responsible-gambling protections vary by jurisdiction and product. Connecticut says the minimum age for online and in-person gaming and sports wagering in that state is 21. Its DCP also said the named platforms offered access to people under 21 and to self-excluded individuals. Do not apply Connecticut’s age rule or its allegations nationwide; check local requirements and whether the exact product supports self-exclusion or other limits. If gambling is becoming difficult to control, use local support and self-exclusion resources.
Who is on the other side?
According to the CFTC, regulated exchanges generally facilitate trading rather than take the opposite side of a customer’s position. That market structure does not make a trade safe, fair-priced, or profitable. For either kind of product, verify the operator’s legal identity, account agreement, custody and withdrawal terms, and complaint process.

In a March 2026 Federal Register advance notice, the CFTC reported that DCMs had certified approximately 1,600 event contracts for listing in 2025. The contracts covered financial, economic, weather, political, international, scientific, cultural, current, and sporting events. This is a count of contracts certified for listing—not a measure of sports-betting handle, customer numbers, active contracts, or market value.
A September 2026 Connecticut governor’s release repeated an American Gaming Association estimate that $40 billion would be wagered on the NFL through prediction markets in 2026 and cited nearly $250 million in college-football trading volume on the first day of that season for one market. The release did not provide enough methodology in the cited passage to independently validate or contextualize those figures, so they should not be treated as verified market-size statistics on that basis alone.

A practical checklist before you participate
- Confirm local status: Check current regulator guidance for your state or tribal jurisdiction and the exact product. A platform’s nationwide-access claim is not a substitute for a location-specific check.
- Verify the operator and oversight: Identify the legal entity and confirm relevant registration or gaming authorization. Find the regulator and complaint channel that apply.

- Set a loss limit: Use only money you can afford to lose, account for all fees, and monitor your position. The CFTC’s consumer guidance puts it plainly: “All speculation involves risk.”
- Check protections: Confirm age eligibility and the availability of deposit limits, self-exclusion, or other responsible-play tools in your jurisdiction.
