Lyft has agreed to a proposed $272.5 million settlement over allegations that it misclassified California drivers as independent contractors. The agreement still requires approval by San Francisco Superior Court, and it does not change how Lyft classifies drivers for work performed after the covered period.

What the Lyft settlement covers

The agreement resolves allegations brought by California officials and private plaintiffs that Lyft treated drivers as independent contractors when they should have received employee protections. California’s Labor Commissioner describes the claims as alleged wage theft under Labor Code sections 2775 and following, together with claims under the Unfair Competition Law.

The alleged losses include minimum wages and overtime, rest-break premiums, reimbursement for business expenses, accurate wage statements, timely wage payments, paid sick leave and other workplace protections.

Who brought the case

The settlement coalition includes California Attorney General Rob Bonta, the California Labor Commissioner’s Office, the city attorneys of San Francisco, Los Angeles and San Diego, and private plaintiffs represented by Outten & Golden, Olivier & Schreiber, and Lichten & Liss-Riordan.

Approval is still required

Lyft’s agreement is proposed, not final. San Francisco Superior Court must approve it before the settlement can take effect and payments can be distributed under the approved terms.

Which Lyft drivers may be covered

Potentially covered workers are people who drove for Lyft in California during the settlement period and whose claims fall within the approved class or payment program. The settlement is not a promise that every California Lyft driver will receive money, and no individual payment amount has been established publicly.

Covered dates

The official releases differ by one day on the starting date. The Labor Commissioner identifies April 6, 2016; Lyft’s SEC filing identifies April 5, 2016. Both sources end the period on December 15, 2020. The controlling start date should be taken from the court-approved settlement documents.

Drivers who filed wage claims through the Labor Commissioner’s administrative process are specifically addressed in the allocation. The office says more than 1,600 such claimants will benefit from money it is giving up.

How the $272.5 million is allocated

The announced settlement value is $272.5 million. California says 87% of the settlement will go directly to drivers through restitution. The Labor Commissioner’s Office also says it will forgo $5.45 million in penalties so that the money can go to more than 1,600 drivers who filed wage claims through its administrative process.

The Labor Commissioner says those wage claimants will receive a multiplier that doubles the mileage used to calculate their payment. That statement does not establish a payment amount for any particular driver.

Who will send payments

Restitution will be distributed from a fund managed by a third-party settlement administrator. At the time of the official announcement, the administrator had not been named publicly. The administrator is expected to contact eligible people directly and later provide a website, email address and call center.

When checks or other payments will arrive

No distribution date, claim deadline or individual payment formula had been published in the available official materials. Those details depend on court approval and the administrator’s instructions. Until an official notice is issued, a driver cannot reliably calculate a payment or assume that a payment is guaranteed.

What drivers should do now

  1. Keep evidence of California Lyft work. Retain old Lyft account information, earnings records, mileage logs, tax documents and address details that could help an administrator match you to the settlement.
  2. Watch for official notices. Eligible people are expected to be contacted directly once the administrator is appointed. Use the contact information in an official notice rather than an unsolicited request for a fee or sensitive account credentials.
  3. Check the approved terms before filing anything. The court-approved documents should resolve the one-day start-date discrepancy, define the covered group and explain whether a claim form is required.
  4. Do not rely on a promised dollar figure. The public announcement does not state an individual payment formula for all drivers.

Does this change Lyft driver status today?

No. The Labor Commissioner says the settlement does not require Lyft to reclassify drivers going forward and does not provide relief for work after December 15, 2020. Proposition 22 took effect after the settlement period, so this agreement resolves alleged historical violations rather than deciding the legal status of later driving.

How the litigation developed

The Labor Commissioner filed its Lyft lawsuit in Alameda County Superior Court in August 2020. In September 2021, the matter was coordinated in San Francisco Superior Court with enforcement actions brought by the Attorney General and city attorneys, along with private cases brought under California’s Private Attorneys General Act.

California Labor Commissioner Lilia García-Brower said: “This settlement is about the workers who came forward and spoke up. Their voices made this outcome possible. We pursued this case to ensure workplace protections have real meaning and to recover as much as possible for drivers. My office will forgo its share of the settlement so that every available dollar goes directly to drivers who filed wage claims.”

  • The court’s approval decision.
  • The final controlling start date: April 5 or April 6, 2016.
  • The name and contact details of the settlement administrator.
  • Whether each eligible driver must submit a claim form.
  • The claim deadline and distribution schedule.
  • The formula that will determine payments for drivers who did not file an administrative wage claim.
