An upper circuit is the highest price an exchange permits for a security during a trading session. You cannot execute a buy above that active ceiling. A buy order exactly at the ceiling may be accepted yet remain pending because execution still requires a seller, and a market order may be protected, converted to a limit order, or cancelled rather than filled automatically.
What an upper circuit actually limits
Indian exchanges calculate a permitted price band around a security’s base price. The upper edge of that band is commonly called the upper circuit. It is a trading control, not a guarantee that the security will trade at the ceiling. The exchange can accept orders inside the band, but its matching engine cannot create a trade when no opposite-side order is available.
The National Stock Exchange (NSE) describes the band as a pre-defined percentage of the base price for each security or contract. For securities assigned a fixed daily band, NSE lists 2%, 5%, 10% and 20% categories (NSE, 2023). The applicable percentage depends on the instrument and exchange classification, so the band shown in your trading screen is the controlling value for that session.

- Price limit: the highest permitted buy or trade price for the current session.
- Order acceptance: the exchange or broker records an order after validating its price, quantity and other controls.
- Order matching: the engine pairs a buy with an eligible sell. Acceptance does not imply a fill.
- Execution: a trade occurs only for the quantity that can be matched under price-time priority.
This distinction explains why a stock can display an upper-circuit price while many investors still have unfilled buy orders.

Fixed bands and dynamic operating ranges
Not every security uses the same type of restriction. Compare the mechanisms before interpreting a rejection or a sudden change in the displayed range.

A dynamic relaxation is not an automatic widening of every stock’s band. It applies only to eligible instruments under the exchange’s conditions. A fixed-band stock can remain locked even while another security’s operating range is relaxed.
Can you place a buy order above the upper circuit?
No. A buy limit above the active upper band is outside the exchange’s permitted range. Depending on the security, trading session and broker validation, the order may be rejected immediately, put into a price-freeze state for validation, or cancelled. NSE’s special pre-open example says an order outside the operating range results in a price freeze and is subsequently cancelled.

What happens after you submit the order
- Price validation: the broker checks the order against the latest band or operating range it receives from the exchange.
- Exchange validation: the exchange checks whether the price is within the currently permitted range. A value above the ceiling fails this control.
- Freeze or rejection: an invalid order can receive a price-freeze or rejection message rather than entering the normal queue.
- Cancellation: a frozen order that is not brought within the permitted range is cancelled under the applicable session rules.
Do not respond to a rejection by repeatedly resubmitting a higher price. The higher price cannot bypass the ceiling; first confirm the current band, the trading session (regular, pre-open or special session) and whether the exchange has announced a dynamic-range change.
Order at the ceiling price
A limit order at the exact upper-band price is different. It is within the permitted range and may be accepted, but it executes only when a seller offers shares at that price. If buy quantity exceeds available sell quantity, accepted orders wait in a queue. Price-time priority gives earlier orders at the same price precedence, so a later order can remain pending even when the screen shows trades at the upper circuit.
Why an upper-circuit order stays pending
At a locked upper circuit, the order book often contains many buyers and few or no sellers. The matching engine cannot fill the buy side from demand alone. NSE calls unmatched orders passive orders and incoming orders that match them active orders.

Queue position and partial fills
Suppose the ceiling is ₹100 and the offer side contains only 500 shares at ₹100. If buy orders totaling 20,000 shares arrive at that price, only 500 shares can execute unless new sellers enter. Orders are served in timestamp order. A trader near the front may receive a partial fill, while a later order remains fully pending. The displayed traded price of ₹100 therefore does not mean every ₹100 buy order has filled.

Editing a limit order often creates a new timestamp; check your broker’s modification rules before changing quantity or price.
Pre-open orders and timestamps
NSE’s pre-open rules distinguish unmatched passive orders from incoming active orders. When an unmatched limit order moves from pre-open into normal trading, NSE rules retain its original timestamp. That treatment can preserve its priority, subject to the security’s specific session rules. An order frozen for being outside the permitted range is not equivalent to an accepted passive order and can be cancelled instead.

