A website screenshot can be useful evidence, but taking one does not automatically prove that the page is authentic, complete, or attributable to the person or organization named on it. In U.S. federal court, the proponent must offer enough evidence for a finding that the item is what they claim it is under Federal Rule of Evidence 901(a). A defensible preservation process therefore records what was captured, when and how it was captured, protects the files from alteration, and preserves enough context to explain what the image does—and does not—show.

This is a practical preservation guide, not legal advice. Evidence rules and discovery obligations vary by jurisdiction and case; coordinate with counsel before collecting, producing, or relying on material in litigation.

What a website snapshot can prove—and what it cannot

A screenshot records a rendered view of a page at a particular capture event. It may help show what a browser displayed, but it does not by itself establish who published the content, whether it appeared earlier, whether the capture is complete, or whether the page was altered before capture. A URL alone does not prove that a site belonged to the business or person a party attributes it to.

Start with the proposition you need to support. For example, a snapshot might be offered to show that a notice appeared on a page during a particular visit, or to preserve a statement before a site changes. The evidence should be designed around that proposition: a single visible paragraph may be enough for one purpose, while another may require the page title, surrounding text, linked documents, interaction state, and proof of the capture method.

  • Rendered appearance: A screenshot can show visible content and layout in the captured browser state.
  • Underlying content: A screenshot is not a substitute for a linked PDF, video, form submission, script-generated text, or other file when that item is central to the claim.
  • Attribution: Evidence connecting a page to its purported publisher may be needed in addition to its URL or visual branding.
  • Historical timing: A current capture documents a current capture event; it does not alone prove what the page looked like on an earlier date.

Authentication is also distinct from other evidentiary questions. Even if a capture is authenticated, counsel may still need to address separate objections concerning relevance, hearsay, completeness, or the appropriate scope of discovery.

How the federal evidence rules apply

Rule 901: authenticate the exhibit

Federal Rule of Evidence 901(a) requires evidence sufficient to support a finding that an item is what its proponent claims it is. The rule’s examples include testimony from a knowledgeable witness, distinctive characteristics, public-record evidence, and evidence describing a process or system and showing that it produces an accurate result. The right foundation depends on the claim and the capture method.

Be precise about the claim. “This is a screenshot of what the browser displayed at this URL during my visit on this date” is narrower than “this proves the company published this statement on that date.” The latter may require additional evidence linking the site and content to the claimed publisher and establishing the historical timing.

Rules 902(13) and 902(14): certification may help with electronic evidence

Rules 902(13) and 902(14), effective December 1, 2017, allow qualifying electronic evidence and electronic copies to be authenticated by certification rather than live testimony. A certification can describe the process used to produce a record or the method used to identify an electronic copy. It may reduce the need for a live foundational witness, but it does not make an unreliable capture accurate or establish that the content came from the attributed speaker.

Whether a particular capture and certification qualify is a case-specific legal question. Preserve enough information for a competent witness or certifying person to explain the process, the system’s operation, and the integrity controls.

Rule 1001: a printout can be an original in some circumstances

For electronically stored information, Rule 1001 treats an “original” as including a printout or other readable output if it accurately reflects the information. An accurate reproduction can be a duplicate. That does not mean any printout automatically qualifies: accuracy and the relationship between the output and the information it represents remain important.

The United States Courts reports that the Federal Rules of Evidence were last amended in 2024. Confirm the applicable rule text and local requirements at the time of a filing; state courts may apply different rules.

A preservation workflow for discovery and potential exhibits

  1. Define the proposition and scope. Write down what fact the capture is intended to preserve. Identify the exact URL, domain, relevant date range, and any specific page states or linked materials that matter.
  2. Choose a reproducible capture method. Record the tool and version, browser or environment, and the steps taken. Preserve a native capture where possible as well as a human-readable rendering. For an interactive page, note the actions needed to reach the captured state.
  3. Record the conditions. Log the UTC timestamp, URL, operator, retrieval tool and version, browser or environment, and any login, locale, geolocation, or other conditions that could affect what appeared. If a site redirected, record the starting and final URLs.
  4. Preserve context and related materials. Keep the page title, surrounding text, navigation path, ownership indicators, and relevant terms of use. Save linked files or other resources if they bear on the claim. Include a site map or collection manifest that identifies what was captured and what was not.
  5. Protect integrity. Hash preserved files, retain an immutable master, limit access, and maintain a log of transfers and access. Record who collected, copied, reviewed, or produced each file and when.
  6. Prepare to explain the process. Have a declaration or certification, where appropriate, describe the capture procedure, system accuracy, and integrity controls. Identify the witness or custodian able to explain the method if challenged.

Use one consistent, documented process rather than relying on a screenshot file whose origin and handling are unclear. NARA’s web-records guidance describes reliability as a full and accurate representation of the transactions, activities, or facts attested to; it describes integrity as being complete and unaltered. NARA recommends documented procedures controlling creation, transmission, receipt, maintenance, and protection against unauthorized changes.

