A federal judge has temporarily halted covered border-barrier construction in Texas’s Big Bend region while a lawsuit proceeds. Judge Kathleen Cardone said the plaintiffs were likely to succeed on at least one claim, likely to suffer serious, irreparable harm without an injunction, and supported by the balance of equities and the public interest. The ruling is preliminary: it does not decide the lawsuit’s claims for good.
What construction does the injunction stop?
Marfa Public Radio reported on October 2, 2026, that the injunction covers construction in the Big Bend Border Patrol Sector within one mile of the Rio Grande and within the state and national parks. The written order was not independently checked for this account, so that geographic description is attributed to Marfa Public Radio. The report also said federal waivers for the sector were no longer in effect during the construction pause.
This is a defined regional restriction, not a halt to every border project in Texas or nationwide. It applies while the case moves forward; the judge has not permanently cancelled the projects.
Why did the judge block the projects?
In its account of the October 2 ruling, Marfa Public Radio quoted Cardone: “The Court finds that Plaintiffs are likely to succeed on the merits of at least one of the claims in suit, that there is a likelihood that they will suffer serious, irreparable harm without an injunction, and that the balance of the equities and the public interest weigh in their favor.” Those are preliminary-injunction findings, not a final ruling that the plaintiffs have proved their case.

The plaintiffs are the Center for Biological Diversity, Friends of the Ruidosa Church, and Billy Miller, a river guide and landowner. Their suit challenges five contracted border-wall projects on constitutional grounds, including separation of powers and the alleged deprivation of citizens’ land. The plaintiffs also contend that federal waivers bypassed environmental, cultural, and archaeological protections. Those remain allegations for the court to resolve.
What do the two sides say is at stake?
Residents and challengers’ concerns
Challengers and local residents have raised concerns about lasting effects on the Big Bend landscape, river access, private property, local livelihoods, historic resources, and protected areas. The injunction preserves the covered area from construction while the court considers the legal challenge; it does not itself establish that every alleged harm will occur.

The administration’s security rationale
The administration says physical infrastructure is necessary for border security. U.S. Customs and Border Protection said, as reported October 2, 2026: “We stand by our assessment and remain confident in our legal authorities to secure the border while preserving the unique landscape of the Big Bend region.” The litigation will address the challengers’ claims about the government’s authority and the effects of the projects; the injunction does not settle that dispute.

Marfa Public Radio also reported, citing CBP data, that the sector historically has had the fewest apprehensions and drug seizures. That context describes enforcement activity; it was not identified as a finding by Cardone in the injunction ruling.

The injunction pauses only the construction it covers as the lawsuit proceeds. The case still has to resolve the plaintiffs’ claims, and the administration may continue to argue that the projects are within its legal authority and serve border security.

Before the injunction, CBP was considering adjustments to the national-park project after stakeholder input. The Associated Press reported on September 30 that the agency had not specified those changes. The October 2 coverage establishes the injunction and the reported pause, but does not establish whether the administration has appealed, whether the injunction has since changed, or what final project revisions were made.