Will a market order execute at the upper circuit?
No market order guarantees a fill at the upper-circuit price. A market order normally asks for the best available price, but circuit conditions can leave no eligible offer. Market-price-protection controls used by a broker or exchange may convert the order into a limit order at the prevailing circuit price. In some illiquid instruments, the protected market order can be cancelled.
Why protection changes the result
- No seller: conversion to a ₹100 limit order still needs a seller at ₹100.
- Protection limit: the converted limit can wait in the same price-time queue as other ₹100 buys.
- Illiquidity rule: the broker or exchange may cancel the order instead of leaving an unbounded market instruction.
- Price movement: if the operating range is relaxed, the permitted price may change, but the original protected order does not become a guaranteed fill.
Read the order confirmation for the resulting order type, limit price and status. “Market” in the original ticket does not tell you whether the final order remained market or was protected as a limit.
Dynamic-band relaxation: when the ceiling can move
Exchanges can relax an operating range for eligible securities when trading approaches a boundary. SEBI describes relaxation in 5% increments when a market-wide trend is observed, while NSE describes an initial 10% operating range for specified derivative-linked securities. Once relaxed, members can place orders up to the revised upper or lower band.

Three cautions matter:
- The mechanism is for eligible instruments, not every listed stock.
- A revised range changes the allowed price interval; it does not create sellers or guarantee execution.
- A broker’s displayed band can lag an exchange update briefly, so rely on the latest exchange status and the broker’s validation message before resubmitting.
For a fixed-band security, assume the original ceiling remains in force unless the exchange explicitly publishes a change.

A stock locked at its upper circuit can still have matching in that security if sell orders appear at the permitted price. A market-wide circuit breaker is different: when NIFTY 50 or SENSEX thresholds are breached, SEBI requires the exchange to stop matching orders to create a trading halt. The halt applies across the market and follows a prescribed reopening process.

Does a pending order carry over to the next day?
There is no universal carry-over rule for an upper-circuit order. Survival beyond the session is controlled by the order-validity instruction, the broker’s product rules and the exchange segment. An order that is merely pending is not automatically converted into a next-day order.
Before relying on a queue position, open the order details and verify:
- the validity label (for example, session-day, immediate-or-cancel or another broker-supported instruction);
- whether the broker cancels unfilled orders at the session close;
- whether the order is in the regular, pre-open or a special trading session;
- whether an exchange freeze or cancellation notice has changed its status.
If the order is cancelled, you must submit a new order on the next session and will normally receive a new timestamp. NSE’s documented retention of original timestamps concerns unmatched limit orders moving from pre-open to normal trading, not an automatic carry-over from one trading day to the next.
A practical workflow for placing an order near the ceiling
- Identify the instrument: confirm the exact exchange, series, derivative status and trading session.
- Read the live band: record the displayed base price, lower limit and upper limit; do not infer the limit from yesterday’s close.
- Choose the order type deliberately: use a limit price within the displayed range when price control is more important than immediate participation.
- Check the offer quantity: inspect the sell side at the ceiling. No offer means no immediate fill, regardless of your order’s validity.
- Submit once: repeated edits or cancellations can change queue priority and increase the chance of a stale-price rejection.
- Monitor status: distinguish open or pending, partially filled, rejected, frozen and cancelled. Each status requires a different response.
- Recheck after a range change: if the exchange relaxes the operating range, confirm the new ceiling before modifying an existing order.
- Verify end-of-session treatment: confirm whether the broker will cancel the order or leave it eligible under its stated validity rule.
Common messages and appropriate fixes

What the upper circuit does—and does not—tell you
- It tells you the maximum permitted price under the current band or operating range.
- It does not tell you that a trade occurred at that price for your account.
- It does not guarantee that a market order will execute.
- It does not predict how many shares will be available to buy.
- It does not mean the band will be widened; dynamic relaxation is conditional and instrument-specific.
- It does not describe a market-wide halt, which follows separate index-triggered rules.
Band percentages, dynamic-range criteria, market-price-protection behavior and order-validity rules can change through exchange circulars and can differ by instrument. Before submitting an order, check the security’s current NSE or BSE band, the live order book and the broker’s exact rejection or validity message. No published statistic establishes the probability that an upper-circuit order will fill; the decisive factors are available sell quantity, queue position and the session rules in force.