What to preserve beyond the image

A screenshot is only one part of a preservation set. The specific collection depends on what the disputed fact requires, but consider keeping the following together:

  • The original screenshot or capture output, plus a readable copy if the native format is inconvenient to review.
  • The exact URL, capture time in UTC, page title, final URL after redirects, and operator notes.
  • Relevant linked documents, images, downloadable files, or media, with their own retrieval details.
  • A record of the browser, capture software and version, viewport, login state, locale, and other conditions that shaped the rendering.
  • A manifest identifying files, hashes, collection scope, exclusions, and any known gaps.
  • A custody log covering storage, access, transfer, review, and production.

For a matter involving an application rather than a static page, note any clicks, scrolling, or form inputs needed to produce the view. Preserve the underlying item and reproduction steps if the point depends on content generated by a script, a video, a download, or a submission. Do not assume the image alone captures those elements.

Using the Wayback Machine or another historical archive

An archive can help show how a site appeared at an earlier time, but an archived page is not automatically self-authenticating. Federal committee materials discuss Wayback Machine printouts as possible exhibits while noting that courts differ on whether testimony about the archive process or other proof is needed. A party may challenge whether a dynamic page was captured accurately or whether its content is attributable to the ostensible site owner.

The Department of Justice likewise cautions that a court cannot assume a website belonged to a business solely because of its URL, and it describes authentication issues that can arise with Internet Archive captures. When using an archived page, retain the archive address and capture details, explain what the archive represents, and seek corroborating evidence connecting the page to its claimed publisher and date.

Archived and contemporaneous captures answer different questions. An archive may provide historical context when no contemporaneous capture exists; a fresh capture documents what appeared during the current retrieval. Neither should be described as proving more than its collection process supports.

Risks with dynamic pages and incomplete captures

Modern pages may change according to time, account, location, browser state, or third-party content. A screenshot may omit material that loaded later, content behind a control, personalized or geofenced elements, embedded resources, comments, redirects, or an interaction state not reproduced during collection.

  • Lazy-loaded content: Note whether the page was scrolled and whether below-the-fold images or text appeared before capture.
  • Personalized or restricted views: Record relevant login and account conditions without unnecessarily exposing credentials or unrelated private information.
  • Third-party embeds: Preserve or separately identify embedded content if it matters; its appearance on a page may not establish who created it.
  • Interactive content: Document clicks, selections, form inputs, or other steps and preserve the resulting underlying record where available.
  • Failures and redirects: Record blank, blocked, timed-out, or redirected outcomes instead of silently treating them as successful evidence of page content.

Explain limitations directly in collection notes. A clear account of what was and was not captured is more useful than presenting a partial rendering as a complete copy.

Choosing a capture approach

Approach Useful for Key limitation to address
Manual browser screenshot or print-to-PDF A quick, human-readable record of a visible page state. Record the browser state and steps; a visual output may not retain source files, headers, or the full interaction context.
Automated browser or capture system Repeatable collection across URLs or consistent rendering conditions. Document the system, configuration, version, and accuracy controls; automation can still miss dynamic or blocked content.
Historical web archive Investigating an earlier appearance when an archived capture exists. Establish what the archive captured and connect the page to its claimed publisher and date.

No single approach guarantees admissibility or completeness. Compare methods by whether they capture contemporaneously or historically, whether the target is static or dynamic, the context retained, the quality of timestamp and metadata, the integrity controls, the evidence of attribution, and whether a Rule 901 witness, Rule 902 certification, or both are available.

Common problems and practical fixes

  • The capture shows a blank page or challenge screen: Preserve that result as a failed or blocked retrieval, note the time and conditions, and try an appropriate alternative method rather than representing it as the page’s substantive content.
  • The page looks different on another device: Record viewport, browser, locale, login state, and other relevant environment details; reproduce the conditions tied to the proposition if possible.
  • The capture is challenged as incomplete: Explain the capture steps and known omissions, then collect the linked file, dynamic state, or additional context necessary to resolve the gap.
  • The date or source is disputed: Retain contemporaneous logs and system details, corroborate the claimed publisher or timing where possible, and identify a witness or custodian who can explain collection.
  • A file has changed after collection: Compare its hash with the preserved value, document the discrepancy, and use the immutable master and custody history to establish which version was collected and handled.

Retention, collection frequency, and legal holds

There is no universal retention period or rule that every webpage must be captured by one particular vendor. Retention and capture frequency depend on litigation holds, applicable rules, organizational policy, and documented risk assessment. NARA recommends that capture frequency and change tracking follow risk assessment. If litigation is pending or reasonably anticipated, consult counsel promptly about preservation scope, collection timing, and whether a legal hold applies.

Frequently Asked Questions

Does an authenticated screenshot prove that the named company wrote the page?

No. Authentication of the capture and attribution of the content are separate propositions; additional evidence may be needed to connect the page to its claimed publisher.

Is a screenshot automatically admissible because it is a PDF or printout?

No. A readable output may qualify as an original or duplicate when it accurately reflects electronically stored information, but the proponent still needs an appropriate foundation and must address other objections.

Can an archived page establish exactly what every visitor saw at the time?

Not necessarily. Archive captures may omit dynamic, personalized, or third-party content, and their completeness and attribution can be contested.
