The league’s reported argument focuses on third-party affiliate publishers allegedly promoting ways to get around court-ordered blocks or territorial restrictions—not on VPN technology itself being unlawful. The Commission has not announced a decision, and inclusion on the list would not amount to a legal finding or ban.
What LaLiga reportedly asked the Commission to do
In a report published around 1 October 2026, TorrentFreak said LaLiga submitted a 14-page contribution asking the Commission to include NordVPN, Proton VPN, ExpressVPN and Surfshark in the 2027 Watch List. TorrentFreak described the VPN-related request as a new element of a submission that also addressed other sites and services. TorrentFreak’s report is the source for the named providers and the account of the submission.
As reported, LaLiga’s concern is that third-party publishers and influencers with affiliate deals publish guides about watching matches through foreign broadcasts or getting around site-blocking measures, while earning commissions on VPN subscriptions. TorrentFreak reported that LaLiga did not identify a specific guide or influencer in the submission and disclaimed asserting that the named providers had been found legally liable. The reported allegations should not be treated as established findings about any provider’s own marketing or conduct.
Affiliate publishers and VPN providers are not the same actor
The reported theory centers on what affiliate publishers allegedly say and the commissions they may earn. An affiliate publisher is not automatically the VPN company itself, and the report does not establish that any of the four providers authored or approved a particular guide. LaLiga’s submission, as quoted by TorrentFreak, says: “The conduct that takes these services beyond neutral technical provision is the deliberate marketing of circumvention, conducted at arm’s length through affiliate programmes.” That is LaLiga’s characterization, not a Commission finding.

Territorial restrictions and court-ordered blocks are different issues
The reported submission discusses both guides for reaching broadcasts available in other territories and methods of bypassing site blocks. A territorial restriction may reflect broadcast licensing; the reporting does not say that every attempt to reach a foreign broadcast involves a pirate stream. Separately, bypassing a court-ordered block is the specific conduct LaLiga says its request addresses. These should not be collapsed into a claim that every VPN use, or every use of a VPN to watch a foreign broadcast, is piracy.
What the EU Counterfeit and Piracy Watch List means
The Commission describes the Watch List as a non-exhaustive account of services and marketplaces reported to be among the most problematic for intellectual-property infringement. Its stated aim is to encourage operators, owners, authorities and governments to reduce infringing goods and services. The Commission expressly says the list “does not purport to make findings of legal violations.” The Commission’s consultation page explains the list’s purpose and limits.

That makes a possible Watch List entry different from a court ruling. Inclusion would not by itself establish that a provider broke the law, prohibit its service, or constitute an EU-wide ban. The consultation also invited service providers to describe measures they take to avoid or reduce third-party infringement on their services.
Consultation and publication timetable
The Commission opened the 2027 consultation on 11 June 2026. Submissions were due by 23:59 CEST on 21 September 2026, and replies to contributions were invited through 28 October 2026. The Commission planned to publish the 2027 Watch List in the second quarter of 2027. The reported request is therefore a submission for consideration, not an accepted listing.

How the Spanish court measures fit in
There is a separate Spanish court proceeding involving two of the named providers. In a statement dated 17 February 2026, LaLiga said Commercial Court No. 1 of Córdoba had granted precautionary measures it requested with Telefónica Audiovisual Digital against NordVPN and ProtonVPN. LaLiga described the measures as requiring the companies to make claimant-provided IP addresses associated with illegal transmissions inaccessible from Spain. This is LaLiga’s account of the orders, not an independent summary of the court’s full reasoning. LaLiga’s statement gives its description.
TorrentFreak later reported that the court refused to fine NordVPN over alleged noncompliance, citing frequent changes to the targeted IP addresses, and that the main proceedings remained ongoing at the time of its report. That procedural update is reporting, not a final ruling on the merits. The Córdoba measures concern specified IP addresses and named providers; they are distinct from the Commission’s broader consultation about a 2027 Watch List.

Is NordVPN being banned in Spain or by the EU?
The cited sources do not establish an EU ban on NordVPN, Proton VPN, ExpressVPN or Surfshark. Nor does the reported Watch List request itself show that Spain has banned either NordVPN or Proton VPN. The Spanish measures LaLiga described concern access from Spain to particular IP addresses associated with illegal transmissions, while the EU matter is a request for consideration under a non-exhaustive watch list. The court proceedings’ eventual outcome and the Commission’s 2027 decision are not established by the cited reports.
