Federal contractors are facing two separate cybersecurity rule tracks, not one final “sensitive-data” rule. A government-wide FAR proposal would standardize how agencies identify and communicate Controlled Unclassified Information (CUI) obligations, while the Department of Defense’s CMMC acquisition rule is already final and took effect on November 10, 2025. DoD then announced an immediate suspension of CMMC Phase II on July 13, 2026, for a program review. That pause does not remove the duty to protect federal information.
Two rule tracks are moving on different timelines
The headline’s “major rules” refer to related but legally distinct actions. FAR Case 2017-016 is a proposed government-wide rule for handling CUI in federal contracts. DFARS Case 2019-D041 is a DoD-specific rule that places Cybersecurity Maturity Model Certification (CMMC) requirements into defense acquisitions.
| Track | Coverage | Status | How it works | 2026 development |
|---|---|---|---|---|
| FAR Case 2017-016 | Federal contracts across agencies involving CUI | Proposed January 15, 2025; listed at the final-rule stage in the Spring 2025 Unified Agenda | Standard CUI communication form, FAR clauses, a solicitation provision and clearer reporting instructions | No final publication was established by the agenda entry |
| DFARS Case 2019-D041 | DoD contracts requiring CMMC | Final action recorded September 10, 2025; effective November 10, 2025 | Solicitation-specified CMMC levels, assessment/status requirements and award eligibility for relevant systems | DoD suspended Phase II requirements on July 13, 2026, pending review |
Because the tracks have different scopes and legal effects, a contractor should not treat the FAR proposal as a replacement for CMMC, or treat the Phase II suspension as repeal of every existing safeguarding clause.

A common way to identify CUI
DoD, the General Services Administration and NASA published the FAR proposal on January 15, 2025. It would apply the National Archives and Records Administration’s Federal CUI Program to contract performance when CUI is on federal systems or resides on, or passes through, contractor systems or facilities.

The proposal’s central problem is inconsistent contract-level communication. It explains that laws, regulations and government-wide policies already mandate protections, but there is no standard way to identify and share those requirements with contractors. The proposed solution is acquisition standardization rather than a wholesale creation of new data-protection duties.
Forms, clauses and reporting details
The proposal would add a standard form, new FAR contract clauses and a solicitation provision. These mechanisms are intended to tell contractors which CUI categories and handling requirements apply and what incident-reporting obligations must be followed.
The proposal itself raises practical questions that contractors should watch for in the final text: whether additional compliance guidance is needed, whether multiple incident-reporting timelines could apply at once, and how overlapping reporting requirements would affect organizations operating under several contracts.
What it does not change
The proposal states that FAR Part 24 Privacy Act requirements would remain unchanged. It also anticipates separate future rulemaking to update NIST Special Publications 800-171 and 800-171A to then-current versions. The FAR CUI proposal should not be described as having made those NIST updates.

Where the FAR proposal stands
The Spring 2025 Unified Agenda listed FAR Case 2017-016 at the final-rule stage and said comments on the January proposal were being considered. An agenda entry is a status indication, not a final rule or proof that publication has occurred. Contractors should wait for the actual final FAR text and effective-date provisions before assuming a new clause must be added to a particular contract.
How the DoD CMMC acquisition rule operates
Solicitations determine the required level
Under current DFARS text, a contracting officer includes the required CMMC level in a solicitation when the program office or requiring activity specifies one. A contractor’s eligibility depends on having the required status for the systems used to process, store or transmit Federal Contract Information (FCI) or CUI that are relevant to the contract.
Where the contract requires it, the contractor must maintain that status and any required annual affirmations. The obligation is tied to the systems and data covered by the solicitation, not automatically to every system a company operates.
Conditional statuses and award eligibility
Current DFARS language describes conditional Level 2 and Level 3 statuses for a period of up to 180 days. Level 1 requires final status for award. The exact status, assessment and affirmation mechanics depend on the solicitation and applicable contract clauses, so an organization should read those documents rather than infer its duties from a general CMMC summary.

Clause timing
DFARS clause 252.204-7021 is used in solicitations through November 9, 2028 when a specific CMMC level is required, with a later applicability condition beginning November 10, 2028. The operative DFARS text and the solicitation language control an individual procurement.
What changed on July 13, 2026
Phase II was suspended immediately
DoD announced an immediate suspension of CMMC Phase II on July 13, 2026, ahead of the milestone that had been scheduled for November 10, 2026. The Department’s announcement and Chief Information Officer resource describe a review of the program.
The Department of War announcement expressly cautions: “It is critical to note that this action does not eliminate the requirement for companies to protect federal data.” In practical terms, the announcement pauses a program phase; it does not announce a general waiver of contractual, statutory or policy safeguards.
What remains unsettled
The July announcement does not, in the material released, establish a replacement milestone schedule or resolve every contract-modification question. It also does not establish that all CMMC clauses have been withdrawn from existing awards. Requirements can vary by solicitation, contract modification and the systems covered.

What contractors should do now
- Inventory the controlling documents. Pull each active solicitation, contract, task order and modification that involves FCI or CUI. Note every FAR, DFARS and program-specific cybersecurity clause.
- Map data and systems. Identify which systems process, store or transmit FCI or CUI for each contract. Keep that map tied to the contract rather than treating the entire corporate network as one undifferentiated scope.
- Check CMMC language and status. Where a solicitation specifies a level, verify the required status, assessment conditions, annual affirmation duties and any 180-day conditional-status provision that applies.
- Continue safeguarding and reporting. Maintain existing controls and incident-reporting procedures. A Phase II pause is not permission to stop protecting federal information.
- Monitor authoritative updates. Recheck the current DFARS text, DoD contracting guidance and any written direction from the contracting officer before changing a compliance plan. Do not assume a universal modification or a new deadline without an official document.
Why the “finish line” is still conditional
The CMMC acquisition rule reached final, effective status in 2025, but its 2026 Phase II suspension means implementation is being reassessed. The FAR CUI rule, meanwhile, was listed at the final-rule stage in the Spring 2025 Unified Agenda. Contractors therefore face a mix of settled requirements, proposed standardization and paused milestones.
The 2025 Unified Agenda estimated $16 million in annualized public costs for DFARS Case 2019-D041, using 2024 as the base year. That estimate concerns the CMMC acquisition rule, not the FAR CUI proposal, and it should not be used as a cost estimate for an individual contractor.
For any procurement decision, the safest reading is contract-specific: follow the clauses and solicitation in force, preserve protections already required, and treat future dates or revised Phase II obligations as unsettled until DoD or the contracting agency publishes authoritative instructions.

Does the proposed FAR CUI rule apply to every federal contract?
No. FAR Case 2017-016 is a government-wide proposal aimed at contracts involving CUI. It had not been established as a published final rule by the Spring 2025 Unified Agenda entry, so the final scope and effective date must be confirmed before applying it to a contract.

Is CMMC Phase II still happening?
DoD suspended Phase II immediately on July 13, 2026, and began a program review. The announcement did not provide a replacement schedule.
Did the Phase II suspension eliminate cybersecurity obligations?
No. DoD said the action does not eliminate the requirement for companies to protect federal data. Existing contract clauses, statutory duties and solicitation-specific requirements still need to be followed.
Where can a contractor find its required CMMC level?
Check the solicitation and contract documents. Current DFARS text requires the contracting officer to state the level when the program office or requiring activity specifies one, along with the status conditions for systems handling the contract’s FCI or CUI.
