Eric Council Jr. was sentenced to 14 months in prison and three years of supervised release for his role in the January 2024 compromise of the U.S. Securities and Exchange Commission’s official X account, @SECGov. The U.S. Department of Justice announced the sentence on May 16, 2025.
What sentence did Eric Council Jr. receive?
The Justice Department said Council received 14 months in prison followed by three years of supervised release. These are the penalties imposed at sentencing, not the maximum possible term cited earlier in the case. The DOJ sentencing announcement, dated May 16, 2025, also quoted FBI Criminal Investigative Division Acting Assistant Director Darren Cox: “The deliberate takeover of a federal agency’s official communications platform was a calculated criminal act meant to deceive the public and manipulate financial markets.”
What happened to the SEC’s X account?
On January 9, 2024, an unauthorized party gained access to @SECGov and published a false statement that the SEC had approved spot bitcoin exchange-traded products. The SEC promptly said the post was unauthorized and that its account had been compromised.
The SEC later said its investigation found that the intruder had taken control of the phone number associated with the account in what appeared to be a SIM-swap attack. In a SIM swap, an attacker gets a victim’s phone number transferred to a SIM card or device they control, potentially allowing them to receive calls or text messages used in account access or recovery. How does the 14-month sentence differ from the five-year maximum?
In February 2025, the Justice Department announced that Council had pleaded guilty and said he faced a maximum potential prison term of five years. That release listed May 16, 2025, as the scheduled sentencing date. The later DOJ announcement reports the sentence actually imposed: 14 months in prison and three years of supervised release. The five-year figure was a potential maximum, not Council’s sentence. See the DOJ plea announcement.
